Council met in adjourned easel= pursuant to adjournment on April 28th, 1930, with Mayor MaConnel presiding, and Councilmen, Bollman, Dickens, Gordon, Johns, and Sandmeyer, Present, Absent, Leighty. owing to the absence of the City Clerk, the Mayor appointed Mr. W. 0. Dyer eating Olerk and announced that the Council was in session for the considers - tion of any business which might lawfully come before it. Thereupon, Councilman Dickens presented the following Resolution: RESOLUTION NO. 33 Filed Apr. 30 -1930 W.C.Dyer Acting City Clerk, By Dickens A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS FOR THE CONSTRUOTION OF IMPROVEMENTS IN LOCAL STREET IMPROVEMENT DISTRICT 30. 9, OF THE OITT OF CALDWELL, IDAHO. WHEREAS. The Mayor and Council of the City of Caldwell, Idaho, have here- tofore, duly and regularly, as required by law, created Local Street Improvement District No. 9, of the City of Caldwell, Idaho, for the purpose of constructing in said district, improvements consisting of am4pbs and gutters along and upgn the streets In said district, amd WHEREAS, The City Engineer of the City of Caldwell has prepared and filed with the City Clerk of said City, plans and specifications for the construction of said improvements in said Local Street Improvement District No. 9, which said plans and specifications have been presented to the Mayor and City Council for approval; NOW„ THEREFORE, BE IT RESOLVED AND ORDERED By the Mayor and Council of the City of Caldwell, Idaho: section 1. That the plans and specifications heretofcr prepared by the City Engineer and filed with the City Clerk of the City of Caldwell, for the con- struction of certain improvements authorized in said Local Street Improvement District No. 9, of the.City of Caldwell, Idaho, including the construction of curbs and gutters in said district, be and the same hereby are approved. Thereupon, it was moved by Councilman Dickens, seconded by Councilman Bollman that the above Resolution No. 33 be adopted. The question being, "Shall the Resolution pass ?" the Mayor directed the Clerk to call the roll which resulted as follows: Those voting in the affirmative: Bollman, Dickens, Gordon, Johns and Sandmeyer. Those voting in the negative: None. Absent: Leighty. Thereupon, the Mayor declared the motion carried and Resolution No. 33 adopted and directed the Clerk to,record the same upon the journal or proceedings of the Council as a part of the minutes of this meeting. And, thereupon, the Mayor and Clerk in open session of the Council signed and approved said Resolution. Thereupon, Councilman Bollman presented. the following Resolution: RESOLUTION NO. 34 By Bo].lman A RESOLUTION ACCEPTING TEIE ASSESSMENT ROLL OF LOCAL STREET IMPROVEMENT DISTRICT 30. 9; AUTHORIZING THE CLERK TO GIVE NOTICE OF THE TIME AND PLACE FOR HEARING AND CONSIDERING OBJECTIONS TO SAID ASSESSMENT ROLL; AND FIXING THE TIME WHEN OBJECTIONS THERETO WILL BE HEARD AND CONSIDERS®, WHEREAS, The assessment roll of Local street Improvement District No. 9, of the City of Caldwell, Idaho, has been completed, according to the provisions of the Iowa of the State of Idaho and the ordinances bf the City of Caldwell, and add assessment roll having been so prepared by the committee on Streets. together with the 01ty of 8sid 0ity had by them certified to the City Council of said City, all as required by law and the ordinances of said city; NOW, THE -MORE, BE IT RESOLVED By Mayor and Council of the City of Caldwell, Idaho: Section 1. That said assessment roll of Loa-al Street Improvement District No. 9, of the City of Caldwell, Idaho, be sooepted and placed on file in the atfice of the City Clerk. and said City Clerk ie hereby authorized and directed to give due and legal notice, in compliance with the provisions of law, to the property owners, as required by Chapter 257 of the 1927 Idaho session Laws, giving aotioe among other things that said assessment roll is on file in his office, the date of filing the Hams and the time atld place at which the Council will hear and consider objections to said assessment roll by the parties aggrieved by ouch assessments and that the owner or owners of any property which is asesseed in such assessment roll, whether named or not in said roll, may within ten (10) days from the first publication provided for in said notice, file with the Clerk of said City, his or their objections in writing to said assessment; which said objections, if any, will be considered by the Mayor and Council In the Council Chambers in the City gall of said City on the ]E'th day of May, 1930,_ - at 8: O'clock P.M. Section 2. That said notice be published in the Caldwell News - Tribune, the official newspaper of sold City in the issues of May lot, 1930, May 8th, 1930, and May 8th, 1930. 'Thereupon, it was moved by Ccuneilmah Sandmeyer, seconded by Councilman Gordon that the above reaolution No. - 34 be adopted. The question being, "Shell the Resolution pass?" The Mayor directed the Clerk to call the roll which resulted as follows: Those voting in the affirmatives Bollman, Dickens, Gordon, Johns and sandmeyer. Negatives None. Absent, Leighty. Thereupon, the Mayor declared the motion carried. Thereupon, motion was made by Councilman Bollman, seconded by Councilman Diokens th8t further oonsideration of the bid of H. J. McNeal for perfo ming labor, furnishing material and constructing the works proposed to be constructed in Local Street Improvement District No. 9, of the City of Caldwell, Idaho, be continued for further consideration to the meeting of the Mayor and Council to be held in the Counoil Chambere in the City Hall, in the City of Caldwell, May 5th, 1930, at eight o'clock P.M. Those voting in the affirmative: Bollman, Dickens, Gordon, Johns and Sandmeyer. Those . voting in the negative: None. Absent and net voting: Leighty. Thereupon, the Mayor declared the motion carried. Upon Motion by Gordon seconded by Johns, The City Engineer be instructed to draw specifications for drilling a well at swimming pool. Motion carried. J J Motion by Johne seconded by Dickens, that Telephone Company bb notified to remove its poles on Kimball Avenue from the Alley North of Albany Street to the Alley South of Cleveland Boulevard. or franchise will be cancelled. F 1, Council met in regular session pursuant to law with Mayor MoOonnel presiding, and Councilmen, Bollman, Diokens. Johns, Leighty and Sandmeyer, present. Absent, Gordon. owing to the absence of the City Clerk, the mayor appointed Mr. W. C. Dyer Aoting Clerk, and announced that the Council was in session for the consid- eration of any business which might lawfully come before it. Mr A. R. Oolvard appeared before the Council and requested that provisions be madl to take care of the water standing near hie residence occasioned by lack of proper drainage and obstructions in the drain ditch. After discussing the subject with the Council the EQayor referred the matter to the City Engineer for inveetigatiom and attention. Messrs.. 0. 10. Oellien, C. Francis Miller, H. G. Peckham, and w. F. Homan, representing Intermountain Co- operative Gas & Oil Company, appeared before the Council and requested the passage of an ordinance granting a franchise to intermountain Cc- operative Gas & 011 Company, for the laying of gas pipes and mains in the streets and alleys in the city. A proposed form of ordinance was read and oonsider%d by the Council, whereupon the Mayor directed. the City Attorney Frank E. Meek and Attorney U. H. Eustace, to redraft the ordinance and present it for oonsiderat3on of the Counoil at its neat meeting. Thereupon, motion was made by Councilman Dickens seconded by Counoilman Leighty that further consideration of the bid of H. J. McNeal for performing labor, furnishing material and constructing the works proposed to be constructed in Local Street Improvement District No. 9. of the City of Caldwell, Idaho, be continued for further consideration to the meeting of the Mayor and Council to be held in the Counoil •Chambers in the City Hall, in the City of Caldwell. Play 12; 1930, at 8 :00 o'clock Y.M. Those voting in the affirmative: Bollman, Dickens; Johns, Leighty and Sandmeyer. Those voting in the negative: None. Absent and not voting; Gordon. Thereupon, the kayor declared the motion carried. un motion made by Sandmeyer and seconded by Bollman the following bills were allowed and warrants ordered drawn on the various funds in payment thereof, to -wit:
