A meeting of the City Council met on call of the Mayor in the Council Room of the City Hall with the Mayor, Fred L. Lilly, presiding. On Roll Call, the following Councilmen answered present: M. S. Sandmeyer, A. G. Keister, 0. E. Bales, 0. M. Johnston, Joe Dickens and E. L. Vassar. The Minutes of April 3rd. April 14th. and April 24th were read and apnroved as re Attorney S. Ben Dunlap and L. A. Waterman again appeared and stated that they had secured Affidavits from the former Mayor, Fred H. No Cannel and from each of the foil owing former Councilmen: F. E. Bollman, Joe Dickens, W. H. Johns,C. H. Leighty and M. S. Sand — meyer setting forth the substance of the agreement between the Messrs. L. A and W. K. Waterman and the City of Caldwell pertaining to their ditch rights on certain real propert which lies due west of the North Eighty of the City's Airport tract. All of these Affidavits were received, read and filed. Agreement Mr. Dunlap also presented the following RA219RAI which was read before the Ocunct A G R E E M E N T. THIS AGREEMENT, Hade in duplicate this 29th day of April, 1933, by and between the CITY OF CALDWELL, IDAHO, a municipal corporation, party of the first part and L. A. Wat— erman and Ruth Waterman, his wife, residing at Caldwell, Idaho and W. K. Waterman and Gladys Waterman, residing at Middlet:n, Idaho, parties of the second part, WITNESSETH: WHEREAS, The Parties hereto did in the spring of 1929, make that certain agree— ment hereinafter set forth and, WHEREAS, It appears that said parties failed through anadvertance and error to pu said agreement into writing, and WHEREAS, It further appears from the affidavits of Fred H. Mo Connel, 0. H. Leigh F. E. Bollman, Joe Dickens, W. H. Johns and M. S. Sa.ndmeyer, they being in the spring of 1929 the Mayor and members of the City Council of the party of the first part, that Bald agreement was made by said persons in behalf of said city in regular session of the Mayor and Council, duly called and held, said agreement being as hereinafter appears and said affidavits being this day filed with the City Clerk of Bald City, and WHEREAS, It further appears that the party of the first part hereto acting under said agreement and pursuant thereto and by and with the consent of the parties of the second part, did fill in and cover up a certain ditch then running through the center of t airport property of the said city, which said ditch had been used by the parties of the Beooud part hereto oontinuoualy for years orior thereto in the irrigation of their land hereinafter desoribed,•and that said party of the first part did also build and provide a drain ditch on the South side of the sity's airport property through which, by its consent and pursuant to said agreement, water has been conveyed for use of eaid land of the partie of the second part,.hereinafter described, and did also construct a ditch for the use of said land of the parties of the second pat, fronm said drain ditch along the Nast line of the South Half (3-) of the South Half (*) of Section Twenty (20), Township Four (4) North Range Three (3) West of the Boise Meridian, and did also in the spring of 1929, build a concrete diversion dam for the purpose of diverting water to the said land of the parties of the second part, and has since the construction thereof exclusively maintained andieg— ulated said diversion dam and its headgate, all of which was done by the party of the first part, pursuant to said agreement and in consideration of the parties of the second part surrendering and giving up their right to the use of their said ditch running through the airport property which was filled in by the party of the first part, as aforesaid, and Al 183 April 29, 1 933 WHEREAS, The said parties hereto desire to put into writing the agreement made U El D a by and between said parties at said time, said agreement being as hereinafter appears; NOW, THEREFORE, THIS AGREEMENT WITNESSSETH: That the parties hereto for and in consideration of the Sum of One Dollar ($1.00) each to the other in hand paid and other good and valuable considerations, do hereby agree as follosta: That the parties of the seoond part now are and were in the spring of 1929, and for the years prior thereto had been the owners of certain real property situate in the County of Oanyon, State of Idaho, described as follows; The North Half (N2) of the South Half (S2) of Section Twenty (20), Township Four (4) North, Range Three (3) West of the Boise Meridian. That said property of the parties of the second part herein described then had for and now has a valid subsisting right to a right of way /ditch purposes through the said property owned by the said party of the first part and used by it for airport purposes. That the parties of the second part have consented and do hereby consent to and agree with the party of the.firet part to surrender and release Said ditch right and 'further agree that said party of the first part may continue to use and occupy Said ditch right. IT I9 FURTHER MUTUALLY COVENANTED AND AGREED, That party of the first part will and does hereby convey to the parties of the second part for the use of their land here— in above describet, the perpetual right to convey water through said ditch hereinabove referred to, to the Southeast corner of Said Section Twenty (20), Township Four (4) North, Range Three (3) West of the Boise Meridian, in Canyon County, Idaho, and from thence in a Northerly direction through that said certain ditch which was built for them by said party of the first part for said purposes along the East line of the South Half (S2) of the South Half (32) of the South Half (S2) of said section to the said lied of the parties of the second part. IT IS FURTHER MUTUALLY GOVENANTED AND AGREED By and between the parties hereto that the party of the first part has constructed and will perpetually maintain for the use and benefit of the said land of the parties of the second part, a good and sufficient concrete diversion dam and headgate on the Southeast corner of said Section Twenty (20), Township and range aforesaid, and will at all times keep said diversion dam and headgate in good repair and of sufficient construction for the delivery of water to the said proper of the parties of the second part; it is further mutually covenanted and agreed by !nd between the pities hereto that party of the first part shall at all tires, have and retain the right to regulate the headgate in said dam and that the said party of the first part will at all times hereafter regulate said diversion dam during the irrigation season as requested by the owners of the traot of land herein described as belonging to the said parties of the second part. It is further mutually covenanted and agreed by and between yhe parties hereto that said diversion dam has been constructed and wil be hereafter maintained for the stole and exclusive benefit of the ,land of the parties of the second part herein described except that in the event tb.t arty of the first kFart should become hereafter obligated for the delivery of water to that certain tract of land known as the Dan Ruby Tract of hd,nd, said � Pf the first part may use adid diversion dam for the diverting water therefor. It 15 1URTHEA MUTUALLY COVENAETBR Ald AgREEd By and between the Pasties hereto that the owners of the tract of land herein described as belonging to the parties of the Second part shall have the right to have the Flash Boards of the headgate in the diversion dam hereinabove referred to entirely removed at Such times as they axe /usbrig Said diversion dam and headgate for the purpose of diverting water to the tract of land herein described 164 ril 29, 1 as belonging to the parties of the second part, provided, further, however, that in the event the party of the first part becomes liable for the diversion of water to the said Dan Ruby tract of land and decides to use said diversion dam for said purpose, that it may do so. Thereupon, the Mayor declared the motion carried by the necessary vote. The Mayor then Signed the Agreement, which eas duty attested by the City Clerk/ 19. S. Sandmeyer as follows: A RESOLUTION AUTHORIZING THE CANCELLATION OF CERTAIN SPECIAL CITY TAXES, LEVIED AND ASSESSED AGAINST THE PROPERTY HEREIN DESCRIBED. WHEREAS, Nellie G. Doolittle is the owner of the Northeast (NE) Seventy -two (72) feet of Lot$ One(1), Two (2) and Three (3) of Block 100 of Goandu Addition to the City of U aldwell, Idaho,, as shown by the official plat thereof on file and of record in the office of the Recorder of Oanyon County, State of Idaho; and WHEREAS, Special City Taxes for the years 1924, 1925 and 1926, to -wit; the Sprinkling Taxes are unpaid and delinquent, and WHEREAS, It has been determined by the Mayor and Council of the City of Caldwell Idaho, that it is for the beat interests of the said City that the Sprinkling Taxes for Bald years, together with all penalties, charges and interest thereon be cancelled, NOW, THEREFORE, BE IT RESOLVED, That the Sprinkling Tax, together with all c oharges, penalties and interest thereon assessed against said property for the years 1924, 1925 and 1926 be, and the same are hereby cancelled and said lots be, and the same i are relieved from liability for the payment thereof. PASSED by the Council this 29th, day of April, 1933. Absent and not voting, None. Thereupon, the Mayor declared the above Res- olution adopted by the necessary vote. The Clerk read the Annual Report of the Fire Chief as follows; To the Hon. Mayor and City Council City of Caldwell, Idaho, Gentlemen; 186 ril N I have the honor to transmit herewith the Annual Report of my department for the II year ending April 30, 1 933• You will find herewith a sertee of tabled showing in condenswd form the ,present status of the personnel and equipment of the Fire Department and also a composit report of the activities of the department for the fiscal year beginning May 1,1932 -ending May 1, The most riotible improvement in the fire- fightin: facilities during .the past year is the replacement of the old wooden water mains with new cast pipe which has allowed an increasw of hydrant_ water nreseure an average of twelve pounds, T his increase of water pressure and the addition and re- location of a number of the fire hydrants will tend towarc removing any threat: of an increase in insurance rates. The buildinng inspection has been carried on at the same level as formerly, the business district aiid schools being covered at irregular intervals during each two weeks. The inspection trips are not made at any specified dates because of a tendency of the Public towards expectation and preparation for any regular tripe. In conclusion, I desire to call attention to the activities of the department during Fire Prevention Week. Relative thereto, I may say that the department has received letters of high commandation from both our State Board of Underwriters and The National Board of Underwriters. They make special note of the emoellent results shown at the fire drills held in the schools. I desire to express my sincere thanks to your Honorable Body for your considerate co- operation and pleasant relatione during the past.year. Respectfully submitted. It appearing that the report of the Judges of the Second Ward did not agree with the Tally Sheets. Moved by 9andmeyer and seconded by Johnston that the Council reject the returns of the Second Ward of the Municipal Election, held on April 25, 1 933 because of ambiguity and uncertainty, and that the Chief of Police be directed to call together the Judges, Clerks andConstable of Election at the voting place of said Ward for the purpose of correcting and certifying the results. On Roll Call, the following Councilmen voted In favor of the motion: 9andmeyer, A. G. Keiater, 0. E. Bales, C. M. Johnston, Joe Dickens and E. L. Vassar. Those opposed, None.
