Reminder on Special Council Meeting
Mayor Carpenter reminded those Councilmen present of the coming special meeting for opening bids o
construction work under Local Improvement District No. 66 and said the Resolution for petitioning the State
Tax Commission for an increase in the tax limitation would also be presented for the consideration of the
Council at that special meetirp

It was moved by Councilman Martin, seconded by Councilman Keys, that the warrants for claims be
approved as per list and filed in the City Clerks office. Such warrants being in the totals as follows

A vote was taken and the motion carried.
It was moved by Councilman Banks, seconded by Councilman Davenport, that the meeting recess until
4:00 P.N. on the 27th day of April. A vote was taken and the motion carried. The meeting recessed at 10:10

The Council met pursuant to recess and acknowledgement of notice in the following form:
We, the undersigned Mayor and Mlembers of the City Oouncil of the City of Caldwell. Idaho, do hereb
acknowledge notice of a Special Meeting of the said City Council to be held in the Council Chambers in the
City Hall in the City of Caldwell, Idaho, at the hour of 4:00 P. M., on the 27th day of April, 1970, for the
transaction of all business in connection with the following objects: Consideration of authorizing the fill.

Upon Roll Call, the following Councilmen answered present: Charles C. Banks, James W. "Bill" Key
V. Jay Martin, C. A. "Chat" Davenport, and James R. Dakan. Absent: Alfred H. McCluskey.
Report on error in time for Bid opening - L.I.P. #66
City Engineer Mel Lewis informed the Council in that it had been intended to eliminate Nnuntain
Standard Time from the invitations for Sid opening for bidding the construction work under local Improvement
Distrlct.No. 66 and for the bids to be opened now, however, the wording Mountain Standard Time had gotten ba lk
into the invitations somehow and he wouldn't be to concerned with this excepting that all the Plans were not
back in. He said he didn't know if Garrison -Young intended to bid nor did he know if Ray Kinney of Ontario,
Oregon intended to bid. It was agreed that the Council proceed with the other consideration for this specie

meeting and, during this time, the City Engineer attempt to telephone those mentioned in order to determine II

Presentation of Resolution for relief from Levy limitations of 63- 2220, Idaho Code
In presenting the Resolution authorizing the filing and prosecuting of a Petition before the Tax
Commission of the State of Idaho for relief from the levy limitations of 63 -2220, Idaho Code, and, in answer
to the question by Councilman Martin; Vayor Carpenter said there were problems in financing the General Fund,
Fire Fund, and Street Fund of the City and the necessary items for which the City needed relief in these fund
were being itemized in the Petition now being prepared. The Mayor referred to the additional costs, among
others, of such needs as for additional men in the Police Department and the Fire Department, and additional
City costs in connection with the one -way couplet on Blaine Street.
Resolution No. 14
Councilman Martin sponsored the following Resolution and moved its passage:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CALDUELL, IDAHO, AUTHORIZING THE FILING AND PROSECUTING OF A
PETITION BEFORE THE TAR COMMISSION OF THE STATE OF IDAHO FOR RELIEF FROPA THE LEVY LIMITATIONS OF 63 -2220,
IDAHO CODE.
WHEREAS, 63 -2220 Idaho Code provides levy restrictions for a d valorum tax revenue of 105% of the
1969 tax charges, and,
WHEREAS, The 1970 budget of the City of Caldwell, Idaho, requires an increase above said limi tatio[
due to change in conditions and circumstances of said City to provide the necessary services for public
health, safety and welfare, and,
WHEREAS, The question of an increase of 1970 tax levy in excess of the limitations of 63 -2220,
Idaho Code, has not been submitted to the voters for approval, and,
WHEREAS, The City Council deems it essential for the public health, safety and welfare that said
Council on behalf of the City of Caldwell, Idaho, petition the Tax Commission of the State of Idaho for
relief from said limitation as provided in 63 -2220, Idaho Code.
NOW, THEREFORE, Be it RESOLVED by the Mayor and City Council of the City of Caldwell, Idaho:
Section 1. That a petition be filed and prosecuted by the City Council on behalf of the City of
Caldwell, Idaho, with the Tax Commission of.the State of Idaho under the provisions of 63 -2220, Idaho Code,
and the rules of the Idaho State Tax Commission governing procedure for relief from the levy restrictions of
said law for 1970.
Section 2. That the Mayor and City Clerk are authorized and directed to execute and attest said
petition on behalf of the City Council and City of Caldwell, Idaho.
The motion for passage was seconded by Councilman Dakan. A roll call vote was called for when the
following Councilmen voted in the affirmative: Banks, Keys, Martin, Davenport, and Dakan, Negative votes:
none, Absent and not voting: LScCluskey. Mayor Carpenter declared that Resolution No. 14 had passed.
Report on Blaine Street project
With reference to the Blaine Street project, Mayor Carpenter informed the Council that last Friday
the City had been informed that there would be a delay in the time for starting the project; that it was
scheduled to start right after the first of July but due to the slowness of the receiving of Federal Funds,
it would be postponed until fall. He said that, in discussion with the State, it had been emphasized that
the City wanted them to go right ahead just as fast as they could in the development of the project rather
than to postpone it any length of time other than beyond their needs.
Mayor Carpenter also told the Council that the State Highway Department officials planned on meet-
ing with the Council at a future date, probably the 18th of May, and they would have more details on the
the construction of the street and the development of it including that of covering all of Indian Creek in
the proposed one -unit project in which they had obtained permission from the Federal Bureau of Roads who
designate the financing into the highway funds. The Mayor told the Council that covering of the Creek could
be brought under the Federal Fund portion which would make the City's cost quite a bit less than what they
would otherwise have and would provide a structure whereby it would be strong enough to support parking and
cover the creek completely between the two blocks. He said there would be some investment but he thought the
added amount of monies could even be budgeted next year because it would be next year before that portion of
the work would be completed and it would make a real good unit for additional parking; that the Bureau of
Roads realize two things in that it is a safety project as ,.ell as a polution project and, with these two
things involved, it was easier to get Federal Funds.
Bids opened for construction work under L.I.D. #66
The next item of business was the consideration of bids for construction work under local Improve-
ment District No. 66.

City Engineer Mel Lewis reported that he had been unable to contact Ray Kinney at Ontario but had
.ad with his wife and she had informed him that she was sure Mr. Kinney did not plan on submitting a bid
doing the construction work under Local Improvement District No. 66. Mr. Lewis told the Council that he
not been able to contact Garrison Young. The Council then proceeded to open those bids received and they
as follows for total bid per schedules

The Engineer's estimate for Schedule A was in an amount of $41,454.60 and for Schedule B an amount
$8,157.99 for a total estimate of $49,612.59. Mr. Lewis told the Council that the low bid of the J. M.
is Construction Company was over the estimate in an amount of $2,566.18 but that the District could cover
amount of the bid over the estimate.
It was moved by Councilman Keys, seconded by Councilman Dakan, that we award the bid to the low bid
the J. M. Hess Construction Company in an amount of $52
In answer to the question, the City Attorney advised the Mayor and Council in that they had the
Pt to accept or reject aiy and all bids and that, unless the bid was so far out of line that they would
it to again advertise for bids, they could award to the low bidder.
A vote was then called for on the motion to award the bid and the motion carried.
It was moved by Councilman Banks, seconded by Councilman Davenport, that the Special Meeting
burn. A vote was taken and the motion carried. The meeting adjourned at 4:40 P. M.

The regular monthly meeting of the City Council met in the Council Chambers of the City Fall with
Mayor Charles W. Carpenter presiding.
Upon Roll Call, the following Councilmen answered present: Charles C. Banks, James W. "Bill" Keys,
V. Jay Martin, C. A. "Chet" Davenport, and James R. Dakan. Absent: Alfred H.'McCluskey.
Ordinance to be drawn amending Chapter of City Cnde entitled "Sale and Distribution of Beer"
It was noted that the regular meeting of the Council had not been held on May h, 1970 for lack of
a quorum. Mayor Carpenter announced that the first order of business would be a consideration of the recom-
mandation of the Council Committee regarding the change of the City Ordinance for the selling of packaged bee:
within the "AB" Residential Zone of the City.
