It was voted on motion of McConnel, seconded by Mumford, that,a further extension a roe. ment for one year be executed by the City of Caldwell and the owners of Lots 9 -16, bo h numbers of inclusive for sidewalk tax oertified in 1920 in New Home Iddition. It was voted on motion of MoConnel, seconded by Conley, that Bill No. 14 be rbais d from the table. It was then voted on motion of Wheeler, seconded by Dutton, that Bill No, 14 be postponed indefinitely. RESOLUTION NO.55, BY MOCONEL ENTITLED " A RESOLUTION REPEALING RESOLUTION NO.43, BNTITLID " A RESOLUTION AUTHORIZIUG AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY OF CALDWELL, IDAHO, TO ENNER INTO A CONTRACT WITH RIVERSIDE IRRIGATION DTSTRICT,LIMITED, AIVING MUTUAL DAMAGES BY REASON OF ENCROACIN�NT OF THE HIGHt ^JAY UP N THE RIGHT OF WAx Or RIVER JIDE CANAL, IN THE CONSTRUCTION OF THE PAVING OF THE OLD OREGON TRAIL FEDERAL AID PROJECT N 1.86B OR DAMAGE WHICH AY ACCRUE IN THE FUTURE ON ACCOUNT OF SEEPAGE, SUBIRRIGATION OR EROSI IN FROM SAID CANAL" PASSED AND APPROVED BY THE Mayor AND COUNCIL OF THE CGTY OF CALDWELL IN THE 18 TH DAY OF OCTOH3R, 1926. BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO. SECTION I. Resolution No. 43 Entitled " A Resolution autheaizing and directing the MW r and City Clerk of the City of Caldwell, Idaho, to enter into a contract with Riverside Irrigation Distriot, Limited, waiving all mutual damggse by reason of encroachment of the highwa upon the right of way of the Riverside Canal, in the oonttruction of the paving on the Old Orggon Trail deral Aid rroject No. 86 B, or damage which may accrue in the future on accounI of seepage, subirrigation or erosion from said canal, be and the same is hereby repealed. a$ A motion was made by Mumford, seconded by McConnel, that Resolution No.55 be ado ted. The MEy or directed the Clerk to call the roll on the aforesaid motion with the follow g result; AYES: CONLEY, DUTTON, MUMFORD, MCCONNEL, AND WHEELER. NAYES: NONE. ABSENT: KIMBROUGH.
