COUNCIL CHAMBERS CALDWELL APRIL, 8, 1921.

Council met in special session as per P:Zayors call, which was read.
The report of F. W. Almond Str.te Medical Advisor, stating that in his
opinion there could be no harm done in the emptying of Sewer District No. 7,
Into the Government Drain ditch if Septic tanks was installed.
On motion of Hayman, seconded by Sutton, the report and recommendation of
the Sewer Committee was duly approved and the City Engineer and Sewer Committee
were directed to cause a septic tank to be constructed and installed at the
outlet of the sewer system in Sewer District No. 7, in compliance with the plans
and specifications submitted with said report, and on file in the office of tha
City Clerk, at a cost not to exceed $800.00.
Motion Hayman, seconded by Sutton,
That cash bid of 3artenbower Brothers of $15.135.80 for the construction
of Sewer District 7, be accepted. Carried.
Motion Sutton seconded by Hayman that meetinh adjourn.'

It was voted on motion of Dunlap seconded by ]Moore, that the Council
precede to canvas the returns of the election held April 26, which was done

The Clerk read the report of the canvassing Board and motion was made by Dunlap,
and seconded by Moore that report be accepted and Certificate of election be issued to

That the rules requiring tho reading of an Ordinance on three separate dates be
suspended and that Ordinance be read the second time by title and the third ti^e in
full and place on.its final passage, on the roll being called on the motion the
vote Was,
Ayes, Dunlap, Fouling, Hayman, Moore, Sutton.
Absent, Westcott.
The Clerk thereupon read the Ordinance the second time by titleand the third time
In full and the Mayor announced the question shall Ordinance No. 357 pass?

AN ORDINANCE AUTHORIZING AIJb PROVIDING FOR THE ISSUANCE AND SALE OF COUPON BONDS
OF LOCAL LATEiiAL SEWERAGE IMPROVEMENT DIST2ICT NO. S. OF THE CITY OF CALDWELL, IDAHO,
IN THE SIPS OF FIVE THOUSAND EIGHT HUI FIFTY - THREE AND 22/100 DOLLARS. SPECIFYING THE
NUISBER, SUM, CONTENTS, AND PROVISIJHS OF THE SAiSE, AND THE INTEREST THEREON, AND
PiOVIDING FOR ANNUAL LEVIES OF SPECIAL TAXES FOR THE PAYIuENT OF THE S_1SE AS PROVIDED
BY LAW.
Motion by Dunlap seconded by Sutton ,
That the rules requiring the reading of an Ordinance on three separate dates be
suspended and that Ordinance be read the second time by title and the third time in full ,
and placed on its final passage, on the roll being called on the motion the vote
was,

The Clerk thereupon read the Ordinance the second time by title and the third ti

The Following Resolution was presented,
'iES OTj UT I ON.
WHEREAS, The City of Caldwell, did in or about the year 1910, organize and
create certain sewer districts within the boundaries of said City, said sewer
districts being known and designated as Sewer District No. 3, Local Lateral Sewerage
District No. 3, and Local Lateral Sewerage District No. 4, and
WMREAS, Said bonds were serial bonds, and it was provided by said City at time
issuance and sale of said bonds that the principal of same and interest thereon, shou
be paid from funds to be raised by ten annual assessments to be lovied against the
property within the respective districts, and
WHEREAS, The City of Caldwell has made and lovied ten annual assessments, the -la
of said assessments having been levied on the property within said districts, in
the year 1919, and
WHEREAS, There is Now due and unpaid bonds of said districts, as follows, towit;
Sewer District No. 3, outstanding, x1,500.00;
Local Lateral Sewerage District No. 3, outstanding_,g3,000.00
Local Lateral Sewerage District No. 4, outstanding,N5,000.00;
together with interest thereon, which said sums end interest have been due since July
1220, and
WHEREAS, Funds available for the payment of said outstanding bonds and interest
are as follows, to-wit;
Balance in Sewer District No. 3 fund, $37.66
Balance in Local Lateral Sewerage District No. 3 fund `x'545.91
Balande in Local Lateral Sewerage District No. 4 fund 933.66
and
WHEREAS, Although said bonds are not a direct obligation of the City of
Caldwell, we believe that a failure of payment of same would 'reflect unfavorably
upon the financial liability and credit of the City of Caldwell and would in all
probability tend to hinder future progress and improvements hereinafter sought to
be made by creation of improvement districts and sale of bonds, and
WHEREAS, It did not become apparent to the menbers of the present City Council
until after appropriations had been made for the present year, that funds would
not be available out of assessments levied against the property within said districts
liquidate said bonded indebtedness in full;
NOW THEREFORE: BE IT RESOLVED, by this body, that we respectfully recommend to
the inooming administration that at the time of the passage of the appropriation
and revenue ordinances for the year 1921, adequate provision be made for the
liquidation of the above mentioned delinquent bonded indebtedness.
