147 the returns presented and if any irregularities were found in same that they be returned to the proper election officials for correction. It was voted on motion of +layman, Seconded Dement that the official re- turns as certified by the fudges of the First ':.ard be returned to said judges for proper signing, that official returns as certified by judges of Second Ward be returned to said judges for proper signing and that official returns as certified by Judges of Third Ward be returned with instructions to the effect that certificates be properly made out. The City Attorney advised that the Chief of Police be instructed to present returns to election officials for correction. The Chief was so instructed. It was voted on motion of Dement that Council adjorn until Thurs, evening April 26th., 1917, at 8 o'clock P, M. Z�L 26 or of the City o Cal ell, Idaho. Attest: , Cit M o rk. erk. Boyes presiding, present, Councilmen Ackley, Dement, Hayman, Sanberg and lard, S. Ben Dunlap, City Clerk, T. S. Jackson, ,ity Attorney, when the following business vase transacted: The returns from the First, Second and Third wards for municipal election held April 24th., 1917, were presented. It was voted on motion of Hayman, seconded Ackley, that the Clerk be instructed to note in the minutes that the election returns were properly sealed. It was announced by Councilman Dement that the returns from the First and Second wards were incorrect, that in each of the said first and second wards one ballot was unaccounted for. City Attorney Jackson advised that the election returns from the first and second garde be returned to the first and second ward election officials for correction. It was voted on motion of Ackley, seconded Dement, that the said election returns be returned to the judges in the first and second wards to ascertain what had become of the missing ballots. 148 Attorneys Thomas B. Buckner, T. A. Stone, Henry Griffiths and J. J. Plowhead appeared and presented their views as to the proper method for the council to proceed. Attorney Plowhead stated that he desired to have the records show that he entered pro- test against the council having the election judges recount the ballots, and that he desired notice of the day and hour when the election judges would meet to correct the returns. It was voted on motion of Hayman, seconded Sanberg, that the election judges of the first and second wards be and hereby are requested to advise the City Council whether they meant to put five votes in squares irrespective of number of marks. It was voted on motion of Dement, seconded Ackley, that the Mayor be and hereby is authorized and directed to appoint a councilman from the first and second wards to return the election returns to the judges of their respective wards. The Mayor appointed Councilmen Sanberg and Hayman to return the election returns to the judges of their respective wards. The time was fixed for the judges to meet in their respective polling places for the purpose of correcting the returns, as follows; First 'lard Judges- Friday afternoon April 27th., 1917, at 3 o'clock P. K. Second Ward Judges- Friday afternoon April 27th., 1917, at 4;30 o'clock P. M. Mr. J. J. Plowhead, as per his request received notice of the time as above fixed, he still being present in the meeting. F;ir. Von 1 1asmer appeared and requested that the water mains be extended from the h. E. Glenn residence in College ',eights Addition, west about one and one -half blocks. He stated that there would be two parties to connect to the proposed extension and that they were .'Tilling to do all the neceeaary work in making the extension provided the City would furnish the material. It was voted on motion of Dement that the matter be referred to the water committee with power to act. i J Mr. Bills of Boise representing the Continental Oil Company appeared relative the resolution passed by the Council April 2nd., 1917, ordering the oil tanks belonging to the said Continental Oil Company and now located on Aven Street near Cleveland Boulevard, removed. He asked to have the order recinded, stating that the company planned to purchase new grounds adjoining the present location and that the premises would be put in good shape and made absolutely safe, and that the company was willing to obey the instructions of the Council as to fences, etc. A motion was made by Ackley, seconded Dement, that the present premises now I owned by the Continental Oil Rompany, together with the lots adjoining the said premises and which they were planning to purchase be approved by the Council as a location for the said tanks. The ayes and naves being called for, the roll was called and the vote resulted: Ayes - Ackley, Hayman -2. 1I I Nayes- Dement, Ward -2. Not voting - Sanberg -1. Absent- Forbes -1. The Mayor declared the motion lost. 148 F Bill No. 25, by Ackley, entitled, "An Ordinance fixing the salary of the Aayor and Councilmen of the Jity of Caldwell, Idaho, providing the time and manner in which they shall be paid, requiring the City Cler__ to collect all water rents and give receipts therefor, to collect other moneys due the water department and to apportion and pay over to the Jity Treasurer money so received, requiring the City Clerk to keep the books and accounts of the water department, fixing the salary of the City Clerk and Police Judge and providing the time and manner in which it shall be paid, repealing Section 8 of Ordinance No. 165, Jrdinance No. 242 and all other ordinances and parts of ordinances in conflict with this ordinance, and providing a time in which this ordinance shall be in force and effect ", was read the first time. A motion was made by Ackley, seconded Dement, that the rules be suspehded and the reading on three separate days be dispensed with, and that Bill No. 25 be read the second time by title and the third time in full and placed on its final passage. The roll being called on the motion the vote resulted: Ayes - Ackley, Dement, Hayman, Sanberg, Ward -5. Nayes -None. Absent - Forbes -1. The Mayor declared the motion carried. Bill No. 25 read the second time by title. F Bill No. 25 read the third time in full and placed on its final passage. On the question shall Bill No. 25 pass? The roll being called the vote resulted: Ayes- Ackley, Dement, Hayman, Sanberg, Ward -5. Nayes -None. Absent- Forbee -1. So Bill No. 25 passed becoming Ordinance No. 278. At this time written recommendations submitted by Councilman Forbes, under date of April 21st., 1917, were read and ordered placed on file. Councilmen Sanberg and ,lard were appointed as a committee to make the following recommendations to the incoming administration. Firet -That the Street Commissioner be paid a salary of ,.125.00 per month. Second -That a City Health Officer be regularly employed at a salary of $40.00 per month. Third -That it is the duty of the City to put the sidewalk abutting the Houston Frost property on Kimball Avenue near the top of the hill on proper grade, without expense to the property owner. The City Attorney was instructed to secure sidewalk maintenance bond from Terry and McGee as per their agreement with the City. At this time, Orel H. Sovereign, Superintendent of Fire Apparatus being called upon suggested plans for the betterment of the fire department. It was suggested that an ordinance be drawn incorporating the ideas of Mr. Sovereign and that they be presented to the Council for consideration, Monday evening. It was voted on motion of Hayman that the ordinance be drawn as per the above suggestion 149. Councilman Sanberg reported that Mr. W. B. Allison offered to remove the old water tank. belonging to the City upon condition that he be allowed to take the material therefrom in payment for his services in this connection. It was voted on motion of Councilman Sanberg, beconded Councilman Hayman, that Mr. Allison's offer be accepted. It was voted on motion of Councilman Sanberg that council adjorn until Monday evening April 30th., 1917, at 8 o'clock P. M. ayor of the ity of c3ld Idaho. Communications from the election officials of the First and Second wards, under date of April 27th,, 1917, with reference to manner of counting votes, and ballots which had baen unaccounted for, were read and ordered placed on file.
