HomeMy WebLinkAbout1936-04-20city council minutesNOW, THEREFORE, BE 'IT RESOLVED That the Mayor of the City of Caldwell, duly attested by the Clerk of the City of Caldwell, make, execute, acknowledge and deliver to the said Carl Isenberg a good and sufficient deed for conveying and assuring the follow described property to the said Carl Isenberg, to -wit: Beginning at the Northerly corner of Block 58, Ifevers Addition to the City oP Caldwell, according to the official plat thereof, now on file and of 'record in the office of the Recorder of Canyon County, Idaho; and running South 46 East, 57 feet; thence South 1 Wait 152 feet, to the Northerly side of the alley through sal$ flock 58; thence following the Northerly side of said alley North 46 West, a distance of 150.2 feet, to the Easterly side line of Tenth Avenue of the City of Caldwell; thence North 43 East, along the Easterly side of Tenth Avenue, 120 Peet, to the point of beginning. Thereupon, Councilman Montgomery moved the adoption of the preamble and resolutic which motion was aeconded by Councilman Fenrich. A yea and nay vote was had thereon, with the following results: Yes: Councilman Edgar L. Oakes, F. D. Mumford, G. W. Montgomery, W. S. Boynton, G.`M& Fenrioh and W. R. Hollingsworth. No: None. Absent and not voting: None. Whereupon, the Mayor declared the motion carried, and the preamble and resolution Li. f i I i iuly adopted. The CityCouncil met in pursuance to a published notice for the purpose of hear- ing protests to the organization df Local Improvement District No. 15, with the Mayor, E. L. Vassar, presiding. On Roll Call the following Councilmen answered present: W. S. Boynton, G. W. 1ontgomery, G. M. Fenrich and W. R. Hollingsworth. Absent: Oakes and Numford. AN ORDINANCE CREATING AND ESTABLISHING LOCAL IMPROVEMENT DISTRICT TO BE CALLED AND KNOWN AS "LOCAL IMPROVEMENT DISTRICT NO, 15, FOR THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, "DESIGNATING THE 4DUNDARIES OF SAID IMPROVEMENT DISTRICT, AND STATING THE NAMES OF THE ALLEYS'AND STREETS .LONG OR UPON WHICH SAID IMPROVEMENT IS TO BE MADE, THE POINTS BETWEEN WHICH SAID IMPROVEMENT IS TO BE MOE, THEKIND AND CHARACTER OF THE PROPOSED IMPROVEMENT: PROVIDING FOR THE RECONSTRUCTION OF SEWERS, COPDUITS nND CHANNELS FOR SANITARY AND DRAIN= AGE PURPOSES, WITH OUTLETS, MAN- HOLES, CATCH BASINS, FLUSH TANKS AND OTHER SEWER APPURTEN- ANCES NECESSARY FOR THE COMFORT, CONVENIENCE, HEALTH AND WELL BEING OF THE CITY OF CALD- WELL: PROVIDING THAT ALL OF THE PROPiRTY IN SAID IMPROVEMENT DISTRICT FRONTING, ABUTTING, CONTIGUOUS OR TRIBUTARY TO THE ALLEYS AIM STREETS ALONG OR UPON WET.ICH SAID IMPROVEMENT TO BE MADE SHALL BE ASSESSED FOR THE COSTS AND EKPENSES OF SUCH IMPROVAMT; AND THE RE= CONSTRUCTION OF THE IMPROVTMTENT IN THE INTERSECTION OF THE ALLEYS AND STREETS SHALL BE AS- SESSED 9 iNST ^HE BLOCKS, LOTS, LANDS, PIECES AND PARCELS OF LAND IN &JI) DISTRICT, ALL OF WHICTMIHALL BE DETERMINED AND FIRED BY THE COUNCIL WHEN THE DISTRICT IS CREATED, IN AC- CORDANCE WITH THE PROVISIONS OF CHAPTER 25, TITLE 49, OF THE IDAHO CODE ANNOTATED, 1932; DESCRIBING THE ML.THOD OF SUCH ASSESSMENTS AND THE PAYMENT THEREOF, AND DIRECTING THE CITY CLERK TO ADVERTISE FOR AND RECEIVE BIDS FOR SUCH MATERIAL AS MAY BE DESIGNATED BY THE COUNCIL FOR SUCH IMPROVEMENT, AND OF DOING THE WORK AND LABOR OR THE RECONSTRUCTION OF THE SAME: AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PATiTS THEREOF IN CONFLICT HERE- WITH: AND DECLARING AN EMERGENCY. which was read for the first time, and the Council proceeded to a consideration of the pro- posed Ordinance. It was moved by Mumford and seconded by Montgomery that the rules requiring a 66 Or- proposed Ordinance to, ead on three separate days be suspended and that the proposed dinance be read the second time by title and the third time in full. The Mayor directed - the Clerk to call the Roll on the Motion as stated, which resulted as follows: Those jl voting in favor of the motion were; .,Oakes, Mumford, Boynton, Fenrich, Montgomery and Hollingsworth. Those opposed: None. Absent and not voting: None. The Mayor then de- clared the motion carried by the necessary three- fourtha mngority, and directed the Clerk to read the proposed Ordinance the second time by title and the third time in full section by section. The Clerk read the proposed Ordinance as directed. On the question as put by the Mayor, "Shall the proposed Ordinance pass 7 ", the Mayor dibreeted the Clerk to Call the Roll which resulted as follows: Those voting in favor of the proposed Ordinance were: Oakes, Rumford, Boynton, Fenrich, Montgomery and Hollingsworth. Those opposed: None. Absent and not voting: None. Thereupon the Mayor declared the proposed Ordinance passed, and in open session of the Council, the Mayor si,;ned and approved the said Ordinance, and the Clerk duly attested the same, which, thereupon, became Ordinance No. 533. The Mayor directed the Clerk to make the proper entry of the passage of the Ordinance upon the 4our- aal of the proceedings of the Council as a part of the minutes of this meeting and further iirected the Clerk to cause. Ordinance No. 533 to be published in the Caldwell News- Tribune, the official newspaper of the City of Caldwell , Idaho. Thereupon it was moved by Montgomery, seconded by Hollingsworth that all rules requiring a bill to be read on three separate days be suspended and that Bill No. 17, pro- _ posed Ordinance No. 534, be read the second time by title and the third time in full hav- ing been read the first time April 13th The Mayor directed the Clerk to call the roll on the question stated, which resulted as follows: Those voting in the affirmative: Oakes, Rumford, Boynton, Fenrich, Montgomery and Hollingsworth. Those voting in the negative: None. Absent and not voting: None. The Mayor declared the motion carried by the necessa y three - fourths majority and directed the Clerk to reed the bill as directed. The - question then being "Shall Bill No 17, pass ?" The Mayor directed the Clerk to call the roll on the above question which resulted as follows: Those voting in the affirmative were: Oakes, Mumford, Boynton, Fenrich, Montgomery and Hollingsworth. Those voting in the negative: j None. Absent and not voting: None. Thereupon, the Mayor declared Bill No 17, had passed, and. the Mayor in. open session of the Council duly signed and approved the Bill, ammliNss -- _ 239W, and the Clerk duly signed and attested the same which became Ordinance No. 534. The Mayor directed the Clerk to make proper entry of the same and to cause Ordinance 534 to be published in the C Caldwell News - Tribune, the official newspaper of the City of Caldwell, Idaho. Absent and not voting: None: The Mayor declared the motion carried by the necessar three - fourths majority and directed the Clerk to read Bill No 19, the second time by title and the third time in full section by section. The Clerk read the bill as directed. The question then being "Shall Bill No. 19,pass?" The Mayor directed the Clerk to call the roll on the above question which resulted as follows: Those voting in the affiiative were: Oakpe,Mumford, Fenrich, Boynton, Montgomery and Hollingsworth. .Those voting in the negative : None. Absent and not voting : None. Thereupon, the Mayor declared Bill No. 19, had passed, and the Mayor in, open session of the Council duly signed and approved the Bill, and the Clerk duly signed and attested the same which became Ordinance No. 535. The Mayor directed the Clerk to make proper entry of the same and to cause Ordinance 535, to be published in the Cah$well News - 'tribune, the official newspaper of the City of Caldwell, Idaho.
