Council Chamber, City of Caldwell, Idaho, April 19, 1916.
Council meet in regular session, pursuant to adjornment, with Mayor Fred C.
Boyes, presiding, Councilmen present, Ackley, Dement, Forbes, Harrington, Hayman and
Sanberg, S. Ben Dunlap, Clerk, when the following business was transacteds
The matter of the petition of the Boise- Payette Lumber, asking that the alley
in Block 73 Original twonsite be vacated by the City, presented at the last meeting and
referred to the Street Committee for investigation, was taken up.
Hon. J. 0. Rice, Attorney for the lumber Company appeared and presented a
memorandum of agreement, entered into April 19 1916, by and between Boise- Payette
Lumber Company and the Caldwell Ice and Cold Storage Company, and by the terms of which,
the Caldwell Ice and Cold Storage Company consented to the granting of the petition by
the City Council.
Councilman Forbes of the Street Committee submitted the following written

I am not in favor of vacating the alley in
Block 73 Original Townsite, and suggest that the
Lumber Company, occupying the alley as part of
lumber yard, be required to enter into an agree-
ment to protect the City from damage on account
of having alley fenced, in for use of same.

It was voted upon motion of Hayman, seconded Harrington, that the report of
Councilman Forbes be adopted and the suggestion therein reoommended, be caused to be put
Into effect.
Mr. J. C. Ford appeared and protested against a sidewalk be ordered constructed
on the north side of Block 42 Original Townsite, claiming that said construction was
unnecessary.
Councilman Forbes, in reply to the protest of Mr. Ford, stated, that in his
opinion the walk should be constructed as new walk would be recommended to be constructed
on both sides of said Block 42 Original and if Block 42 were left out, the vacancy thus
caused would work a hardship on the residents of that portion of the City.
City Attorney Walters reported that the demurrer filed by him in reply to the
complaint of the Bellan Investment Company against the City had been sustained by the Court
and the Plaintiff given twenty days in which to amend the complaint.
Resolution No. 7, by Forbes, entitled, "A resolution providing for the cone.
demnation and removal of certain sidewalks according to Ordinance No. 266 of the City of
Caldwell, Idaho, along and in front of certain lots and blocks in said City, and providing
for the payment for the removal of such condemned walks by an assessment levied and
assessed against the property fronting and abutting on said sidewalk ", was read.
- A motion was made by Harrington, seconded Hayman, that the resolution be
adopted. The roll being called on the motion, the vote resultede
Ayes - Ackley, Dement, Forbes, Harrington, Hayman, Sanberg -8.
Reyes and absent - None.
The Mayor declared the resolution passed.
Resolution No. S, by Forbes, entitled, A resolution providing for the construc-
tion of a sidewalk according to plan three of Ordinance No. 148 of the City of Caldwell,
Idaho, along and in front of certain lots and blocks in said City, and providing for the
payment of such construction by an assessment levied and assessed against the property
fronting and abutting on said sidewalk ", was read.
A motion was made by Sanberg, seconded Ackley, that the resolution be adopted.
The roll being called on the motion the vote resultede
Ayes - Ackley,,Forbes, Harrington, Hayman, Sanberg - 5.
Payee - Dement - 1.
Absent - None.
The Mayor declared the resolution passed.
Bill No. 11, by Ackley, entitled, "An Ordinance providing that any person,
firm or corporation who shall desire to run a portable or stationary stand on those streets
and alleys in the City of Caldwell, within the boundaries-of Local Improvement Pavement
District No. 1, must first secure the approval of the City Council as to the kind and

style of stand which it is proposed to install and repealing - Ordinance No. 156 of said City"
was read the third time. The question being on the passage of the bill the roll
being called the vote resulteds
Ayes - Ackley, Dement, Hayman, Sanberg - 4.
Nayes - Forbes, Harrington - 2.
Absent - None. So bill No. 11 passed becoming Ordinance No. 268.
Bill No. 14, by Dement, entitled, "An Ordinance vacating, abandoning and
discontinuing Oak, Vaple and Walnut Streets, between Washington and Wyoming Avenues of
Mountain View Addition to the City of Caldwell( as the same appear upon the plat of said
Addition now on file in the office of the Recorder of Canyon County, Idaho ". was read
for the first time.
A motion was made by Ackley, seconded Forbes, that the ryles be suspended and
the reading on three Separate days be dispensed with and bill No. 14 be read the second
time by title and the third time in full and placed on its final passage. The roll being
called on the motion, the vote resulteds
Ayes - Ackley, Dement, Forbee, Hayman, Sanberg - 5.
Mayes - Harrington - 1.
Absent - None. So the motion prevailed.
Bill No. 14 read the second time by title.
Bill No. 14 read the third time in full and placed on its final passage. On
the question shall bill No. 14 pass? The roll being called the vote resulteds
Ayes - Ackley, Dement, Forbes, Hayman, Sanberg - 5.
Keyes - Harrington - 1.
Absent - None. So bill No. 14 passed becoming Ordinance No. 269.
In the matter of the petition of J. Jester Jr. et -al, asking that the water
mains be extended through Mountain View Addition, pre =anted to the City Council On April
3, 1916, the Clerk reported that the Name of F. HaBoyd had been added to said petition.
Councilman Harrington of the Water Committee ,appointed to investigate the
advisability of extending said mains as per the petition, and given full power to act in
the matter, referred the matter back to the Council, stating that he preferred not to act
alone in the matter.
It was voted upon motion of Forbes that the City Engineer be instructed to
ascertain if the extension could be made at lees expense than at first estimated by
taking a different route.
Councilman Dement upon request was excused from attendance for the balance of
the meeting.
The following communication was reads
Caldwell, Idaho -April 17, 1916.
This is to certify that a regular meeting
of the Caldwell Fire Department, Charles M. Allen was
duly elected Chief, and W. E. Woodcock, Assistant Chief
of the Department for the ensuing year.

It was voted upon motion of Ackley, seconded Forbes, that the City Clerk
be instructed to issue certificates of election to the persons elected, upon their
filing the proper oath as provided by Ordinance No. 122 of said City.
The report of the City Treasurer for the quarter ending March 31st., 1916, was
read. It was voted upon motion of Hayman that the report be approved.
In the matter of the complaint of Miss Bissett, relative to the irrigation
ditch adjoining her property on the corner of Ninth Avenue and Cleveland Boulevard, made
to the Council April 3, 1916, the City Engineer reported that in his opinion the adjustment
of the matter was between the Pioneer District and Mies. Bieeett and that it was not the
duty of the City to remedy the condition complained of.
Councilman Forbes suggested that proper action be immediately taken to compel
the Pioneer Irrigation District to remove the rubbish from all ditch banks inside the
(City limits.
Councilman Sanberg stated that the local Chapter of the D. A. R. -had extended
through him, a special invitation to the City Council to attend the dedication services
to be held April 28th., 1916.
It was voted upon motion of Sanberg that Council adjorn.

Council meet in regular session with Mayor Fred C. Boyes, presiding,

The minutes of the sessions held during the month of April, 1915, were
read and it was voted upon motion of Dement that the same be approved.
Councilman Forbes arrived during the reading of the minutes.

County Superintendent Z. Fay Fowler and professors Clifford and McCall
arpeared and presented the plane contemplated for the establishment of Agriculture
Clubs amoung the boys and girls of this City. They stated that financial assistance
to the amount of about 150.00 would be needed to carry out the plane, and they
asked that the City contribute this sum. The matter was taken under advisement.
The application of 0, F.. Smith for permission to install a portable
stand in the paving district and submitting plane and specifications of the stand
which he desired to install, as provided by Ordinance Wo. 268, was read.
It was voted upon motion of Ackley that the plans and specifications be
approved and that the application be granted.
The written opinion of City Attorney malters, under date of April 29, 1916,
advising that the City would be liable for damage which any member of the public
might sustain by reason of an alley being closed, when consent to close same was
