HomeMy WebLinkAbout1962-04-16city council minutes334 r- adjoining, contiguous and tributary property and Shall be paid for in ton equal installments, the first installment to mature within one year from data and the last installment in not more than ten years from date, and shall be numbered from one (1) upwards, conaecutively, and shall bear interest payable semi- annually and said bonds may be sold at not less than par value and the city, for the purpose of meeting the coats and expenses of such improvements as the same are installed prior to the sale of said bonds, will issue warrants against the improvement district, payable to the contractor of the proper person, upon estimates of the City Engineer, bearing interest at the rate of not to exceed seven per cent per any, which warrants, together with the interest thereon at the date at the issue of said bonds $hall be redeemed and retired from the proceeds of the sale of said bonds. Section 11. That the construction of said improvement is necessary for the immediate preservation of the public peace, health, and safety, and therefore an emergency exists and this resolution shall be in full fares and affect from and after its passage and approval. The Council met pursuant to recess and acknowledgement of notice in the following form: We, the undersigned Mayor and Members of the City Council of the City of Caldwell, Idaho, do each bereby acknowledge notice of a Recessed Meeting of the said City Council, to be held in the Council Chambere in the City Hall in the City of Caldwell, Idaho, at the hour of 8:00 o'clock P. M. on the 16th day of April, 1962, for the transaction of all business in connection with the following object; New and unfinished business. Upon Roll Call the following Councilmen answered presents E. L. Vassar, Emile Shorb, Max Luby, Charles E. Krause, V. Martin and N. E. "Coley" Smith. City Code adopted: Bill No. 6 - Ordinance No. 987 Mayor Simnerman stated that he could report to the Council that the City Code was ready for adoption; that it had been proofed and with the exception of one page where they had failed to put in the Airport Nap designating the flight pattern. Thereupon Councilman Vassar introduced Bill No. 6, entitledt AN ORDINANCE FOR REVISING, CCD=NG AND COMPILING THE GENERAL ORDINANCES OF THE CITY OF C ALDWE L , IDAflO. which was read for the first time and the Council proceeded to consideration of Bill No. 6. It was moved by Councilman Vassar, seconded by Councilman Shorb that the rules requiring the reading of a bill on three separate days be suspended and that Bill No. 6 be read the second time by title and the third time in full, section by section, and placed on the final passage. The Mayor directed the Clerk to call the Roll on the above motion with the following result: Those voting in the affirmative wares Vassar, Shorb, Luby, Krause, Martin, and Smith. Negative, none. Absent and not voting, none, The Mayor declared the motion had passed the necessary three - fourths majority and directed the Clerk to read Bill No. 6 the second time by title and the third time in full, section by section. The Clerk read the Bill as directed. The question being "Shall Bill No. 6 pass?" The Mayor directed the Clerk to call the roll on the above question which resulted as follows- Those voting in the affirmative were: Vassar, Shorb, Luby, Krause, Martin, and Smith. Negative, none. Absent and not voting, none. Thereupon, the Mayor declared Bill No. 6 had passed and the Mayor in open session of the Council duly signed and approved the Bill and the Clerk duly signed and attested the same which became Ordinance No. 987. The or directed the Clerk to make proper entry of the same and to cause Ordinance No. 987 to be published in the Name- Tribune, the official newspaper of the City of Caldwell, Idaho Full time Sanitary Inspector - Harry Minto Mayor Sismmerman then reported to the Council that the City now has a full time Sanitary Inspector and that he would go to work Wednesday morning, April 18th. The Inspector would be Mr. Harry Minto. The Mayor stated that he had been with the Police Department for about six years and that he had had previous Municipal experience in the Building Department of another City. Ne will also serve as Fire Marshall and in time to come, he may help some in the Building Department. Deeds presented and accented. Mayor Sim merman called upon Mr. Lewis, the City Engineer, who presented Deeds to the City as follow A Warranty Deed from Leo A. Maxwell and Elnora Maxwell, husband and wife. COMMENCING at the Southwest corner of the Northwest Quarter of the Southeast quarter of Section 28, Township 4 North, Range 3 West of the Boise Meridian, and run thence North along the West boundary line thereof a distance of 165.25 feet TO THE REAL POINT OF BEOINNINGs Thence North on said West line 8 feet; thence East on a line parallel with the South boundary line of said Northwest Quarter of the Southeast quarter a distance of 264 feet; thence South 8 feet; thence West 26h feet to the real point of beginning; ALSO, COMMENCING at the Southwest corner of the Northwest Quarter of the Southeast Quarter of said Section 28 and ran thence North along the West boundary line of said Northwest Quarter of the Southeast Quarter a distance of 305.55 feet TO THE REAL POINT OF BEGINNING: Thence North along said West boundary line 2h.45 feet; thence East on a line parallel with the South boundary line of said Northwest quarter of the Southeast Quarter, a distance of 264 feet; thence South 24.45 feet; thence West 264 feet to the real point of beginning. Thence North on said West line 132.3D feet; thence Fast and parallel with the South boundary line of said Northwest Quarter of the Southeast Quarter a distance of 16 feet; thence South on a line parallel with the West boundary line 132.30 feet; thence West 16 feet to the REAL POINT OF BEGINNIN( Moved by Councilman Smith, seconded by Councilman Laby that the City accept the foregoing Deeds and ;hat they be duly recorded. Councilman Smith then inquired of the City Engineer whether or net the City could contract the isphault installation as well as the curbs and gutters in L.I.D. #50 any cheaper theft it could be done by the 335 City. Mr. Lewis answered that the City could do the work cheaper than it could be done by Contract. Councilman Smith then inquired if the installations of oil by the City were cheaper than that which would be •put in by a Contract and Mr. Lewis stated that it wasn't if the Contractor put in a road mix. The City puts in a cold mix preparation. Mr. Lewis stated further that there was no trouble with oil breaking up in the Districts bat rather the trouble was with the older streets and primarily where theta was not a good base material. He said that a hot mix was much better but also much more expensive with the problem of availability and also that it would be almost impossible to get any Districts formed at the higher cost. Selling price for City Code established The matter of the City Code was again referred to when Councilman Vassar moved and Councilman Luby seconded that the price for selling a single copy of the newly adopted City Code would be 825.00 and that this price was to include any additions or alterations which might be made from time to time. A vote was taken and the motion unanimously carried. Exemption approved on sewer charge - Miss Julia Cross Councilman Shorb presented to the Council the matter of an application for exemption from the sewer service charge by Mies Julia Cross at 309 Everett St. as well as a letter from the Department of Public Assitance stating that their agency does not provide for sewage assessment on any individual's budget. M by Councilman Shorb, seconded by Councilman Martin that the request for exemption of sewer service charge by Mies Julia Cross be granted. A vote was taken and the motion unanimously carried. It was moved by Councilman Smith, seconded by Councilman Vassar that the bills presented for Mid - April be approved and that warrants be issued in the various amounts for payment of them. There being no farther business to come before the Council, it was mowed by Councilman Luby, seconded by Councilman Smith that the Council recess to meet April 24, 1962 in the Council Chambers at 8 P.N.
