REGULAR MEETING
April 15, 1974
8:00 P.M.
Mayor Pasley called the meeting to order.
The roll of the Council was called with the following members of
the Council present: Gamboa, Dakan, Carter, McCloskey, Williams
and Banks. Absent: None.

(APPROVAL OF MINUTES)
14OVED BY Carter, SECONDED BY Gamboa to dispense with the reading
of the minutes of the April 1 meeting and accept them as written.

(RIO VISTA ACRES VACATION - Postponed)
Mayor Pasley stated that the attorney for the plaintiff in the
action of the vacation of a portion of Rio Vista Acres was out of
town and after obtaining the consent of Bill Gigray, attorney for
the Tertelings, had asked for postponement of the matter until
the next Council meeting.
MOVED BY McCluskey, SECONDED BY Carter to table the matter until
the next Council meeting. MOTION CARRIED
(FORWARD CLUB - Certificate of Appreciation Presented)
The Mayor called upon Councilwoman Williams who spoke in behalf
of the Mayor and Council and presented a certificate of apprecia-
tion to the Forward Club for all the work they had done in the
Rose Garden. Present to accept the certificate were Celia Day,
Doris Squires and Mary McCluskey, the vice president.
Celia Day reported on the work that had been done and named the
following donations:

Doris Squires reported that she had been the chairman of civic
improvement the last year and had obtained three new trees for
Luby Park.
(BILL NO. 13 - ORDINANCE NO. 1324)
Councilman McCluskey sponsored the following Bill No. 13:
AN ORDINANCE TO AMEND SECTION 5 -1 -2 OF CHAPTER 1 OF TITLE V OF THE
BUILDING CODE OF THE CITY OF CALDWELL BY INCREASING THE FEES FOR
BUILDING PERMITS.
MOVED BY McCluskey, SECONDED BY Banks to suspend the rule requir-
ing the reading of a bill three separate days and that Bill No.
13 be read the second time by title and the third time in full,
section by section.

The Mayor called for a roll call vote. Members of the Council
voting Yes: McCluskey, Williams, Banks, Gamboa, Dakan and Carter.
No: None. Absent and not voting: None. MOTION CAR RIED
The Mayor directed the Clerk to read Bill No. 13 the second time
by title and the third time in full.
MOVED BY McCluskey, SECONDED BY Banks that the ordinance pass and
be entitled Ordinance No. 1324.
The Mayor called for a roll call vote. Members of the Council '
voting Yes: McCluskey, Williams, Banks, Gamboa, Dakan and Carter.
No: None. Absent and not voting: None. MOTION CARRIED
(POLICE CARS - Items Exceeding Specifications)
The Mayor read a letter from Wolfe Day Ford thanking the Mayor,
Council and Police Chief for the award of the bid for four 1975
police cars. They listed the following items which exceeded the
bid specifications which would result in additional benefits to
the city:
1. HR78 x 15 steel belted radial tires
2. 70 amp alternator
3. 80 amp battery.
(INDEMNITY AGREEMENT - Approved)
Councilman Dakan read an indemnity agreement from Homer R. Skelton
for the burial of Edith Mae Skelton in space 4, Block No, 1 Lot
No. 22 in Canyon Hill Cemetery.
MOVED BY Dakan, SECONDED BY Gamboa to approve the above Indemnity
Agreement. MOTION CARRIED
(BEATER PURCHASE - Authorized)
The Mayor stated that the city was reponsible to keep the weeds
down on its property as were the individual owners of property in
the city. He added that if the property owners did not keep their
weeds down, the city then cleaned them up and charged the property
owner for this service.
The Mayor stated that the foreman of the City Shop had informed
him that the beater the city had been using in weed control was
beyond repair, and it was the recommendation of the Building
Inspector that the city purchase a new beater for $712.00, plus
breight.
MOVED BY Gamboa. SECONDED BY McCluskey to purchase a new beater
for $742.00 plus freight. MOTION CARRIED
AMENDMENTS FOR BILL NO. 9)
The Mayor called upon Councilman Carter who presented the follow-
ing amendmens to Bill No. as recommended by the Council Committee
on Water and Sewer:
1. That the amendment considered and tabled by the Council
have a "grandfather clause ".
2. That an amendment by made to the Code regarding water
rates and sewer rates such that each extra building
served from one water meter pay a minimum water fee of I
$2.50 and a minimum sewage fee of $2.20 if they are
presently receiving these services.
3. That a form letter be sent to each property owner
affected explaining the situation prior to the first
billing. A general format of the letter is attached.
Councilman Carter then read the following form letter:
