J. Miller F. R. Miller, Fred Mitchell and Ch"les Sauberg. In the matter of application for the establishing of a sewer district by Cakes at al. On motion, F. R. Miller, seconded by Mitohell the sewer committee was instbnoted to proceed to draft ordinance covering same. The following resolution was presented by Councilman Mitchell, and on motion by F. R. Miller, seconded by Mitchell the same was adopted. "WB ERMES That portion of Ward No. 1 of the City of Caldwell lying along and adjacent to Canyon Hill has become so wet on account of the seepage, drainage and waste water from the land lying above it that it is almost impossible to con- struct and maintain roads across the same during the winter and spring months; And whereas a portion of this ward is in the Pioneer Irrigation District and has and still is paying waste assessments levied by said district but has not been benefitted by the drainage system which the Pioneer Irrigation District has installed in OAS portions of its district but on the contrary, on account ! of the increased volume of water that the drainage ditches constructed by the e, government have caused to be emptied into Indian Creek, the water table on this i portion of the town has been raised; And whereas the irrigation of the land on Canyon Hill by the Canyon Hill Irrigation District has caused and will onus* additional water to appear upon this land by seepage and wastage; and whereas the oonstruotion of the ditch along the edge Of Canyon Hill by the government for the purpose of irrigating the lands in Black Canyon will alsl cause fatther increased amounts of seepage and wastage water to such an extent that itwill be practically impossible to maintain roads unless an adequate drainage system is provided; Now therefore be it resolved that the Mayor of the City of Caldwell be Instructed to request the United States Reclamation Service to make investigation and recommendations as to the best system of drainage for this land and'that he G also submit a copy of this resolution to the directors of the Pioneer Irrigation District, the B14ok Canyon Irrigation District and the Canyon Hill Irrigation h Distriot and ask them to oo- operate with the government in carrying out whatever plan of drainage may be recommended by the engineers of the United States Reolama- tion Service to the and that each may bear its Just proportion of the expenses incident to the construction of said drainage system." The following resolution by Sanberg was presented, and on motion by Mitdhell the same was adoptedl "WHEREAS the City of Nampa is depositing its sewage in Indian Creek without proper filteration, and whereas other property owners along Indian Creek are using the same for drainage and are depositing filth in the some; and whereas the government by its system of drainage ditches has materially increased the flow of water of Indian Creek and thereby. made the flood conditions much more serious to the City of Caldwell; "Now therefore be it resolved that the City Engineer be requested to investigate the matters above referred to and report to the Council some plan for eradicating said nuisances." �I 336 u ciJ I'1 r n Bill No. 34 by A. REGULAR ADJOURNED MEETING OF THE CITY COUNCIL, COUNCIL CHAMBER, CALDWELL, IDAHO, APRIL 23rd. Mayor F. L. Lilly presiding. Councilmen present - Joseph Dickens, A. J. Miller, F. R. Miller, Fred Mitchell, Charles Sanberg, and W. Grant Ward. Mayor appointed Mrs. L. W. Botkin to fill the vacancy on the Library Board made vacant by the resignation of Mr. W. E. Parker. On motion by Sanberg, seconded by Mitchell the appointment was confirmed. The lease of Crandell 1 DeLong for the unused portion of the cemetery lying under Canyon Hill to be used as a fur farm was presented, and on motion F. R. Miller seconded by Mitchell the lease agreement was accepted and Mayor authorized to execute the same. She matter of lighting Indiana Avenue was referred to Street Committee and Councilman F. R. Miller with power to act. On motion by Mitchell, seconded by A. J. Miller, Street Committee was authorised to confer with County Commissioners in regard to requiring Railroad Company to fill in approach to bridge over Indian Creek on south line of City limits. Moved by F. R. Miller, seconded by Mitchell the City Attorney was instructed to draft resolutions preparatory to starting continuation proceedings for Right -of -way of street crossing on third street. Bill No. 35 by Ward was read for the first time. On motion by Mitchell, seconded.by Sanberg, the rules were suspended re- quiring the reading of the Ordinances in Pull on three separate meetings. And Ordinance was,read second time by title, third time in full and placed on its final passage. On motion the vote "Ayes" - Josepa Dickens, 4. J. Miller, F. R. Miller, Fred Mitabell,. Charles Sanberg and W. Grant Ward. Bill No. 35 was then read the second time by title and the third time in full and placed on its final passage. On the question: "$hall Bill No. 36 pees ?" the vote was: Those voting "Yew" - Joseph Dickens, A. J. Miller, F. R. Miller, Fred Mitchell, Charles Sanberg and W. Grant Ward. Those voting "No" - none. Thereupon the Mayor declared Bill No. 35 passed and so became Ordinance No. 316. On motion Sanberg, seconded by Ward, the City Clerk was instructed to notify Bond Company that they had been relieved of any liability regarding the bonds of Harry L. Smith and Martin Ingebretsen. Bill No. 29 by Mitchell entitled "Vacation Ordinance" was presented and on motion by Mitchell seconded by F. R. Miller articles 2 and 3 were omitted and Bill as amended was read the third time and placed on its final passage. On the question "shall Bill No. 29 pass ?" the vote was as follows: Those voting "Yea" - Joseph Dickens, A. J. Miller, F. R. Miller, Fred Mitchell, Oharles Sanberg and W. Grant Ward. Those voting "No" - none. And so Bill No. 29 became Ordinance No. 316. Bill No. 34 by A. J. Miller was read the second time. On motion by Mitchell, seconded by $anberg, the rules were suspended requiring the reading of an ordinance
