Oonley, Dutton, Mumford, and Ma'annel, present, and Kimbrough and Wheeler, absent.

the ensuing three months. It was voted on motion of Mumford. seconded by MaGonnel. that
Licensee be granted.
Resolution No. 20, by Mumford, was pressated:
^ A RESOLUTION AUTHORIZING AND DIRECTING THE CITY TREASURER OF THE CITY OF CALDWELL IDAHO,
TO MARE PROOF OF CLAIM TO THE COMMISSIONER OF THE DEPARTMENT OF FINANCE OF THE STATE OF I AHO FOR
FUNDS OF THE CITY OF CALDWELL ON DEPOSIT IN WESTER:; CONIIERCIAL BANS, AND AUTHROIZING AND
DIRECTING THE %ITY TREASURER TO BELL AND DISPOSE OF THE SECURITIES PLEDGED BY THE WESTERN
00 MERCIAL BANK AS SECURITY ?O DEPOSITS IN SAID RANK.
WHEREAS, Western Commercial °ank was one of the depositories for the funds of the City of
C aldwell, and suspended business on December '23rd, 1926, at which time the City Treasurer had on
deposit in said bank a total of $38,798.60, and had in his possession as security for sai d
deposits, a depository bond in the sum of 016,000.00, executed by Fidelity & deposit Company, of
Maryland; securities consisting of Golden "ate Highway District warrants amounting to 86 927.22,
and United States Liberty Bonds a:ounting to the sum of ,$16,000.00, making a total of $36 927.22;
and,
WHEREAS, it is necessary that said Highway District Warrants and United States Liber y Bonds
be sold in order to reimburse said city in part for funds on deposit in said bank, and to real-
ize on said surety bond; therefore
Be it Resolved by the Mayor and Council of the City of Caldwell:
Section 1: That the gity treasurer of the City of Caldwell, Idaho,'be and he is hereb author-
ized and directed to sell, pursuant to law, the Golden 'ate Highway District Warrants an United
States Liberty Ronde, held by him as security for deposits of funds belonging to the City of
Caldwell, in western Commercial Beak, and to apply the proceeds of suoh sale 4weawla towl rds the
liquidation of the claim of the slid City against said bank.
Section 2. The City Treasurer of the City of Caldwell, Idaho is hereby authorized and directed
to take such stelae as may be necessary to recover payment for and on behlaf of the city f the
surety bond in the sum of $16,000,00, executed by Fidelity and Deposit Compnay of Maryann , and
to apply the Proceeds towards a liquidation of the claim of said city against said bank.
Section 3. The City l reaeurer of the City of Caldwell, Idaho, is hereby authooized abi directed
pursuant to law, to make proof of claim of the balance of the funds belonging to said of y in
Western Commercial Bank, which may be due and-owing to said city after giving credit for he
amount of securities on hand and said depository bond, on or bdfore May lOtb, 1926, said iate
being the date fixed bythe Commissioner of the Department of Finance of the State of Ida o, in:
his notice to "reditors of said yank , as the final date for filing claims.
Section 4. The City 'ressurer of the City of Caldwell,Idaho, is hereby authorized and d rented
in making the proof of claim,designated in Section Three hereof, to claim an off -set as E any
warrants of the City of Caldwell, held by said bank on the date of its suspension of,bueJ aese, •
and cause the some to be deducted from the amount of any balance remaining in the hands 3f the
'Commissioner of the Department of Finance after giving oredit for the security pledged rc secure
said deposit to said City.
A motion was made by Mumford, seconded Me that Resolution No. 20 be adopted. Tj roll
was called on the same, resulting as follows:

NAYES: NONE.
