Mayor Fred L Lilly presiding. .The roll being palled the ,following Councilman were present: Joe Dickens, Amos J Miller, F R Miller„ Fred Mitohell, Chas Sanberg and W Grant Ward. Minutes of last regular meeting' was read and an motion of Councilman Mitchell seconded by Councilman Sanberg same were approved as.read. Regarding the proposition oft the Howard- Cooper Corporation wherein they agree to allow the City the sum of $2000.00 for the old City Road Roller on the purobase of a new Truck, same was referred to the Street Committee with power to act. The bond of W H Curtis in the sum of $1000.00 to carry on the business of Plumbing was approved and placed on file. Bill No 33 was read the second time and referred to the salary committee The petition of Oakes et. al. praying for the creation of a sower diet. was presented and on motion same was referred to the Sewer Committee, City Aty. and City Engineer for investigation. Mrs Lydia MoUtt was appointed registrar for the Third Ward, Dire Ida Moe was appointed registrar for the second ward and Sarah Boone was appointed registrar for the First Ward. The Mayor following the usual oustom declared Monday April 14th annual Olean -up day. On motion Mitchell seoonded by Sanberg the Council went on record requiring the Oregon Line to repair the crossings on Kimball Ave. and 5th. Ave. in accordance with plane and specifications to be prepared by the City Engineer, and the City Clerk was instructed to notify the Rail Road Company of at oh action. Dist. Clerk, ;ire Lelia Aakley. Polling Place City Halij 331 Thereupon Cotncilman Dickens introduced Ordinance No. 312, entitled; AN ORDINANCE CREATING AIM ESTABLISHING A LOCAL. IMPROVi- Z.11'T DISTRICT TO BE CALLED "LOCAL STREET IMPROVEMENT DISTRICT NO. 2 IN THE CITY OF CALDWEZZ, CANYON COUNTY, IDAHO; DESIGNATING THE STREETS AND POINTS BETWEEN WHICH BAID IMPROVEMENTS SHALL BE WA AND PROVIDING FOR Y',HE CONSTRUCTION OF PAVEMENT. CURBS AND GUTTERS THEREON: PROVIDING THAT THE COST AND E%PEN OF SAID IMPROVEMENT SHALL BE TAXED AND ASSESSED UPON ALL THE PROPERTY IN SAID IMPROVEMENT DISTRICT FRONTING OR ABUTTING OR CONTIGU- OUS OR TRIBUTARY TO THE PORTIONS OF SAID.STREET3 30 IMPROVED; AND PRESCRIBING THE METHOD OF SUCH ASSESSMENT AND THE PAYMENT THEREOF; REPEALING ALL ORDINANCES, RE- SOLUTIONS OR ORDERS,' OR PAR'l3 THEREOF, IN CONFLICT HEREWITH-, AND DECLARING AN EMERGENCY. Ordinance No. 312 was thereupon read in full by the City Clark and con - eidered by the Council. Thereupon Councilman Ward moved that that part of the Compiled Laws of the State of Idaho and the rule requiring the reading of Ordinances fully and distinctly on three different days be dispensed with in the m=dar prescribed by law, and that proposed Ordinance No. 312 be read "the second time by title and the third time in full and placed on its final passage. Said motion was eeconded by Councilman Mitchell. The Mayor stated the motion and put the question and the vote upon said question was as follows: Those voting "yes" Oounoilman Dickens, A. J. Miller, F. R. Miller, Mitchell Sanberg & Ward. Those voting "no" - none. The Mayor then declared that said motion had duly carried by the necessary three quarters vote. Then the Mayor stated, under the motion, that Ordinance 312 stood for second reading and directed the Clark to read Ordinance No. 312 the second time by title. The Clerk then read Ordinance No. 312 by title. The Mayor stated, under the motion, that Ordinance No. 312 stood for third reading and directed the Clark to read the same, fully and distinctly at length. The Clerk then read Ordinance No. 312 the third time, fully and distinctly at length. The Mayor stated, under the motion, that Ordinance No. 312 had been read the third time fully and distinctly at length and stated the question: "Shall Ordinance No. 312 pass as read ?" The Mayor directed the Clerk to call the roll, and upon roll Ball the vote upon the final passage of said Ordinance resulted as follows, to wit; Those voting "Yes" Councilmen Dickens, A. J. Miller, F. R. Miller, Mitchell, Sanberj & Ward. Those voting "No" - none. The mayor declared said Ordinance No. 312 to have duly passed and directed the Clerk to make proper reoord thereof. Ordinance No. 312 having duly passed, the same was presented to the Mayor for his approval and the Mayor having duly considered the same thereupon, in open fli ;l FIE c,. session of the City duly signed and approved said Ordinance No. 312. 332 33 33 IT WAS FURTHER ORDERED, that said ordinances Nos. 312, 313 and 314 be published at least one time in the regular issue of the Caldwell Tribune, a weekly newspaper printed, .published and of general ciroudation, in the City of Caldwell, Idaho, which newspaper is hereby declared, determined and adjudged by said City Council to be the official newspaper thereof. Thereupon Councilman Dickens introduced Ordinance No. 315, entitled: AN ORDINANCE CREATING AND ESTABLISHING A LOCAL IMPROVF.1MNT DISTRICT TO BE CALLED "LOCAL STREET IMPROVEMENT DISTRICT NO. 2 ", IN THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DESIGNATING THE STREETS AIM POINTS BETWEEN WHICH SAID IMPROVEMENTS SHALL BE MADE, AND PROVIDING FOR THE CONSTRUCTION OF PAVEMENT, CURBS AND GUTTERS THEREON: PROVIDING THAT THE COST AND EXPENSE OF SAID IMPROVEMENT SHALL BE TAXED .'QM ASSESSED UPON ALL THE PROPERTY IN SAID IMPROVEMENT DISTRICT FRONTING OR ABUTTING 012 CONTIGU- OUS OR TRIBUTARY TO THE PORTIONS OF SAID STREETS SO IMPROVED; AND PRESCRIBING THE METHOD OF SUCH ASSESSMENT AND THE PAYMENT THEREOF; REPEALING ALL ORDINANCES, RE- SOLUTIONS OR ORDERS, OR PARTS THEREOF, IN CONFLIOT HERE=WITH; LND DECLARING AN EMERGENCY. Ordinance No. 313 was thereupon read in full by the City Clerk and considered by the Council. Thereupon Councilman Ward moved that that part of the Compiled Laws of the State of Idaho and the rule requiring the reading or Ordinances fully and distinctly on three different days be dispensed with in the manner prescribed by law, and that pro- posed Ordinance No. 313 be read the second time by title and the third time in Yell and placed on its final passage. Said motion was seonnded by Councilman Mitchell. The Mayor stated the motion and put the question and the vote upon said question was as follows: Those voting "yea" Councilmen Dickens, A. J. Miller, F.R. Miller, Mitchell, Sanberg and Ward. Those voting "no" - none. The Mayor then declared said motion had duly carried by the necessary three quarters vote. Then the Mayor, stated, under the motion, that Ordinance 313 stood for Second reading and directed the Clerk to read Ordinance No. 313 the second time by title. The Clerk then read Ordinanoe No. 313 by title. The Mayor stated, under the motion, that Ordinance No. 37-3 stood for third reading and directed the Clerk to read the same, folly and distinctly at length. The Clerk then read Ordinance No. 313 the third time, fully and distinctly at lenght. The Mayor stated, under the motion, that Ordinance No. 313 had been read the third time fully and distinctly at length and stated the question: "Shall Ordinance No. 313 pass as read?" The Mayor directed the Clerk to call the roll, and upon roll call the vote upon the final passage of said Ordinance resulted as followa, to Wit: Those voting "Yee" Councilmen Dickens, A. J. Miller, P. R. Miller, Mitchell, Bahberg & Ward. 333 Those voting "No" - none. The Mayor declared said Ordinance to. 313 to have duly passed and directed the Clerk to make proper record thereof. Ordinance No. 313 having duly passed, the same was presented to the Mayor for his approval and the Mayor having duly considered the same thereupon, in open session of the City Council, duly signed and approved said Ordinance No. 313. Thereupon Councilman Dickens introduced Ordinance No. 314, entitled: AN ORDINANCE CREATING AND ESTABLISHING A LOCAL IMPROVEMENT DISTRICT TO BE CALLED "LOCAL STREET ELPROVEM14T DISTRICT NO. 2 ", IN THE CITY OF CALDWELL; CANYON COMM IDAHO; DESIGNATING THE STREETS AND POINTS BETWEEN WHICH SAID IMPROVEMENT SHALL BE MADE, AND PROVIDING FOR THE CONSTRUCTION OF PAVEMENT, CURBS AND GUTTERS THEREON: PROVIDING THAT THE COST AND EXPENSE OF SAID IMPROVEMENT SHALL BE TAXED AND ASSESSED UPON ALL THE PROPERTY IN SAID IMPROVEMENT DISTRICT FRONTING OR ABUTTING OR CONTIGU- OUSOR TRIBUTARY TO THE PORTIONS OF SAID STREETS SO IMPiOVED; AND PRESCRIBING THE METHOD OF SUCH ASSESSMENT AND THE PAYMENT THEREOF ; REPEALING ALL ORDINANCES, RE- SOLUTIONS OR ORDERS, OR PARTS TMMOF, IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. Ordinance No. 314 was thereupon read in full by the City Clerk and con- sidered by the Copnoil. Thereupon Councilman Ward moved that that part of the Compiled Laws of the State of Idaho and the rule requirlgg the reading of Ordinances fully and distinctly on three different days be dispensed with in the manner prescribed by law, and that proposed Ordinance No. 314 be read the second time by title and the third time in fall and planed on its final passage. Said motion was seconded by Councilman Mitchell. The Mayor stated the motion and put the question and the vote upon said question was as follows: Those voting "yea" Councilmen Dickens, A. J. The Mayor stated,under the motion, that Ordinance No. 314 had been read the third time fully..and distinctly at length and stated the questions "Shall Ordinance No. 314 pass as ready" The Mayor directed the Clerk to call the roll, and upon roll call the vote upon the final passage of said Ordinance resulted as follows, to wit: Those voting "Yes" Councilmen Dickens, A. J. Miller, F. R. Miller, Mitchell Sanberg & Ward. Those voting "No" - none. The Mayor declared said Ordinance No. 314 to have duly passed and directed the Clerk to make proper record thereof. Ordinance No. 314 having duly passed, the same was presented to the Mayor for his approval and the Mayor having duly considered the same thereupon, in open session of the City Council, duly sl#ned and approved said Ordinance No. 314. IT WAS FURTHER =MD. that said Ordinances Nos. 312, 313 and 314 be publish- ed at least one time in the regular issue of the Caldwell Tribune, a weekly news- paper printed, published and of general circulation, in the City of Caldwell, Idaho, which newspaper is hereby declared, determined and adjudged by said City Counti; to be the official newspaper thereof. On motion F. R. Miller seconded by Joseph Dickens, the park Committee was authorized to contract walks, curbs, pipelines etc., in City park.
