Thereupon, Councilman Montgomery, introduced Bill No. 15, proposed Ordinance No. 532, By Montgomery, entitled: Bill No. 15, Ordinance No. 532, By Montgomery. AN ORDINANCE VACATING THAT PORTION OF KIMSEY STREET IMMEDIATELY NORTH OF TH AND ADJACENT TO BLOCK 3 OF CALLAWAY ADDITION TO THE CITY OF CALDWELL: AND ALSO VACATING THAT CERTAIN UNNAMED STREET JOINING WITH THE NORTH SIDE OF AVEN STREET AND EXTENDING NORTH ALONG THE EAST SIDE OF SAID BLOCK 3 OF CALLAWAY ADDITION TO THE CITY OF CALDWELL; AND REPEALING ALL ORDINANCES - OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. which was read for the first time and the Coijncil proceeded to a consideration of Bill No. 15. -It was moved by Iollingsworth, seconded by Montgomery that the rules requiring that the reading of a bill on three separate days be suspended and that Bill No. 15, be read the second time by title and the third time in full, section by section and placed on its final passage. The Mayor directed the Clerk to call the roll on the motion with the fol- lowing results: Those voting in .the affirmative were! Oakes, Boynton, Fenrich, Mumford, - Hollingsworth and Montgomery. Those voting in the negatives None. Absent and not voting: one.. The Mayor declared the motion had passed by the necessary three - fourths mahority and directed the Clerk to read Bill No. 15 the second time by title and the third time in full section by section. The Clerk read the Bill as directed. The question then being "Shal4 Bill No, 15 pass?" The Mayor directed the Clerk to call the roll on the above question i which resulted as follows. Thereupon, the Mayor declared Bill No. 15 had passed, and the Mayor irected the Clerk to make proper entry of the same and to cause Ordinance No. 532 to be blished in the Caldwell News- Tribune, the official newspaper of the City of Caldwell, There being no further business to came before the Council, it was, on motion seconded and carried declared adjourned. ayor r City Clerk COUNCIL CHAMBERS APRIL 6th., 1936. 8:00 P. M. The Regular Monthly Meeting of the City Council met in the Council Room of the City Hall, with the Mayor Emery L. Vassar, presiding. On Roll Call the following Councilmen answered present: Edgar L. Oakes, F. D. Mumford, W.S.Boynton, G. M. Fenrieh, G. W. Montgomery and W.R. Hollingsworth. Absent: The Minutes of March 2nd, and 23rd., were read and approved as read with a few corrections. Messrs. Caron, Rettig and Torrens appeared before the Council on. 'behalf of the Kitten Ball Club and asi:ed the City to furnish the globes and reflectors for lighting the field at night. The Mayor appointed Councilmen Boynton and Mumford as a committee with e power to act. Mr. Sandmyer appeared before the Council and stated that a new bridge was needed across Indian Creek between 5th and 8th Streets on Arthur. The Mayor informed Mr. Sandmyer i that -the Council would take this under advisement. Mr. Peckham asked permission to park his trucks in the alley back of the Peckham Furniture Co., The Mayor appointed Hollingsworth and Oakes to investigate. Mr. Amos Miller appeared before the Council and asked permission to build s Service Station on the corner of 9th and Blaine Streets. Motion by Montgomery, seconded by Hollingsworth that this request be granted. Motion carried. Mr. Riner asked the City to open South 12th Street to Logan Street. The Mayor appointed a Cocmittee consisting of Councilmen - Oakes, Montgomery and the City Attorney to investigate. The City Clerk read a bid from Byron Defenbach.for auditing the books and ac- . counts for the ensuing year. Moved by Fenrich, seconded by Boynton that this bid be accepted. Motion carried. and Card Room Applications for Pool Hall /Licenses were read from I. H. Waters, S. F. Dow and A. Martin.and Card Room Licenses from F. M. Wilson,H:'.L..Livdsayl and Curtis Huston, the as accompanying each application. Moved by Montgomery, seconded by Fenrich that these applications be allowed.- ion carried. WHEREAS, It is deemed advisable and to the best interest of the City of Caldwell, anyon County, Idaho, to reconstruct a sewer, and the flitches, drains, conduits, with out - eta, man - holea, catch basins, flush tanks, septic tanks and all other sewer appurtenances; hat a local improvement district should be established within the said City of Caldwell, ad including the property abutting, adjoining, contiguous and adjacent to such improvement nd benefited thereby, as hereafter in' this resolution shall be specifically set forth; an hat there be constructed in said district a reconstructed sewer with outlets, man - holes catch basins, flush tanks and all other appurtenances necessary for the comfort, convenien ealth and well being of the municipality; and that the cost of said improvement shall be -vied and assessed against the lots and lends included'within the said improvement distric ad benefited thereby, as in the manner provided by law, NOW, THEREFORE, BE IT RESOLVED By the Mayor and Council of the City of Caldwell, daho: :1i) 0 Section 1. That it is hereby declared to be the intention of the Mayor and Coun- t of the City of Caldwell, in the County of Canyon, State of Idaho, to create and establl thin the City of Caldwell, Local Improvement District No. 15 for the said City of Caldwel -- 0 Section 2. That the said proposed improvement shall be a reconstructed or re- improvement of the sewer line and improvement already in place, and which is in need of nnn�rrr enlargement and repair; and the general character of the improvement to be'made in the said proposed local improvement district is to reconstruct a sewer for sanitary and drainage purposes, with outlets, man - holes, catch basins, flush tanks and all other sewer appurten- ances necessary for the comfort, convenience, health and well being of the municipality to be constructed of Portland cement, earth, sand, gravel, stone and cast iron, and such ex- cavations as may be necessary, all in accordance with the plans and specifications to be hereafter adopted by the player and Council of the City of Caldwell, Idaho, and placed on file in the office of the City Clerk of the City of C Canyon County, Idaho. Section 3. That said local improvement districA shall constitute and include a1 of the lands and lots, parcels or pieces of land abutting, adjoining, contiguous and adjace t �?1 to the improvement, as hereinafter described, in Sao. 4 hereof, and all of the lots lands, V� parcels and pieces of land benefited by such improvement within the following described boundaries, to -wit: Beginning at the center of the intersection of Albany Street and Eleventh Avenue North in the City of Caldwell, Canyon County, Idaho; thence running Southeasterly along the center Xine of said Albany Street, to the center of the intersection Of said Albany Street and Twelfth Avenue North; thence at right angles in a North- easterly direction, along the center line of said Twelfth Avenue, to the center point of the intersection of said Twelfth Avenue North and Albany Street of Caldwell, Idahp; thence Northwesterly along the center line of said Belmont Street, to the, center point of the intersection of Eleventh Avenue North and said Belmont Street; thence at right angles, in a Southwesterly direction, along the center line of Eleventh Avenue North, to the center of the inter- section of said Albany and Eleventh Avenue North, which is the point of beginning. Section 4. That it is proposed to construct in said local improvement district o. 15, the following described reconstructed sewer for sanitary and drainage purposes, Kith outlets, man - .'doles, catch basins, flush tanks and all other sewer appurtenances nee - ssary for the comfort, convenience, health and well being of the municipality; and partiou - ly, }8 inch main line constructed of suitable sewer pipe material, having its point of I ' j eginning and general course and point of ending along and upon the following described r ley, to -wit: That certain alley between Albany street and Belmont Street, Canyon County, Idaho, and beginning at a point in the middle of the street at Twelfth Avenue North; thence in a Northwesterly di- rection, along said alley line, to the center of the intersection of said alley line and Eleventh Avenue North. which said sewer, with its outlets, man- holes, catch basins, flush tanks and all other sewer appurtenances necessary for the comfort, convenience, health and well being of the municipality, shall be constructed according to the plans and specifications for such system which are now on file in the office of the city engineer of the City of Caldwell at the city hail thereof. Section 5. That the estimated cost of said improvement herein provided for is the sum of 61500.00. Section 6. That the cost and expenses bf said Local Improvement District No. 15, and the construction of said improvement shall be assessed upon the property lying within the boundaries of said proposed local improvement district, in accordance with the pro- visions of Sections 49 -2505 and 49-2506, I. C. A., and in accordance with the special be- uePits to said property to be determined and fixed by the Council when the district is created, and shall be assessed upon the abutting, adjoining, contiguous and adjacent lots, lands, parcels and pieces of land within said improvement district, and the land benefited and included in the improvement district, when formed, along which alley where the proposed improvement be constructed, as hereinbefore described, and the said cost and expenses, in- cluding the cost and expenses of the intersections, shall be assessed u ^on the abutting, adjoining, contiguous and adjacent lots, lands, parcels and pieces of land included in the improvement district, when formed, each parcel of land being separately assessed for its proportion of the "total cost thereof, and for the debt thereofin proportion to the number 0f squarof such lots, lands parcels and pieces of land abutting, adjoining, contiguous and adjacent thereto, or included within the said improvement district, to a distance back from said alley, if platted in blocks and lots, to the outer edge of said block; if not platted, to a distance of 125 feet from the center of said block and middle of said alle y and in proportion to the benefits derived to such property by said improvement, sufficien to cover the total cost and expenses of the work, provided that no property shall be in- cluded within such improvement district, or assessed for such cost and expenses, situated more than 150 feet on either side of the improvement to be made; and that all property within the said improvement district shall be assessed in accordance with the special ;, benefits to such property, as herein provided; and the cost and expenses to be assedded and provided for shall include the contract price of the improvement, engineering, clerics service, advertising, cost of inspection, cost of collection upon assessments, interest on warrants, if issued, and for any and all legal services for preparing proceedings and ad- vertising in regard thereto. Section 7. That the cost and expenses of all improvements within the inter - sections in the said Local Improvement District No. 15 shall be paid for in accordance with Section 49 -2506, I. C. A., and against the property within the said local improvement district, and not against the City of Caldwell; the petition for the organization of this district having requested that the same be assessed against the property within the distri and not against the city, and shall not become a general obligation of the City of Caldwe Section S. That the Mayor and Council of the City of Caldwell shall assume and retain fill and complete jurisdiction of all construction work necessary to consturct the said improvement, and to do the same by contract, as provided by law, or by force account. That the committee on streets, together with the city engineer, shall, under the direetio of the Mayor and Council, supervise the construction of the work and see that the some is done in6trist compliance with the plans and specifications provided by the city engineer, and approved by the City Council, and such contracts as may hereafter be entered into by said city, and to whom the contract may be awarded after due notice for bids has been pub- lished, as required by law. Section 9. That all property owners who desire to protest against the making of such improvement, and the creation oY such improvement district may file such protests against such improvements and against the creation of such improvement district, in the office of the City Clerk of the City of Caldwell, Idaho, at any time before a o'clock P. M. on the 20th day of April, 1936, at which time the Mayor and Council of the City of Caldwell will meet at the City Council Ohambers'in the ehthorized and usual place of meet- ing, to hear and pass upon such protests heretofore filed, and determine whether or not to proceed with the proposed improvements. Section 10. That the City 4lerk is hereby authorized and directed to give due and legal notice hereof of the time within which protests against such propsed improvement or the creation of said district may be filed, and the date when such protests will be heard and considered by the Council, which notice shall prescribe the general character of the improvement proposed to be made, and the estimated total cost thereof, and shall cause such notice to be published once a week for two weeks in the Caldwell News Tribune, a newspaper printed and published at Caldwell, Canyon County, Idaho, and the official news paper of the city, the last publication of which shall be ay least five days preceding the said 20th., day of April, 1936, being the date fixed in this resolution when the protests may be fAled; and the City Clerk of the City of Caldwell, Idaho, shall cause the publisher's affidavit of publication to be fildd in his office befone the time herein fixed for the filing of said protests; a copy of such notice shall be mailed to each and every owner of property, if known, or his agents, if known, within the limits of said improvement distrie , addressed to the Post Office at Caldwell, Idaho, the city wherein said improvement is to be made; and the City Clerk of the City of Caldwell must file in his office an affidavi$ showing the mailing of said notices. Section 11. Assessments made and levied to pay the cost and expenses of said improvement shall constitute a lien upon and against the property upon which ouch assess - ment.or assessments are made and levied, from and after the date upon which the ordinance levying such assessment or assessments becomes effective. Such lien shall be superior to the Ilan of any mortgage or other encumbrances, whether prior in time, or not, and shall constitute sudh a lien until paid, subject to the extinguishments of any such lien by the sale of the property on account of non - payment of general state and county taxes. Such assessments shall be collected, or the property in default shall be foreclosed and sold for such assessments and costs in a suit for that purpose by the city, in the manner pro- vided by law. Section 12. That the construction of said improvement is necessary for the im- mediate preservation of the comfort, convenience, health and well being of the.municipalit ; and therefore, and emergency existing, this resolution shall be in full force and,effect from and after its passage and approval. Whereupon, Councilman Hollingsworth moved the adoption of the resolution, whie m otion was seconded by Councilman Fearich. WHEREAS, An application has been made to the WPA for a grant for the improvement : onstruction and enlargement of the sewer between Albany and Belmont Streets in the City c ;aldwel )-, and WHEREAS, The same.would be a great benefit to the Idaho Meat Producers, Inc., ar Co the City of Caldwell, WHEREAS, There will be certain additional expenses that must be met for material and labor, which must be expended in addition to the grants allowed by the Federal Govern. lent through WPA, and WHEREAS, The said Idaho Meat Producers, Inc., is willing to assume the additions 3xpense•thus created, to the extent of Three Thousand, Sim Bundred Dollars($3,600.00j and cave signed a contract with the City of Caldwell, by and through its officers and agents, I / . / which was executed on behalf of the City by the Mayor and City Clerk, NOW, THERL - ORE, BE 1T RESOLVED That the said contract so made and entered into by and between said Idaho Meat Producers, Inc., and the City of Caldwell, and dated April 1 1936, be and the same is, hereby affirmed, approved and adopted as and for the act of'I the City of Caldwell. Whereupon, Councilman Hollingsworth moved the adoption of the preamble and re- solution, which motion was seconded by Councilman Montgomery. Whereupon, the Mayor declared the motion carried and the preamble and resolution duly adopted. B. appeared before the Council and requested that the street begin dng at the easterly corner of Block 112 Strahorn Addition and Cleveland Boulevard and pass ing through said block to the roadway or alleyway south of the Caldwell Produce Co., ware- house. Mr. Cooper also stated that they would furnish the ground. Thereupon the Mayor appointed Hollingsworth and Fearich as a committee with powe'. to act. Attorney, S. Ben Dunlap appeared before the Council on behalf of Paul Chevalier and requested settlement for the land taken off of Chevalier's property in Block 58 of Devers Addition for the Stock Trail project. Whereupon the Mayor appointed the following Committee: Hollingsworth, Fenrich and City Enginner to investigate the matter and report to the Council. Mr. Dunlap further appeared before the Council and asked what could be done with the Bunt case. The matter was referred to the City Attorney. Mr. Dunlap further appeared before the Council and asked that the taxes be can :ellad on Lots 7 and 8 Block 12 Arldngton Addition belonging to Fordyce Newell. A discussion was had on the subject and the City Attorney was of the opinion that the City Council had no authority to cancel special improvement district taxes and assessments when there were outstanding unpaid bonds and warrants against the local improve districts. Therefore the Mayor declared that he'thouglit nothing could be done on the request the matter was dropped. An affidavit of publication on- Ordinance No. 522, was read by the City Clerk.
