Oounoil met in regular Session pursuant to law with Mayor .McConnel
preaiding, and Councilmen, Bollman, Dickens, Gordon, Johns, Leighty and Sandmeyer
present. Absent; None.
Owing to the absence of the City Clerk the Mayor appointed Dar: W. 0. Dyer
acting Clerk and announced that the UO uncil wen in Session for the consideration of
any business which.might leWfnlly acme before it.
Mr. R. E. Wagner, holding the garbage disposal contract for the city of
Caldwell, appeared before the Uounoil and discussed the matter of the condition of
the city dumping grounda, Prom which it appeared that there had been an indiscriminate
dumping of waste and garbage at the city dump grounds some of which was likely to
become a menace to the public health. Thereupon it was moved by Bollman and
Seconded by Johns that the Mayor appoint a Committee to investigate the condition ,
of the city dump grounds. Motion carried. Thereupon the Mayor appointed Councilmen
Bollmon,'Leighty and Dickens, as such committeeN
Mr. C. V. Yeokham, appeared before the Council and stated that he had
signed &:promissory note in the sum of 4200.00 with John White, who had been.conviot-
ed a number of years ago in police oourt.on a charge of the violation of the liquor
laws, with note having been given in payment of a fine. He requested that the Mayor
and Connoil do such action as might be necessary towards remitting Such fine and
csnoelli�g such note. After unbusaing slid considering he request quest of C. Y. Peckham
by membeis of the Council, it was moved by Dickens and seconded by Bollman that the
Mayor be. authorized to remit the fine for John White for which the promieso" note
by 0. V.1 had been given. Notion carried.
Thereupon Councilman bandmeyer introduced the following resolution and
moved ite adoption;

WHEREAS The City of Caldwell, Idaho, is the owner of 'Block Eighty- nine(89)
Of Mounain View Addition to the City of Caldwell, Idaho, and
WMREAS Said property IS assessed by the Pioneer irrigation District as
Lots and on a lot basis according to the contract between said Pioneer Irrigation
District and the Uity of Caldwell, Idaho, and
Y11HREAS It will be to the advantage of Said City of Caldwell, Idaho to
have thA plat on said property vacated, so that the said property may be assessed
by th9 ioneer Irrigation Listriot for water assessments on an sereage basis instead

of a lot basis#
NOW THEREFORE BE IT RESOLVED, By the Mayor and Council of the City of

Caldwell, Idaho as follows;
That the Mayor of the City of Caldwell, Idaho, be and he hereby is
authorized and directed to Sign a petition for vacating the plat on said Block
Eighty -nine (89) together with the alley therein; and that the City Clerk of said
city be-and -he hereby is authorized to attest said signature and attach the seal
of the City of Caldwell, Idaho thereto,
The motion for the adoption of said resolution was duly seconded by la ighty.
The question being Itshall the resolution pas §7" The Mayor directed the Clerk to call
the roll which resulted as follows: Those voting in the affirmative: Bollman,
Dickens, Gordon, Johns, ieighty and Sandmeyer: those voting in the - negative: Hone.
Absent and not voting: None. Whereupon the Mayor declared the motion carried and

Resolution No, *9 adopted and directed the Clerk to record the same upon the ouraal
of the proceedings of the Council as a part of the minutes of this meeting. Thereupon
the Mayor in open session of the Council duly signed and approved said resolution and
the Clerk duly signed qnd attested the same.
Notion by Sandmeyer seconded by Bollman that Bills be allowed and warrants
ordered drawn on the various funds, to -wit: Motion carried.'

AGRICULTURAL LAND.
THIS AGREKMNT, made End entered into this let day, of April, A.L., 1931, by and
between the City of osldwell, a municipal corporation, in the county of Canyon, Stats of
Idaho, party of the first part, and W. Be ALLISON, of Caldwell, in. the County of Canyon,
state of Idaho, party of the asoond part.
WIT Esszn: that, whereas, the party of the first part is the owner of the
real property' hereinafter described, which is agricultural lamd and suitable for the
growing of crops, and the party of the second part desires to farm said land and grow
crops thereon; therefore.
IN pONSIDERATION OF THE PREMISES, and of the mutual covenants and agreements
herein contained, it is hereby mutually agreed by and between the parties hereto, as
follows: .
(1) The party of the first part hereby employs the party of the second part to
farm and care for, during the farming season of 1931, the following described real pro-
perty, situated in the County of Canyon, state of Idaho, towwit:
Commencing at the Southwest corner of the Northwest Qnairter (NN}) of Section
Fourteen (14p Township Four (4) North, Range Three (3). West of the Boise Meridian,
thence East'ajong the South line of said quarter section BE rods; Chance in a Northwesterl
South west R liine o of skid point 56 5 6rod the theplace beginning-, in; nos
also the southeast Quarter of the Northeast Quarter (SE} NE}). of section Fifteen (lb),
Township Four (4) North, Range Three (3), West of the Boise Meridian, Canyon County,
Idaho, in all oomprizing approximately 49 acres. /,
(2) The party of the second part shall properly and in due season prepare for seed,
plant, till, irrigate and harvest a 'grain 'crop upon the lend heretofore under cultivation
on the above •dsscribed premises! and irrigate and harvest the h@y growing on said premises,)
a skillful and farmerlike manner; and shall furnish the necessary seed for planting said
crop of grain, together with all of the labor and other expenses incident to the producing
of a crop thereon, except the charges for Irrigation of said land, which eball be paid by
the party of the first part.
(3) The party of the second part shall receive for his services in forming and oarin@
for said land•two- thirds of all of the grain which he shall produce on said premises, and
one -half of all of the hay produced on said premises for the crop season of 1931;
provided, however, that the party of the second part 1s hereby granted the privilege of
purchasing from the party of the first part, at a market price at the time of threshing.

the party of the first part.
(4) In the event the party of the second part shall not purchase the share of the
crop belonging to the party of the first part, he shall deliver the grain belonging to the
party of the first part to such point of marketing in the City of Caldwell, as may be
designated by the Mayor of the city. All hay grown on said premises shall be ataoked on
the premises, and measured for division not later than Coto ber, 1. 1931, and in the event
the party of the second part does not purchase the share of hay belonging to the party of
the first part, said share shell be left on the premises for the party of the first part.
(6) The party of the first part hereby reserves the dwelling house and a garden slgot
not to exceed one -forth acre on the above described premises, and the party at the second

part shall farm all of the remainder of said land.
IN TESTIMONY WHEREOF, the City Council of the City of Caldwell, has caused this
instrument to be signed by the Mayor of said city; and attested by the Clark thereof

Thereupon it was moved by Sandmeyer and seconded by Johns that the foregoing
contract be approved, and that the Mayor and Clerk be authorized to execute said contract
for and on behalf of the City d' Caldwell. Motion carried.
Thereupon it was moved by Bollmsnt and seconded by Dickens that Council
adjourn to reconvene on April 30th, 1931, it 8:00 o'clock p.m. Motion carried.
Thereupon the Council adjourned pursuant to the foregoing motion.

Ccunoil met in regular session, pursuant to adjournment with Mayor•

Sandmeyer, present: Absent; none.
paving to the absence of the City Clerk the Mayor appointed Mr. W. C. Dyer,
acting Cleri, and announced that the Council was in session for the consideration
of any business which might lawfully come before it.
The Minutes of the meetings of the Council held on February 2, and ' 18,
March 2 and.30th, and April 6, 1931, were read by the Clerk. it was moved by
Councilman Johns and seconded by Councilman Bollman that the minutes be approved go
read.
Thereupon Bill No. 22 came up for third reading and the Mayor directed
the Clerk to read the bill the third time in fu11 section by section. The Clerk
read the Bill as directed and the Council proceeded to a oohsideration of Bill No.
22. it weeef moved by Sollman and seconded by Leighty. that Bill no. 22 be placed on
its final Assage. Motion carried. Thereupon the Bill was placed before the
Council foxy final passage. The question being "Shall bill No. 22 pass?" .The Mayor
Directed the Clerk to call the roll which resulted as follows: Those voting in -
the affirmative; Sollman, Dickens, Gordon, Johns, Leighty and sandmeyerl Those
voting in the negative: None. Absent and not voting: None. Thereupon the Mayor
deolared Bill No. 22 had passed, and in open eeesion of,the Council the Mayor duly
signed an &•approved said bill, and the Clerk duly signed and attested the same, which
