Ths Regular Monthly Meeting of the City Council met in the Council Room of the City Hall, with the Mayor, Emery L. Vassar, presiding. On, Roll Call the following Counci]men answered present: Edgar L. Oakes, W. S. Boynton, G. 4P. Montgomery, G.N. Fenrich amd W.R. Hollingsworth. Absent: F.D. Mumford. The Minutes of March lst., and March 15th., were read and approved as read. Mr. P. F. H6rne„ representing the I. 0. 0, F. appeared before the Council and asked that OFdinance No. 535 be amended. This matter was referred to the City Attorney and the Cemetery Conmittee. Mr„ Harry Parker appeared before the Council and asked permission to place a Trailer Luncyi Stand on the lots at 7th and Blaine. This matter was referred to the Build. ing Inspector. A Petition uith a number of signers was presented to the Council petitioning that Georgia.Avenue be opened and improved between said Cherry Street aid Beech Street. The Mayor appointed the Road Committee and the City Engineer to investigate this matter and report at the next Council Meeting. Mr. F.D. Mumford appeared and was marked present. The City Clark read an Affidavit of Publication. A Petition was presented to the Mayor and City Council for the construction of A sewer on Block A. Original, Block A Golden G,,te, Block B Original, Block B. Golden G and Block 1 GZlIden Gate. Moyed by Montgomery, seconded by Mumford the above petition and other sewer petions be set up as goverment projects. Motion carried. Applications for Pooh Hall License .:were read from I.'H, WSters dnd.S .F, Bow, - the fee -, accompanying each application. Applications for Card Room License were; read f rom I,. H. :'Paters, S.F.-Bow, Lind- ley and Rowland, and the Pastime Lunch the fee accompanying each application. Moved by Oakes, seconded by Hollingsworth that these licenses be granted. Motion carried. The City Clerk read a letter from The Caxton Printers extending their appreciati< of the services which the Fire and Police Departments of the City of Caldwell gave in con- nection with.their fire. The bills for March were read and on motion -by 40ntgomery and seconded'"' by Boynton that these Bills be allorada and warrants be ordered drhwn for the various amounts all of which had been approved by the Chairman of the Finance Gommittee. NOW, THEREFORE, BE IT RESOLVED, That the said sprinkling tax against the said property for the above mentioned years in the above principal amounts f'or the several years, plus interest and penalties, be, and the same are, hereby cancelled, and the j treasurer of the .City of Caldwell, as the collector of all special improvement and � special taxes of the City of Caldwell, be, and he is hereby authorized and directed to cancel upon the books the assessments, plus interest and penalties for each of the above years on the above described property, and to issue in suitable form any certificates or instrument in.writing necessary to show that the said assessments and taxes have been cancelled in conformity herewith; and moved the adoption of said preamble and resolution, which motion was seconded by Montgomery. A Yea and.a Play vote was had thereon, with the following result: Yea: Oakes, Alumford, Boynton, Renrich, Montgomery, and Hollingsworth. Nay: None: Absent and not voting: None: Thereupon. the mayor declared the motion duly carried and the preamble and resolution duly adopted. PASSED By.the Council this 5th. day of April 1937. APPROVED By the Kayor this 5th day of April 1937. Mayor Y City Clerk. Mr. Chas Shaffer appeared before the Council and explained the various insurance and casualty, policies carried by the City in its various departments. Thereupon the matter of the contract with the Trustees of the Hill Crest Pipe Line, a common law trust, which was for the delivery of excess domestic water which the City at the present time does not have any use, was presented to the Mayor and Council and upon due consideration the following resolution was presented by Boynton, who moved its adoption, which motion was seconded by Montgomery. RESOLUTION By Boynton. BE IT RESOLVED, WHEREAS, The City of Caldwell has at the present time excess wat and the Hill Crest Pipe Line desires to use the same and have presented to the Mayor and Council a contract and it appearing that it is for the best interest of the City and its inhabitants thereof that said contract be executed, NOT THEREFORE BE IT RESOLVED and this does resolve that the said contract be and the same is hereby a ^proved and the Mayor and City Clerk of the City of Caldwell be and they are hereby authorized and directed to execute said contract on behalf of the City of Caldwell. A Yee and Nay vote was had thereon with the following result: All the Council— men present voted in favor thereof and none against. Thereupon the Mayor declared the motion carried and the Resolution adopted. Thereupon Counciliaan Hollingsworth presented the following preamble and resolutio and moved its adoption, which motion was duly seconded by Montgomery. RESOLUTION By Hollingsworth. J ➢PHERE�S, there is an action pending in the Judicial Court of the Seventh Judi District of the State of Idaho in and for Canyon County, wherein T. T. Bunt tasplaintiff Sa 9 \ and the City of Caldwell, defendant which involves the old Interurban Right of way at the north add of the City of Caldwell and extending to the 014 Interurban Bridge,aoross Polbse River, and, I WHEREAS, a matter of the settlement of said dispute has been agreed upon between th attorneys for the plaintiff and defendant and a contract has been tendered between said W. T.Bunt and the City of Caldwell in settlement of said matter and it appearing that it is for the best interest of the City of Caldwell that the matter be settled as outlined in aid contract, NOW TEEREFORE BE IT RESOLVED, that the said contract so tendered be and the same s hereby approved and the Mayor and the City Clark of the City of Caldwell be and they re hereby authorized to execute the said contract on behalf of the City of Caldwell. A Yea and Nay bote was had thereon with the following result: All the Councilmen resent voted in favor thereof and none against. Whereupon the Mayor declared the motion carried and the Resolution adopted. Whereupon, the following preamble and resolution was presented to the Mayor and ouncil by Councilman Montgomery, who moved the adoption thereof: FIEREZS, The City of Caldwell is the owner of the lot, parcel and tract of real state hereinafter described and situated within its limits; add That the same was not acquired for or used as a pu park, playground or public uildi.ng site, and that the same is not needed for:.any,municipal purposes whatsoever. NOW, THEREFORE, BE IT RESOLVED That the said tract of land 'hereinafter described ad above referred to, be offered for sale in accordance with the Statutes of the State of daho in such cases made and provided, and the same is hereby authorized to be sold by the ayor and Council of the City of Caldwell, Canyon County] Idaho.
