met in ragular session pursuant to adjournment with Mayor J. B. Gowen presidiLIg and
Councilmen E. A. Clark,R. Farrar, J. G. Gartin, Jas. Harris, T. N. Poynter present;
C. J. Shorb, Clerk, when the following business was tran:
Mrs. H. K. Hartley appeared bearing protest of A. Greenlund et al, against
guttering Kimball Avenue, which she read, and the same was Banded the Clerk to file.
The minutes of the Council held in February were read and approved on motion
of Clark;
The February reports of officoee were read and approved on motion of Clark
accepted and ordered filed.
The minuted of the Council meetings held in March were read and approved.
The reports of Treasurer, Librarian, Sexton, Clerk, Sanitary Inspector,
Superintendent of Streets, Superintendent of Water Works and Sewers, were read, accepted,

The claim of the Gauld Co., in the sum of 59,514.56 for steel pipe and
fittings to tb replace the wood pipe in the Paving District, was read and a motion was
i2de by Farrar that the same be allowed and that warrants for same be drawn on the
Water Works Fund. The roll neing calledon the motion, the vote resulted
Ayes-- Clari, Farrar, Gartin, Harris, Paynter--5.
Nays - -0.. Absent -- revers. 0o the motion prevailed.
A motion was made by Clark that the City Clerk be allowed :25.00 per month
additional, for extra services, beginnil►g March 1, 1910. The roil being called on
the motion, the vote resultede

A motion was made by Farrar that the claim of Frank Hagerman in the.sum of
501, witness Pees and Percy Jessup, in the sum of $2,50 for special police, be
disallowed. The roll being called on the motion, the vote resulted:
Ayes -- Clark, Farrar, Gartin, Barrie, Paynter - -5.
Nays - -0. Absent-- Devers. So the motion prevailed.
A motion was made by Clark that the claim of Otilie Vieeher be allowed

The City Attorney gave the following opinion:
April 4, 1910.
To the Honorable Mayor and Council of the City of Caldwell, Idaho,
Gentlemen:
In re bonds of Local Sewerage Impoovement District No. 3, will say that I
have again examined the laws govecning the issuance of these bonds, and especially the
st4ituted of this state, and am of the opinion that the laws governing the Issuance of
same have been substantially complied with.
The point line been raised that Ordinance No. 139 provided that said bonds
shall be paid at the and of ten ye4ra and that in order to meet said payments the
council must levy equal annual assessments. The law governing this subject is found
in I. R. C. Sec 2353, paragraph 11, and a careful examination of said section will
show that if the city does not deem it advisable to have the cost of constructing the
sewer paid for in one assessment they nay issue bonds therefor to mature in ten years.
The city had availed itself of this privelege and has provided that coat of said sewer
may be paid for in ten year bonds.
On examining the statutes, and the Ordinances of the City of Caldwell passed
in conformity therewith and by virtue thereof, it is apparant that any person who is
assessed in said district may pay his entire assessment at One time, or he may pay it
In ten equal annual installments with interest at 8 per cent pnrdeferred payments, or
he may avail himself of the bond issue and make his payments as provided therein.
The bonds may be made payable on or before a date not to exceed ten years
from and after theidate of said bonds and nothing is provided by statute as to when
the sinking fund shall be assessed and collected except that same must be sufficient
to pay said bonds at maturity.
At the suggestion of a member of the James Kennedy Construction Co. it
was provided in Ordinance No. 143 that the sinking fund shall begin to accumulate
after the year 1915, one -fifth to be paid each year thereafter. This was done to
facilitate the sale of the bonds and refers to the bonds only.
The provision concerning annual installments in Ordinance 139 Is but the
incorporation of the statutory provisions allowing any person to pay his assessment any
time vithin the ten years period ,without regard to the bond issue.

Voted, on motion of Farrar that the same be spread at length upon the
minutes and certified copies of the same be furnished contractors.
The Mayor appointed Farrar and Poynter members of Fire Committee.

A motion was made by Farrar that the Water Committee and City Engineer be
empowered to receive bids for additional wells at the City pumping plant. The roll
being called on the motion, 'he vote resulted:
Ayes -- Clark, Farrar, Gartin, Harris, Paynter--5.
Nays - -0. Absent-- Davers. So the motion prevailed,
Petition of officers of'Oollege of Idaho praying the Council "to include
the grounds comprising the College Campus in Sewer District Tio. 3" was read. It was
suggested that the City Engineer prepare the plane and estimates and the City Attorney
the necesaary ordinances to create another lateral sewer district.
Voted, on motion of Curtin, that the Council adjourn until Monday, April
11, 1910, at 8 p, m.
