H The City Council met in the Council Rooms in conformity of adjournment og March 21 with the Mayor, Fred L. Lilly, presiding. On Roll Call, the following Councilmen answered present: M. 8. Sandmeyer, C. E. Bales, C. M. Johnston, Joe Dickens and E. L. Vassar. A. 0. Keister, absent. Sickness. The Mayor stated that the object of the meeting was to hear the final report of the Zoning Committee. E. L. Vassar, Chairman of the Zoning Committee, read the Final Report of the Committee. R. B. Soatterday was present and asked the Oouncil to allow the Union pacific Stage Co. to change its location from the corner of 7th. and Arthur Street to the corner of 9th. and Arthur Street. ur After a tmorough discussion of the matter, the Clerk read 'Ordinance No. 49f by Sandmeyer, as fllows: AN ORDINANCE PROHIBITING THE USE OF CERTAIN STREETS, SIDEWALKS AND CURBS IN CONNECTION WITH PARKING, LOADING AND UNLOADING BY STAGES AND BUSSES AND REGULATING THE USE OF THE STREETS, SIDEWALKS AND CURBS BY THE SAME; AND PROVIDING FOR A PENALTY FOR A VIOLATION HEREOF;AND REPEALING ORDINANCE NO. 46t. The Council proceeded to a consideration of the proposed Ordinance. It was moved by Sandmeyer and seconded by Dickens that the Rules requiring the reading of a Bill on three separate days be suspended. and that the proposed Ordinance be read the second time by title and the third time, section by section, and placed on its final reading for passage. The Mayor directed the Clerk to call the Roll on the motion with the following results: Those voting in the affirmative were: Sandmeyer, Bales, Johnston, Dickens and Vassar. Those voting in the negative, None. Adsent and not voting, Keister. The Mayor then declared the motion had carried by the necessary three - fourths majority, and directed the Clerk to read the proposed Ordinance the second time by title and the third time in full, section by section. The Clerk read the proposed Ordinance as directed. The, question being.. 11 Shall Proposed Ordinance No. 448 pass? ° The Mayor direct- ed the Clerk to call the Roll with the following results: Those voting in the affirmative were Sandmeyer, Bales, Johnston, Dickens and Vassar. Those voting in the negative, None. Absent and not voting, Keister. The Mayor, thereupon, declared that the proposed Ordinance had passed, and., in open session of the Council,duly signed and approved said proposed Ordinance, and the Clerk signed and attested the same which became Ordinance No. 49�( The Mayor directed the Clerk to make the proper entry of the se_ne and to cause Ordinan ce No. 498 to be published in the Caldwell News- Trkbune, the offficial newspaper of the City of U aldwell. The Clerk then read proposed Ordinance by Sandmever, as follows: AN ORDINANCE GIVING TO UNION PACIFIC STAGES, INCORPORATED, A CORPORATION, AND ITS ASSIGNS, CERTAIN RIGHTS WITH RESPECT TO OPERATION OF STAGE LINES AND STAGE DEPOT, AND PROVIDING FOR PARKING IN CONNECTION THERE'JITH;PROHIBITING THE USE OF CERTAIN PARKING SPACES BY PRIVATE CONVEYANCES AND PROVIDING A PENALTY FOR THE VIOLATION HEREOF, AND REPEALING ORDINANCE NO. 462. The Council proceeded to a consideration 6f the proposed Ordinance. It was moved by Sandmeyer and seconded by Diokene that the Rules reeuiring the the reading of any Bill on three separate days be suspended and that proposed Ordinance No. 499 be read the second time by title, end the third time in full, section by section, and placed on its final_ passage. The Mayor directed the Clerk to call the Roll on the motion with the following results: Those voting in the affirmative were; Sandmeyer, Bales, 1 Johnston, Dickens and Vassar. The itayoy then declared the motion had passed by the necessary three-foutth March 29, 1932 majority and directed that the Clerk to read the proposed ordinance the second time by title and the third time in full, section by section. The Clerk read the proposed Ordinanc as directed. The question beinn, '� Shall the proposed Ordinance No 499 pass?° The Mayor directed the Clerk to call the Roll with the following results. Those voting in favor were Sandmeyer, Bales, Johnston, Dickens and Vassar. Those voting in the negative, None. Absent and not voting, Keister. Thereupon, the Mayor declared that the 'proposed. Ordinance No. 499 had passed and the Mayor, in open session of the Council duly signed and approved the said proposed Ordinance, and the Clerk duly signed and. attested the same, which became �, Ordinance. No. The Mayor directed the Clerk to make proper entry of the same and to cause Ordinance No. to be printed in the Caldwell News- Tribune, the official newso_a_ner of the City of Caldwell. Mr. Scatterda.y a190 presented the written consent of all the owners or occupants of property that would be affected by the location of the Stage office at this. looa.tion. 1 as follows. TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, IDAHO. �+�J The undersigned being the owners or occupants of the property on the south side of Arthur Street, between Kimball Avenue and Ninth Street, and comprising Lots Six (6) , Seven (7), Bight (8), Aline (9), Ten (10), Eleven (11) and Twelve (12)in Block Ten (10) of i the Original town ( now city) of Caldwell, hereby consent to and state that they have no objections to, Union Pacific Stages having its office in the building located on Lot Ten (10) in said Block, and also have no objections to said company using for parking space the street in front of said Lot Ten (10) ( being the Ball building) , and the Southeaaterl h 20 feet of said Lot Nine (9) ( being the building occupied by Bill's Barber Shop), and we request that Union Pacific Stages be permitted to use such parking space for that purpose. Burns Pron The Council again took up the consideration of the Report of the Zoning Committee which was considered Paregraph by Paregraph, and each thoroughly discussed. Moved by Dickens and seconded by Johnston that the report of the Zoning Committee be accepted and a cony placed on file in the office of the City Clerk, and that the Clerk be authorized to see that a notice of a public hearing, to be held on the evening of April 18, 1932 at 8:00 o'clock p. M., be published in the Caldwell Newe -- Tribune first on March 31st and in each issue of the above paper thereafter until said hearing. Motion Carried. No further business appering, it was moved by Vassar and seconded by Dickens that this Council stand adjourned until the next Regular Monthly meeting, April 4th, unless scones assembled on call of the Mayor.
