The Mayor requested that everyone stand and give the Pledge of Allegiance to the Flag. The Roll of the City Council was called with the following members present: Mallea, Marcus, Cowles, Raymond, Norman, and Carter. Absent: none. (APPROVAL OF MINUTES) MOVED by Cowles, SECONDED by Norman to dispense with the reading of the minutes of the Regular City Council Meeting of March 5, 1985, and of March 19, 1985, and approve them as written. MOTION CARRIED (AUDIENCE PARTICIPATION) The Mayor asked if there was anyone from the audience who cared to bring anything before the City Council that was not on the prepared Agenda. Mr. Tom Doerr was recognized and stated that he would like to address the City Council at this time. Mr. Doerr stated that he would like to bring to the attention of the City Council the condition of the downtown street area and the continuing problem of the retail merchants not cleaning up the front of their stores in a timely manner. It was his understanding that if there was a vacant lot that became unsightly because of weeds, the City would go clean the weeds up and then charge the owner of the land. With the absentee ownership of many of the downtown buildings, the condition around the buildings was becoming a mess.. Mr. Doerr suggested that the City Council take some kind of action to require that merchants keep a clean, orderly sidewalk and front of their businesses just as it was required that the weeds be kept under control. Mr, Doerr talked with the Mayor and City Council at some length with this problem. The Mayor commented that the City sweeper did clean up the downtown streets twice a week in the early morning, but one of the primary problems was the need to have the alleys cleaned up as the trash would blow from there onto the clean streets. The Mayor also stated that this was a good time to try to stress this downtown clean -up as the annual spring clean -up was going to be for the month of April. After considerable discussion, the Mayor appointed Councilmen Raymond, Carter, and Norman to work on this problem and come back to the City Council with a recommendation. OLD BUSINESS (BILL NO. 6 - AMEND CITY CODE WITH REGARD TO SENIOR CITIZEN COMMISSION) The Mayor informed the City Council that this was the time set for the second reading of Bill No. 6 which was a Bill to amend the City Code with regard to Senior Citizen Commission. The Mayor then read Bill No. 6 by title only as follows: AN ORDINANCE TO AMEND TITLE II, CHAPTER 11, OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO WHICH PERTAINS TO SENIOR CITIZEN`S CENTER COMMISSION BY DELETING AND ADDING CERTAIN LANGUAGE WITH REGARD TO VOTING PRIVILEGE, MEMBERSHIP, VACANCIES, AND ANNUAL MEETING: REPEALING ALL ORDINANCES, RESOLUTIONS, OR PARTS THEREOF IN CONFLICT HEREWITH. Book 26 Page 50 It was then MOVED by Carter, SECONDED by Mallea to dispense with the rule requiring that a Bill be read at three separate times and the requirement that a Bill be read in full and that Bill No. 6 be passed at the second reading. Roll call vote. Those voting yes: Carter, Norman, Raymond, Cowles, Marcus, and Mallea. Those voting no: none. Absent and not voting: none. MOTION CARRIED MOVED by Carter, SECONDED by Mallea that Bill No. 6 be passed and entitled Ordinance No. 1691. Roll call vote. Those voting yes: Carter, Norman, Raymond, Cowles, Marcus, and Mallea. (DISCUSSION ON STREET PROJECTS) The Mayor then requested that the City Engineer, Ron Redmond, present this discussion on street projects. Mr. Redmond stated that he did give each Council members a handout identifying and summarizing - the projects suggested for the year. This listing of possible street projects for the year 1985 is attached to these minutes as Exhibit A. Mr. Redmond pointed out that the City has approximately $364,000 available to work with for this year. Also pointed out was those projects which had over 60% minimum requirement on petitions for Local Improvement Districts. Mr. Redmond then proceeded by explaining those projects on the handout. Several members of the audience that were present at the meeting for this particular discussion were recognized and asked questions with regard to the proposed projects. After considerable discussion, the Mayor requested that the City Council determine what direction they would give to the City Engineer on the possible street projects for 1985. MOVED by Mallea, SECONDED by Raymond to authorize preparing a Resolution of Intent to form Local Improvement Districts for Projects 1, 2, and 3 under Section A and Projects 1 and 2 under Section B on the handout identifying the possible street projects_ Roll call vote. Those voting yes: Mallea, Marcus, Cowles, Raymond, Norman, and Carter. Those voting no: none. Absent and not voting: none. MOTION CARRIED OLD BUSINESS (APPOINTMENTS AND REAPPOINTMENTS TO HISTORIC PRESERVATION COMMISSION) The Mayor informed the City Council that he received a request from the Chairman of 'the Historic Preservation Commission with regard to appointments and reappointments. The new appointments suggested were Milton Roelofs, Ron Redmond, and Sylvia Robison; the .reappointments were Chuck Randolph and Gary Mee. It was the Mayor's recommendation that the appointments and reappointments be as requested. Book 26 Page 51 MOVED by Carter, SECONDED by Cowles that Milton Roelofs, Ron Redmond, and Sylvia Robison be appointed to the Historic Preservation Commission and that Chuck Randolph and Gary Mee be reappointed to the Historic Preservation Commission. MOTION CARRIED (RESIGNATION FROM THE AIRPORT COMMISSION) The Mayor read the following letter addressed to him from Bill Keys: Please accept my letter of resignation from the Airport Commission as of this date. This action is prompted by the fact that I have served on this Commission for many years and am feeling burned out in this area. I feel that certainly there is "new blood" in the community that can fill this position with much more vitality and aggressiveness than I. Thank you for the opportunity of serving on this Commission for these many years. MOVED by Carter, SECONDED by Norman to accept with regret the resignation of Bill Keys from the Airport Commission. MOTION CARRIED NEW BUSINESS (PETITION AND RESOLUTION FOR NEW FEES AT THE CEMETERY) The Mayor stated that the primary purpose of this Petition and Resolution was to bring the costs of the Cemetery more in line with other cemeteries in the area„ Councilwoman Mallea stated that she did have a question with regard to the elimination of the costs for people living outside of the City Limits. It was her suggestion that action on this Resolution be postponed until they were able to discuss this with the Sexton at the Cemetery. (PRELIMINARY AND FINAL PLAT OF DEIDE ACRES) Mrs. Robison presented this Plat to the City Council. This Plat was located about a mile from the City Limits; a mile South of Terrace Drive -in Theater. The City was looking at it because it was within a mile of the City. The lots were very large; from two to four acres and each one of them was large enough to be subdivided. Percolation tests have been completed and forty foot half right of way has been dedicated. Jack Teraberry was present at the meeting and explained that there was 26 acres in all and they would be single family dwellings. It would be four acre lots, but it could not be broken down anymore. Mrs. Robison also stated that it was approved by the Health District and the Irrigation District. MOVED by Mallea, SECONDED by Norman that the Preliminary and Final Plat of Deide Acres be approved. MOTION CARRIED (PURCHASE OF STATE PROPERTY) Mr. Redmond, the City Engineer, stated that most of this property was visited by the City Council members on their site tour last week. Those members who made the tour were in agreement as to what properties the City should purchase. There was two parcels off Centennial Way; one adjacent to the City property on Chicago. This piece was about 2.15 Acres which was on the East side of Centennial way. The price listed by the State was $4,680.00. Book 26 Page 52 There was also a 1.4 acre piece on the opposite side of Centennial Way which does not have access, but the State was only asking $150 for it. It was the Council's consensus to purchase this piece. Also, there was the little triangle where Red Eyed Pete was buried that was lasted for $200 and a small triangle piece off Ninth Street in the off ramp which was on the other side of the Interstate. It was only about two - tenths of an acre, but they only want $150 for that piece. It was no use to�the City unless some kind of a developmental proposal was considE�red due to a business moving in the triangle across from Luby P &rk. The City could purchase it and clean it up in case it was needed later on. Altogether there was :four parcels that the Council showed interest in. There was considerable discussion regarding the properties offered by the State. The total cost was $5,180 for the four pieces of property. Councilman Raymond pointed out the necessity of keeping the weeds under control in these properties if purchased. MOVED by Mallea, SECONDED by Norman to purchase parcels 108 -A and 108 -B in the amount of $4,830 and ask the State to include Parcels #62 and ##86. MOTION CARRIED (ENCROACHMENT PERMIT FOR DAIRYMENS) The following letter was addressed to the City Council from Dick Cooper, the Plant Engineer for Dairymens: Dairymen's Creamery Association is requesting an amendment to our encroachment agreement. It has become necessary for us to add additional storage for the incoming milk. We would propose to add another 60,000 gallon silo adjacent to the one we installed in 1983. This silo would be identical to the first one and would be located between it and the caustic tank building. It has been pointed out to us that we also should include the acid tank that is located over the tunnel ramp. This tank sits on legs on top of the parapet that protects the tunnel entrance. it is self contained and somewhat portable, requiring only a large fork truck to move it. it has never been listed on the encroachment agreement. The additional silo will allow us to store more incoming milk. This will help during the daytime hours when we receive the majority oil the milk. The present situation requires a large number of trucks to park in the street waiting to unload. The additional storage will make it possible to unload these trucks more expeditiously. we are confident aht you will recognize the need for this request as DCA continues to grow and change to meet the economic challenges of the future. The City Engineer stated that they would not be using anymore of the street than they were at the present time. Dairymens informed the City when they asked for the first encroachment that they would be asking for an amendment in the future. MOVED by Raymond, SECONDED by Cowles that approval be given for the encroachment agreement as requested. MOTION CARRIED (REQUEST FOR SECURITY TRAILER) The Mayor called on Mrs. Robison, the Planning and Zoning Director, to present this item on the Agenda. Mrs. Robison informed the City Council that a request was submitted by Larry Book 26 Page 53 Ball of Mack's Fruit Stand on Cleveland Boulevard for a Security Trailer. They have been having some problems with security out there. The trailer would be placed behind the store, be hooked into the septic system for the store. There was a letter from the Southwest Health District stating that this would be all right. Also, Mr. Ball brought in a petition signed by eight neighboring businesses stating that the trailer would be not only beneficial to Mack, but would be to them as well. There would be a fifty dollars annual fee for the Security Trailer License. Mr. Ball spoke to the Council briefly on the security problems they were having at the fruit stand. It was then MOVED by Mallea, SECONDED by Cowles that approval be given for the Security Trailer as requested. MOTION CARRIED (COMMITTEE REPORTS) Councilwoman Mallea reported that the site inspection last Friday was very rewarding for all members of the City Council. She further said that she would like to commend all of the Superintendents, especially the Shops. Councilwoman Mallea also stated that she attended the meeting with regard to the Comp Time and the use of City vehicles by the Departments. The plans for the Open House on April 26th were progressing and any ideas would be appreciated. She also reminded the City Council that the next Regular Meeting would be on Monday, April 1st. Councilman Carter said that he received a .memo from the Police Chief about a Civil and Vicarious Seminar that was being held in April. One was to be in Lewiston and the other in Twin Falls. It was a very indepth Seminar. On April llth, the Idaho Division of Aeronautics was having a Seminar on Maintenance Mangement for Airports. The City was allowed to send one person to this Seminar. The fee was $25.00. The Mayor stated that he would like to have the City Engineer attend this meeting. Councilman Norman stated that he would like to commend the City Engineer for the site inspection tour. Councilman Raymond said that he had one application for a hardship discount on sanitary service charge. He looked into the request and felt that it was warranted. MOVED by Raymond, SECONDED by Carter that approval be given for this request. MOTION CARRIED Councilman Raymond also said that he would like to refer again to the discussion on Hillcrest and the project the State Highway had with regard to the access road to EIighway 20 -26 off Florida. if this was a traffic hazard that was created by the State of Idaho Highway Department, it would seem to him that it was their problem to correct. He would like to have the Police Chief document whatever problems there was up there and present some ideas as to how it could be corrected. This was discussed by the Council and pointed out that the drivers coming South on Florida were exceeding the speed limit. Val Feller replaced the fence many times due to the drivers not making the curve because of excessive speed. Mr. Redmond suggested putting a stop intersection at Hillcrest and Florida, Councilman Cowles commented that the Fire Department requested that no one park in the parking space between the Fire Department and City Hall. It was difficult for the emergency vehicles to proceed on a call when cars were parked there. (MAYOR'S COMMENTS) Book 26 Page 54 The Mayor read the following letter: I wanted to write and let you know how very much one of your employees was appreciated. Vinton Howell, Foreman at Canyon Hill Cemetery, went beyond the call of duty as an employee by helping us to select a burial site for my Mother on Monday morning, March 11th at 8:00 a.m. Vinton did much checking and made us feel we were the only people he would assist that day. He was very kind and concerned to fill our wishes. The City of Caldwell is very fortunate to have an employee like Vinton Howell. /s/ Barbara and Jess Haines The Mayor also informed the City Council that the Building Inspector has drafted a form for people who complain about neighbors having junk around their property. The letter to inform them of the complaint will also suggest that they clean up the junk in time for the spring clean up time in the month of April. There being no further business, the Meeting was adjourned at 1:50 P.M.
