THE West linsof said Northeast Quarter (NE4) of the Southwest Quarter (SATs) a distance of 300 feet to the
real point of beginning and containing 4.14 acres, more or less.
A Yea and Nay votes etas had thereon with the following results: "Yea": Mason, Claisyer, Burrell,r
Myers, Fenrich and Harding. "Nay ": None. Absent and not voting: None.
Thereupon the Acting Mayor declared the motion carried and the resolution duly adopted.

Moved by Harding, seconded by Burrell that the City Engineer be instructed to issue building
permits without charge for repairs on existing structures up to $500.00 and on now construction up to
rw300.00.
Upon Roll Call it appeared the motion was unanimously carried.
There being no further business to come before the Council, it was moved by Glaiayer, seconded'
by Fenrich that the Council adjourn. Motion carried.

We, the undersigned Acting Moor and members of the City Council of the City of Caldwell, Idaho,
do hereby acknowledge notice of a special meeting of said City Council to be held at the Council
Chambers in the City Hall in theCity of Caldwell, Idaho, at the hour of 8 :00 P. M. on the 23rd, day of
Yareh, 1949, for the transacting of all business in connection with the foil rr.ing o ct: Consideration

Upon Roll Call the following Councilman answered present: Teo J, Mason, Wm Glaisyer, L. E. Burrell
John Byers, Dale Fenrich and Bryan Harding.
The Acting Mayor informed the Council the meeting was called to take up the matter of the
renewal of the Airport Contract.
Representatives of the Western .Aircraft Corporation were present and the matter was thoroughly
discussed.
Thereupon the following Resolution was presented to the Actin; Mayor and Council by Councilman
Myers who moved the adoption thereof which motion was seennded by Councilman Burrell.
RESOLUTION
By Councilman Myers.
WHEREAS, oe lay 1, 1946 the City of Caldwell, as lessor, leased to the 'Western Aircraft Corporation,
a corporation organized and existing under the laws of the State of Idaho, by written lease, certain portions'
of the Caldwell Vunicipal Airport with certain buildings thereon for a period of fifteen years, subject how—
ever to certain covenants and conditions pertaining to rent and improvements of said airport, one of which
was that the lessee would within a period of three years from and after the date of said lease agreement,
I construct upon the leased premises not less than ten additional hangers for storage of aircraft; and
WHEREAS, the 'Restern Aircraft Corporation has not constureted the ten hangers as agreed by them
in said lease; and
— WHEREAS, on May 1, 1949 the three year period will expire; and
WHEREAS, the representatives of the Western Aircraft Corporation have advised the city council
that they do not intend to erect said hangers,
�I NOW THEREFORE, Be it resolved by the Acting Mayor and Council of the City of Caldwell that in

the event the Western Aircraft Corporation does not comply with the lease of May 1, 1946 of the Caldwell
Municipal Airport as above, that said lease shall be cancelled as of May 1, 1949 and the City Attorney Ie
instructed by proper notice to notify the appropriate officers of said corporation to give up possession
under the terms of the lease.

M1HEAEAS the actual ditches.of the Caldwell Municipal Irrigation System in certain small particularo,,
l and the actual lands being served by the Caldwell Municipal Irrigation System vary in several small parti—
culars with the boundaries as contained in R No 4, passed by the Council on the 5th day of May,
1941 andapproved by the Mayor on that same day; and I

land, which land is not located within the Pioneer Irrigation District and has Ao decreed water rights and
WHEREAS, a well for irrigation water has been dug and an underground system established; and
WHEREAS, it is desired that this system be made part of the Caldwell Municipal Irrigation System,
