Thereupon the matter of the canvass of the election returns for the Special municipal Bond Election, held in the City of Caldwell on the 11th day of March, 1947, came on for consideration. The Clerk then presented to the council the returns of the election and all other pertinent data._ The City Council thereupon proceeded to canvass the results of said election and to incorporate their findings and determination into the form of the following resolution, which was introduced in written form by Councilman Sloop and pursuant to motion made by Councilman Sloop and seconded by Councilman Olesen , was adopted by the following vote: Aaret R. Burrell, J, Randall Sloop Nayt None Absent and not voting: None The resolution was thereupon signed by the Wayor, attested by the City Clerk, was ordered recorded, and is as follows: A RESOLUTION CANVASSING THE RESULTS OF AN ELECTION HELD IN THE CITY OF CAL777r9LL ON 11ARCH 11, 1947, I ON THE AUTNORIZATTOY OF WE B0I3D ISSUE OF SAID CITY ART DETMI INING THE RESULTS OF SAID BLEGTION, ^1HEREASj_ On January 27, 1947, the City Counci l of the City of Caldwell adopted Ordinance Number 692 calling an election to be hZd said city on March 11, 194b for the purpose of sub- witting to the qualified electors of the city who are taxpayers thereof, the proposition hereinafter set_ ont; and WIT -REAS, Pn January 27, 1947, the City Council of the City of Caldwell adopted Ordinance Number 692 calling an election to be held in said city on Larch 11 1947) for the purpose of submit- ting to the qualified electors of the City who are taxpayers thereof, the proposition hereinafter set out; and W9?REAS said election has been duly held pursuant to the provisions of said Ordinance and to the provisions of the Constitution and Laws of Idaho, and the results thereof have been canvassed by the City Council, and a complete investigation has been made by the council as to the manner in which said election was held and as to the regularity thereof; NOW, THEREFORE, BE IT RESOLVED By the Mayor and Council of the City of Caldwell, Canyon County, Idaho, as followst Section 1 . That a special election was held in the City of Caldwell on March 11, 1947 at which election there was submitted to the qualified electors of said city who are taxpayers there- of, the following proposition: Shall the City of Caldwell, Idaho, issue w sell its negotiable coupon bonds to the amount of 4100,000,00, for the purpose of providing funds with which to construct and equip a fire station building and acquire fire fighting equip - ment, as more fully provided in Ordinance Number 692, adopted on January 27, 19477 Section 2. That notice of the calling of said election was duly and legally given by the publication of an appropriate notice in the Caldwell Nevis- Tribune, a newspaper printed, published and having general circulation in the City of Caldwell, on January 31, 1947, February 1, 1947; February 3 to 8, inclusive] February 10 to 15, inclusive; February 17 to 22, inclusive; February 24 to 28, inclusive; March 1; March 3 to 8, inclusive, in 1947, for a total of thirty -three pub - lications, which publications constituted every issue of said newspaper published from January 31, 1947 to Larch 8, 1947, inclusive. Section 3. Section 5. That the ballot used at said election wes in the form prescribed by law and by said Ordinance Number 692. Section 6. That the City Clerk is hereby instructed to have published in The Caldwell News - Tribune, the official newspaper of the city, for three consecutive publications at weekly intervals, with the first of such publications to be not less than twenty -one days prior to the date of .sale, a notice in substantially the following forme NOTICE OF SALE OF $25,000.00 STREET I6MVWNT BONDS OF THE CITY OF CAIMLL, IDAHO. NOTICE IS HEREBY GIVEN by the City Council of the City of Caldwell, Canyon County, Idaho, that said city intends to sell and issue its following described bonds and will receive sealed bids therefor-up to BsOO o'clock P.M., on June 2, 1947, at which hour said bids will be opened and considered at a public meeting of the council to be held in the City Hall in the City of Caldwell: $25000 Street Improvement Bonds, falling due $1,000 in each of the years 1949 to 1951 inclusive, and $62,000 in each of the years 1952 to 1962, inclusive. The bonds in each series are dated June 2, 1947, are in denominations of $1,000, fall due on June 1 of the indicated years, bear interest until paid, payable semi- annually on June 1 and December 1 of each year at such rate or rates not greater than two per cent per annum as may be determined at the time of sale, are numbered from 1 upward, are non - optional are payable in lawful money of the United States at the office of the City Treasurer in Caldwell, Idaho, or at the option of the holder at The First National Bank of Caldwell in the City of Caldwell, and are full general obligations of the city, payable from taxes to be levied without limitation as to rate or amount. The bids submitted shall specify (a) the lowest rate of interest and premium, if any, above par, at which the bidder will purchase such bonds, or (b) the lowest rate of interest at which the bidder will purchase such bonds at par, and each bidder (except the , State of Idaho) must accompany his bid with a certified check made payable to the City of Caldwell in the amount of rive per cent of the amount of the %bi.d, or by a cash deposit in like amount, which check or deposit will be returned to the bidder if his bid be not accepted. The check or deposit of the successful bidder will be forfeited to the city if the bidder shall fail, neglect or refuse to accept the bonds and to complete and pay therefor in accordance with the terms of his bid within thirty days following its acceptance. Bids will be separately considered for each of the three issues and the bonds of no series will be sold at less than par and accrued interest, The right is reserved to reject any and all bide.
