IDAHO MAR. litn. 1919. COUNCIL met in regular session as per adjournment of March A). with Mayor Fred L Lilly presiding. Upon thm roll being called the following Councilmen were found present: Jos Dickens, Amos J Miller, Fritz R Miller, Fred Mitchell, Chas Sanberg and 7 Grant Ward. The Clerk presented to the Council the affidavits of publication of the Ordinance of Intention tp create Local Street Improvement District No 2 and Local Street Improvement District No 3, which affidavits were and are in wprds and figures as follows, to wit: AFFIDAVIT of PUBLICATION STATE OF IDAHO, ) SS. County of Canyon.) V H Harnett being duly sworn, deposes and says that he is foreman Of the CALDWELL PRINTING COMPANY, publishers of the CALDWELL TRIBUNE, a weekly newspaper published at Caldwell, Idaho; that the said paper is in general circulation in the County aforesaid, and has been for a perbod of one year proceeding first public of this advertisement, a copy of which is attached hereto, was published in the regula edition of said Caldwell Ttibune 2 consecutive weeks, beginning with the issue of March 9, 1919, and ending with the issue of March 14th. 1919 (signed) W H Barnett Subscribed and Sworn to before me this 14th. day of March 1919. Idaho. ! 1 31 J / V J A �I Upon motion duly made and seconded and unanimously carried, the Clerk was instruoted to and did then and there insert the said affidavit as part of the minutes of this meeting. , The roupon the Mayor announced that this was the time set for the consideration of protests filed against the creation of Loaeal strait Improvement Districts Nos. 2 and 3, and the making of the proposed improv- ements therein. The Clerk then stated that protests had been filed against the creation of Local Street Improvement District Not and the makimg of the proposed improvements therein, by the following named persons to wit: P E Engl and Boise Valley Traction Company, qnd presented said I W protests to the Council. Said protests were then given careful consideration by the Council and all persons present desiring to be heard were given a hearing? Thereupon Councilman Mitchell moved and Councilman Dickens seconded the adoption of the following resolution, to wit: Whereas heretofore and on, to wit: the third day of March A. D. 1919, Ordinance No 309.entitled: "An Ordinance declaring the intention of the City 11f Caldwell, Idaho, to create and establish Local Street ImprovementDistriet Ido 2 of the City of Caldwell, Idaho, for the purpose ofoonstructing suitable pavement0 curbs and gutters therein, stating the streets and allays upon which eaid Improve- ment is to be made,and the points between which said improvement is to be made the general character of said improvements, and the estimatedoost of the same," and that such cost, except the oost,of such improvementsin the space formed by the function of two or mores•trests, or wherin one main street terminates In or orossesanother main street, and also all street eroseinge,and orose walks is to be assessed againat the property abutting,fronting, contiguous or trib- utary( and included in the assessment district hereinprovided) on such streets to be improvsd:and fixing the time within which protests against said Improve- ments may be filedin the office of the City Clerk; declaring the intention of the Mayor and City Counoil to provide for the payment of the cost and expense of such improvements by issueing impraiement bonds of thedistriot; repealing all ordinances, resolutions and orders, or parts thereof in conflict herewith; and declaring an emergency." was du passed and approved declaring the intention of this Councilto create Local Street Improvement District No 2 in the City 8f Caldwell, Idaho,for the construction of pavement and cement ourbeand gutters therein; and WHERUS, heretofore an4 on towit: the 3rd day of Match, A. D. 1919, Ordinanca No 810, entitled: "An Ordinance declaring the intention of the City of Caldwell, Idaho, to create and eatablish Local Street Improvement District No 3 of the City of Caldwell, Idaho, for the purpose of constructing suitable pavement, warbs and gutters therein: stating the streets and allays upon which said Improve- ment is to be made, and the points between which said improvement is to bemade, the general character of said proposed improvements, and theestimated cost of the same; and that such coat, except the cost ofsuch improvements in the space formed by the function of two or morestraets, or wherein one main street terminates in or crosses anothermain street,and also all street orossingsand cross walks, is to be assessed against the property abutting , fronting, contiguous ortributary ( and InclUed in the assessment district herein provided) on such streets to be improved • and fixing the time within which protests against said proposed improvements W be filed in the office of the City Clerk; declaring the Intention of the Mayor and City Council to provide for the payment of the cost and expeneeof such improvement b; issueing Improvement hondsof the District• repealing all ordinances, resolutions and orders, or parts thereof in conflict herewith, and declaring an emergency. " and :71E2EA8, said Ordinance No 309 and Said Ordinance No 310 were both duly published as provided by law, in two consecutive issues of the Caldwell Tribune ", the official newspaper of said City, published and of general circulation therein,before the time fixed in each of said ordinances for the filingg of protests against Said proposed improvements by the owners of lands and lots abutting on said improvements, and includedin each of said assessments districts; and 327 WHERRAS, original publishers affidavits of the publication of said ordinance No 309 and said ordinance No 310 as aforesaid, have been filed with the City Clerk; and M3ZREAS all protests against the creation of said Local Streeat Improvement District No 2 and the proposed improvement to bemade therein have been duly considered by the Council; and WHEREAS no protests have been filed against the creation of said Local Street Improvement District No 3, or the proposed improvements to be made therein;; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO: 1. That said protests and each of them be and hereby are over - ruled. and that the Mayor and City Council proceed with the work of establishing and creating Local Street Improvement DistrivtNo 2 and Local Street Improvement District No 3. in the City of Caldwell, Idaho, and the construction of the pavement, curbs and gutters therein, as provided by Ordinances No 309, and 310 respectively. both passed and approved March 3, A D 1919. The Mayor put the question upon the motion for adoption of the foregoing resolution, and on roll call the vote was asfollows; Those Voting "Yes" Councilmen Joe Dickens. Amos J Miller. Fritz R Miller, Fred Mitchell, Chas Sanberg, W Grant Hard. Those Voting 'No" None. The Mayor declared said resolution had duly passed by a unanimous vote of all the city councilmen, and directed the Clerk to record the same upon the journal of proceedings of the Council, as part of the minutes of this meeting, and thereupon the Mayor and clerk in open session of the Council duly signed and approved said resolution.
