Page 66 The Mayor requested that one of the Roy Scouts in attendance at the Meetinq lead the City Council and the audience in the Pledge of Allegiance to the Flag. The Roll of the City Council was called with the following members present: Raymond, L. Carter, J. Carter, Mallea, Betts, and Cowles.• Absent: name. (APPROVAL OF THE MINUTES) It was MOVED by Cowles, SECONDED by Mall_ea that the minutes of the Regular. City Council_ Meeting of lurch 1, 19G3, and the minutes of the Regular City Council Meet.inr7 of Marc11 2, 1983, be as written. MOTION CARRIED (AUDIENCE PAR.TICIrATION) The Mayor asked if there was anyone from the audience who cared to brinq anything before the City Council that was not on the prepared Agenda. Mr. Ted Vance, was recogni.�_ and seated that he woul..d like to call. the Council's attention to the railroad crossing on 5th Street which was hecom:i.ng intolerable. Tie would appreciate it .i if someone could visit with the Union Pacific to see -if it could be repaired. The Mayor informed Mr. Vance that the City Enclineer di.cl turn this complaint into the Union Pacific and they were very slow. It Baas discussed at the City Council. Meeting several. weeks ago and as a result, Mr. Redmond slid contact them. The Mayor then stated that he would like to recognise Scout Troop'_._,. Ado. 228 that was present at the City Council Meeting, Mr. bii_l.ler , the Scout Master was also recoq_nixed and explained that their group was from the United methodist Church. The Mayor requested that each of the Scouts introduce themselves to the City Council Several of the Scouts addressed the Mayor and City Council with questions with regard to the City of Caldwell. The Ouartet then sang several songs for the members of the City Council, the Mayor and audience and gave a brief explanation of their groux, and invited all to come to their annual show. Councilwoman 1 reported that the Committee did review these bids an d determined that the low 1:;3d was from Municipal Pi pe.. amine Supply of Raker, Oregon. The bid for wise Avenue was in the amount of $6,322.71; and the .revised bid that was re -added for Happy Day Ford was $35,976.34. The latter bid was only off a small amount. T he topic of discussion was the issue of tout cl.aisns, it was t unani r.-ous conclusion that the Idaho Code should be changed to reduce the time from filing of a tort claim to iil ing of lawsuit against municipalities, The present two years seems to us to be entirely 'coo long. The exposure for c'lhar,r personnel and the ability of the witnesses to recall_ is beyond reality. We 'therefore petition you to begin legislation to _educe the statute of limitation from two Years to six Pontlhs. Snip, we are addressing this item to you because of your interest in municipal government and, of course, your intimate knowledge of the profession and your sense of fair , -1ay, The Mayor stated, that with Council approval, he :could notify Yr. Smyser that the City of Caldwell was in agree rent to this action. City Council members stated their approval. (LETTER FROL -i G -L WT vG ) The Mayor stated that he received a copy of a letter written by Captain Wing to the Police Chief with regard to County Prisoner Days. Captain taint indicated in the letter that he checked the County Prisoner report and found nu arous ;problems. one lady was cited by a Caldwell Police. Officer for an improper turn. She stated that s'ne was leaving town that eve ninq and she was taken to the Canyon County Sheriff's office to host bond. She was in the Sheriff's Dffice not to exceed ten minutes. Captain Wing state6 that in conversation with the jailer he stated that tb,eir jail policy was that anyone who was brought in to post bond Went throu ,71t Book 24 Page 68 the entire booking process before they were released. lip further stated that even if - the County officers brought the person in, that this would happen as it was jail procedure. He also stated that the only way it could be eliminated Was for the officer to request , a jailer to meet him outside the building with a receipt boolt and to take bond outside. IF the prisoner got inside the buil(5inq, he would go through the process. The Mayor informed the City Council that he wanted t1 to be aware of thi.s and that some action was taken by the Police Department to alleviate this. if the city arrested a person that was not a City prisoner, the City would have to pay for them if the City booked them. From now on the Police Department was going to call the County and tell them to pick the prisoner ul, (REPORT ON THE LANDFILL COST) The Mayor stated that he received a letter from the County Commissioners with regard to the landfill- cost and the City of Caldwell's cleanuj, which he read as follows: The Commissioners have read and discussed your March 8, 1.983 letter concerning the April cleanup of the City of Caldwell. our decision is that the County will bill the City for the loads cc)yqinq into the solid waste site. V%ka will then ask you - to review the billing and determine how many loads were for the City of Caldwell cleanup campaign. The County then will remove those charges from the account, for one - truck, Lip to 15 loads, picl<e-,l up during the month of April. i " 1. We trust this will solve your problem and meet with your annroval. The Council stated that they did appreciate their support on Lbi.s, but the regular charge was going to be very difficult. (13RACKrTT LETTER) The Mayor also read the following letter. addressed to - the city from Robert D. DracketL: We had your building Inspector, Mr. Dennis Davis, recently perform the final inspection on our dwelling at 2426 North Montana It was very refreshing to watch a man or this calibre perform his duties. Not only was he courteous, but businesslike, thorough and very professional. In - this day of government waste and red tape, it is a pleasure to 1 served by this rRan. Tie is the kind of civil employee that every City hopes for, but seldom finds. Again, thanks. (DISCUSSION V-71TH UGART) TO RrSOLAJTION TO SET SPIPFJ) LIMIT ALONG t The Mayor called on the City Engineer, Mr. Redmond, to discuss the proposed Resolution to set a speed limit along the Miracle Mile. Mr. Redmond stated that there was a request from the Miracle Nlile Merchants to have the speed limit reduced :from 45 miles per hour to 35 miles per hour in their area. Initially, when loolkinc , r through the Citv Code, it indicated that a City by pass-iniq a Resolution could adopt a speed limit less than what the State indicated. Upon further research, it was found that the State Laws have charaged, and this was specifically addressed which did become effective the Ist of march of this year. The State Transportation Poard has the ultirr,ate authority on State Hirfhways and the City cannot. (90 anything to supersede this. However, the City can perform a study of the speed limits for that area and forward whatever information they can to prove to the State that the speed should be .reducer. Thera a Resolution could be adopted to request the reduced speed limit if the study indicates that it was warranted. He had LalRed with Dan McComb, who was going to come over to Caldwell to discuss the traffic light study at Cleveland and Linden and the City planned to discuss the speed limit in t'he Miracle Mile area at the same time. Mr. Redmond further stated that it % not possible to Book 24 Page 69 proceed with the .Resolution at this time, but they would begin the study with the hope that the Resolution could be prepared at a later time. (PRESENTATION OF EASEMENTS) The City Engineer presented two easements for acceptance by the City council one easement was to the City from F. Craig and Eleanor M. Barnett and the other from Calvin F. and Loraine H. Burns. Both easements were for the same thing, storm clrain easements on Taslh and Arlington for a short distance as there was a section of storm drain that was unc'er size. The City would relieve this by putting a short section of pipe through their. yards. MOVED by Raymond, SECONDED by L. Carter that the City accept the two easements as presented by the City Engineer and that the City Clerk W instructed to have them recorded. MOTION, CARRIFI (CATERINJG PEPMITS) The City Clerk presented two Catering Pern for approval. Both were to be catered by the Corral. for the ^agles. One for the niqlnt of the IRth, of March for a Benefit Dance and the otter on the 1.9th of March for a membership dance. The Chief of Police has - his approval and the fee was paid to the Office of -, the City Clerk. NOVEL by L. Carter, SECONDED by Cowles that approval be given for the Catering Permits as presented. IMOT!01 CARRTRF� (FIMSICIAL REPCHM Counci- 'Oallea reported, that the Finance Committee reviewed the Requests for Payment. on the statement submitted to the City Council members, there was accounts payable issued in the amount of $207,906.59. Of this, the Finance Committee has held two Requests for Payment for further investigation-, one in the amount of $627.00 and one in the amount of 5150.00 loavinq Requests for Payment in the amount of $207,129-59. In addition, there was a Payroll of $19R,354.84 of which $41,455.59 was Fringe Renefits. The total.. amount to be issued was $405,484.43. miovEr, By m SECONDED by J. Carter that the checks be issued and the Requests for Payment be filed in the Office of the City Clerk. tIOTION CARRIFD (COMMITTEE REPORTS) Councilwoman Mallea reported that she spoke with the City Attorney today and he has asked that the City Council give nolitical supt�ort to the three cent gas tax. m.-r. Smyser said this would amount to $233,000 for Caldwell's streets. Councilman L. Carter asked the �mayor and City Council if they had noted that Keith Stanwood was selected Pro of the Year. Council - members and the Mayor all. stated that they were not aware of this. Councilwoman mallea asked that Councilman Carter offer Keith the Council 's corgtratulations. Councilman Cowles stated that the Parks Departm.ent was doing their annual tree spraying. The Historical Commission also had their. Centennial posters on sale. Councilman Raymond questioned as to whether the Council members were aware of a Policeman's Association F=6 Raiser. The Council members discussed this briefly and stated that they were glad to know of this in case they were approached. (FX7CUTTV1 SESSIOeT CALLRI The Mayor stated -that he would request a motion for the City Council to convene into an Executive Session pursuant to Idaho Code, Section 67-2343, for the purpose of discussing personnel matters. MOVED by Ravmond, Sr- by Betts that 'the City Cnuncil- convene, into an Jxecutive Session as stated For the purpose of discussing personnel matters. Roll call vote. Those voting yes: Raymond, I.- Carter, J. Carter, Fallea, Betts, and Cowles. Those voting no: none. Absent and not VoLinq: none. MOTION CARRIED There being no fortiier. business, the Regular City Council meeting was adjourned at R:lO p.m., and the City Council. convened into an. Executive Session.
