CALL AND ACKNOWLEDGMENT OF NOTICE
We, the undersigned Mayor and Members of the City Council of the City of Caldwell, Idaho, do each
hereby acknowledge notice of a special meeting of the said City Council to be held at the Council Chambers
in the City Hall in the City of Caldwell, Idaho at the hour of 5:00 o'clock P. M. on the 11th day of March,
1958 for the transaction of all business in connection with the following object: Second reading of Bill
Number 14, , which object was presented to each of the undersigned in writing.

Upon Roll Call the following Councilmen answered presents E. L. Vassar, Emile Shorb, L. P.
Eldredge and Leland Finley. Absent: Fran Blomquist and Max Luby.
The Mayor informed the Council this was the time set for thesecond reading of Bill No. 14. The
Bill was read by title.
Council Vassar recommended the following be added to Section Six, paragraph "B ": Nothing herein
shall be construed to prohibit the use of outdoor fireplaces, barbecue pits, or grills in preparing food„
or for recreational purnoses.
This was unanimously approved by the "ouncil and the City Attorney was instructed to include this
in Bill No 14.
Mr. I. R. Nicol was present and discussed garbage and trash pickups. Mr. Nicol recommended the
; followings Large limbs and bulky items be tied in bundles not to exceed four of five feet and certain days
be set for trash pickups. Garbage not to be nicked up the same day as trash. Pickup only materials that
can be handled by fork or by hand. Number of pickups per week and price to be set at the beginning of each
fiscal year. Set maximum weight of filled barrels in commercial area. Pickups outside of City limits shoo:

be billed by contractor if they are not /water users.
The following comments from the Mayor and Council:
Mayor Simmermant Mr. Nicol would you take the contract on a n 80% basis. Mr. Nicol: I would take
the contract on an 80% basis but would like a five year contract.

Councilman Vassar: Contractor should nick up everything. Rates should be set before the 1st
of May each year. Some provision mast be made for pickups that fall on holidays.

dge. I feel it would be better for shrub and rose trimmings and bulky items to be
stacked in piles instead of tied or put in boxes. Who is to handle commercial pickups. Mayor: This would j
be up to the Contractor and Inspector.
Councilman Finley: I think it would be up to thecontractor to decide if he would pick up trash
without being tied in bundles.
Councilman Shorb: In Pocatello a card giving rates for garbage is sent to each new customer.
The Inspector and Contractor should work out a schedule of charges and present to Council and recommend
the size of barrels to be used in the commercial district.
Councilman Luby: A schedule should be made up and each householder should receive one. A definit
plan s::ould be worked out for holidays.
City Engineer: Schedules should be the most important thing in the brochure. Is the Council to
act as a board of arbitration. Mayor: The Council will act as board of arbitration and special meetings

will be called for that purpose.
City Engineer: If pickup day falls on holiday and garbage is not picked up the next day there

A general discussion was held on points brought up by those present.
Thereupon it was moved by Councilman Finley, seconded by Councilman ldgssa2', contract be given to
Mr. I. R. Nicol on an. d0$ basis, and the •:ayor and Clerk be authorized to execute the same on behalf of the
City.

The following is a report made by the City Engineers 6�
At the Council meeting on March 3, 1958 1 was requested to provide the Council with information
in which to clarify the request of Mr. Ssm Blakely inregard to the assessment of Local lmp'revement District
h42. At the Council meeting when the Council authorized the advertisement for the sale of the bonds for L. !! 1
I. D. 42, 1 brought up Mr. Blakely's request again. It was the consensus of opinion of the Attorney -
Engineer and douneil at that time that the request to have the assessment distributed equally over all
properties in the district be denied for the following reasons.
i
1. The assessment roll '.ad been duly submitted, accepted and advertised for the period
required -by law for the hearing of protests. Since there were no protests at the meeting
set aside for them, the Council authorized that the assessments be made and the procedure
for the sale of the bonds be carried out.
2. Mr. Blakely was requested by the Engineer to submit a letter stating his reasons why
the assessmeht should be changed. This he agreed to do but up until the time of the meet-
ing at such the advertisement for the sale of bonds was authorized, no such letter had
been received.
3. The assessments made in L. I. D. 42 were in conformance with the method by which assess-
ments wee made in other prorated local improvement districts assessed at the same time.
k. The Engineer had checked with the Councilman in charge of streets and the Mayor at the
time the district was bormed and neither expressed a recollection of the assessment being
made equally over the district, both, however, didexpress that it was their understanding that
the oiling would be prorated half way back into the block. At the time L. I. D. q L22 was
formed, this method of assessment had not be commonly uesed, therefore, was oneof -the first
prorated districts.
5. A check of the minutes of the meetings at which the petitionaas presented or the re-
solution of intention was passed oP when the Ordinance forming the district was passed, did
not reveal any discussion or action which set forth the method of assessment.

Councilman Finley reported he found the tractor, offered for sale by War Surplus at Portland,
in excellent condition.
Councilmen Vassar and Finley recommended Jackson & Co, for the 1957 -1958 Audit.
Noaction was taken at this time.
Mov,ad by Shorb, seconded by Finley the Mayor and City Engineer be authorized to attend the North -
st Reginal Highway Conference to be held in Portland, Oregen March 24th and 25th.

The City Attorney was instructed to write the Recreation Board and clarify the disbursement of
Recreation Funds.

Proposed routes for the Interstate Highway were discussed,
The following letter from the Chamber of Commerce was ordered spread on the Minutes : -
Honorable Mayor and Council
City of Caldwell
Sir:
Relative to the use of Highway 00 and RO- _'0-26 as it passes through
the Northerly portion of Caldwell, as a part of the proposed Freeway
or Interstate Highway System.
The Chawber.of Commerce, Road and Streets Committee wishes to re-
commend to the Mayor and the Council, that this Freeway location be
endorsed, and a resolution drawn favoring same, with the provision
that suitable access to that portion of the City lying north of the
Hi -way be provided.
It is also recommended that, as the new Freeway, as proposed would
cause Farm to Market traffic from the west and the north to travel
on on the Freeway a short distance, consideration should be given
to a new road from the vicinity of Desert Junction to an inter-
, section of the Wilder Hi -way near Airport and Industrial area.
