Bill No. 37, by Farrar, entitlted, "An Ordinance to provide for the issuing and sellidg of municipal coupon bonds of the City of Caldwell, Idaho, in the sum of Fifty Thousand Dollars, for the purpose of providing for the construction and maintenance of necessary additional water works for said city and suppluing the same with water, and to provide for the rayment thereon ", was read the first time. A motion was made by Farrar that the rules be suspended and the readings on three separate days be dispensed with and that Bi.. No. Z? be read the second time by title and the third time in full and placed on its final passage. The roll being called on the motion, the vote resulted: Ayes -- Clark, Farrar, Gartin, Harris, Paynter - -5. Nays - -0. Absent-- Deyers So the motion prevailed. Bill No. 37 read second time by title. Council met in regular session with Alayor Gowen presiding and 0ouncilmen Elmer A. Clark, R. Farrar,'J. G. Gartin, Jas. Barrie, I. N. Poynter, Present; C. J. Shorb, 91erk, when the following business was transacted: Mr. Armstrong, representing the Rocky Mountain Bell Telephone Co., addressed the Council on the matter of putting the telephone wires under ground. J. 0. Andrews made verbal complaint that there was an overcharge for his water during, January and rebruary, 1910. A motion was made by Clark thd.that matter of rebates be referred to adjust and present'claims. The motion was withdrawn: The claims for water rebapes were then referred by the Mayor to the Water Rpmmittee and Superintendent of lgater Works for adjustment. Voted', on motion of C &drk, that the :patter of procuring fire escapee for the City Hall be again referred to the Mayor. The following letter from the Warren Construction Company was reads Caldwell, Idaho, March 7, 1910. The Honorable Mayor and City Council of Caldwell, Idaho. Gentlemen: Referring to conversation the writer had with the Mayor regarding the change In. the conditions of excavation and fill on tan streets included in our contracp with the City of Caldwell for paving district no.l, said change being due to the recent flood and resulting washouts, would say that we have taken the matter up with our officers and they have authorized me to agree to the following, realizing that the City has already been damaged to a large extent by the flood, this proposition being made in the spirit of compromise and fair play. We will accept the conditions as they exist in the district, and make the necessary cuts and rills throughout the district so as to bring the finished surface of the sub -grade of the street pavement to the sea ^t contour of the finished sub- grade. We will make these fills in layers nbt to excedd nine inches, thoroughly. rolling each layer with a roller weighing ten tons, thus providing a solid nub -base, and assuring permanent satisfactory results. We will do this work without any charge for dame over and above the Engineers original estimated cost of the excavation in the district. Said estimate being 1CS000,29 cubie yards. Under our contract with the City we are not responsible for "Acts of God" which have caused these washouts and believe we could maintain a claim for extra work to cover same, but we are not disposed to do do. We are making this offer to the City of Caldwell in the same spirit in which we last year offered to the City of Nampa to stand the expense of the Nampa fire, where the same damaged the pavement, and if your Honorable body sees fit to accept this proposition,iwe will consider the matter settled, and will accept in total payment for all exdavation and fill, payment on the Engineer's original estimate as above set forth, without any increase in the u unit contract price for excavation and fill. This proposition does mot.include the digging out and re- tamping, with suitable material, all soft and spongy material, payment for which is provided for in the specifications. Sidewalk resolution No. 41 by Farrar, "providing for the construction of a sidewalk according to Plan 1 of Ordinance No. 148 of the City of Caldwell, Idaho, along certain Streets and avenues and in front of certain lots and blocks in said city, and providing for the payment of such construction by an assessment levied and assessed against the property fronting and abutting on said sidewalk" was read. Bill No. 38, by Farrar, entitled" An Ordinance declaring the intention of the City of Caldwell to establish within the limits of the City of Caldwell, a Local Improvement District to be called Local Lateral Sesser Improvement District No.l, and the intention of said city to establish therein a lateral sewerage district; was read the first time. A motion was made by Farrar that the rules•be suspended and the readings on three separate days be dispensed with and that Hill No. 38 be read the second time by title and the third time in full and placed on its final passage. The roll being called on the motion, the vote resulted: Ayes -- Clark, Farrar, Gartin, Harris, Paynter - -5. Nays - -0. Absent -- Devers. So the motion prevailed. Sidewalk Resolution No. 42 by Gartin, "providing for the construction of a sidewalk according to Plan 3 of Ordinance 148 of the City of Caldwell, Idaho, along certain streets and avenues and in front of certain Iota and hlocks in said city, and providing for the payijent of such construction by an assessment levied and assedsed against the property fronting and abutting on said sidenalk," was read. The roll being called on the passage of the resolution, the vote resulted: Ayes -- Clark, Farrar, Gartin, Harris, Paynter--5. Nays - -0. Absent -- Devers. So the resolution passed. Certain sidewalk resolution ordering sidewalk along Fillmore Street was re- ferred to the City Engineer. Voted, on motion of Harris, that Council adjourn until Monday at 8 o'clock p, m., March 14, 1910. ��
