The Roll of the City Council was called with the following members present McCluskey, Williams, Hopper, and Carter. Absent: Betts and Raymond. (DISCUSSION WITH REGARD TO PERSONNEL :POLICIES) The Mayor stated that the purpose for this Special Meeting was tc discuss the Personnel Policy changes that were suggested. This item was on the Agenda at the last Regular Meeting, but action was postponed until the City Council could meet and go over the changes again to make sure that there was no misunderstandings. The Mayor then called on Councilwoman Williams to discuss these suggested changes. Councilwoman Williams stated that the proposed changes presented to the Council for consideration at the Regular Meeting were as follows: Proposed Changes to Personnel Policy: Earned Vacation: Page 4 Delete Items #2 and #8 ADD: Pull -time employees begin to accrue vacation time immediately upon employment although vacation time may not be used until the employee has successfully completed twelve months of continuous service. After one year of continuous employment, an employee who is either dismissed or who resigns will receive payment in the amount of one day's salary for each vacation day accrued under the following terms: An employee who resigns, but fails to give his supervisor a ten day written notice will forfeit payment of accrued vacation time. An employee who is dismissed for cause (i.e. not lack of work) will forfeit any claim for accrued vacation time. ADD: SEVERANCE PAY Severance pay will not be recognized unless authorized by the City Council. This authorization will be in the form of a written request from the Council President, and submitted to the Payroll Department in advance of the employee's termination date. Such notification will state the number of days, daily rate, and total amount to be paid. Assuring fair treatment of applicants and employees in all aspects of personnel administration without regard to political affiliation, race, color, creed, national origin or ancestry, sex, or religion. POSITIONS COVERED: These regulations shall apply to all positions in the City of Caldwell with the exception of the Fire and Police Departments. INTERPRETATION: The regulations are intended to cover most personnel problems and actions which will arise. Those not — specifically covered shall be interpreted by the Department Head, Mayor, and City Council. Such interpretations shall be in keeping with the intent of the resolution establishing the personnel policies and the purposes of said policies. VETERANS' PREFERENCE: Procedures concerning honorably discharged veterans of any war will conform with Title 65, Chapter 5, Idaho Code, providing that equal preference be awarded such veterans as exists under Federal Civil Service Statutes. ENFORCEMENT AND ADMINISTRATION: The responsibility and authority for the enforcement and administration of the rules and regulations set forth herein are vested in the Niayor and City Council. Councilwoman Williams then commented that there was about three things that needed to be discussed with regard to these proposed changes. The first change discussed was with regard to vacations. Councilwoman Williams stated that. since the last meeting she had prepared a revised policy dealing, with the vacations which she read to the Council as follows: No vacation will be granted for the first year of employment. Beginning with the second year of employment, an employee will be granted ten working days each calendar year. Amount of vacation granted: From the beginning of the second year through the twelfth year - ten working days. From the beginning of the thirteenth year through the twentieth year - fifteen working days. From the beginning of the twenty -first year and thereafter-- twenty working days. Effective date of this policy on vacations will be retroactive to January 1, 1980. Any unused vacation recognized after the date of this policy will be the one week carried over from 1979. Councilman Carter inquired as to what the Policy had read in the past. Councilwoman Williams said that she felt that there has been a difference of opinion in the past couple of years and that the City has been paying accruals. She further commented that this was the time to get the Policy straightened out so that it can be understood and followed. The City Council discussed the Personnel Policies at some length. Mr. Lewis questioned as to whether you can get from date of employment anniversary to calendar year under this policy as written by Councilwoman Williams. Councilwoman Williams stated that probably to get from the anniversary date to a calendar year basis, the City will have to pay that difference. She did state that she objected to the employees having a vacation at all in the first year of employment. Book 21 Page 68 The question was raised that if they began in October that when their anniversary date came around there would only be a short time left in that year to take their vacation in order to get on a calendar year basis. It was the Mayor's suggestion that all employees revert to the calendar year after their third year of employment. Several of the suggestions made were: No vacation or pay in lieu of vacation shall be granted for the first year of employment. That after twelve continuous months of employment, ten working days will be granted. Starting with the third year of employment, only calendar year basis will be recognized for vacation purposes. After continued discussion, it was agreed that the discussed changes would be typed up, and that Mr. Lewis and Donna would get together to further analyze the problems. It would then be ` considered for approval at the next Tuesday noon meeting. It was also agreed that when the policy was approved, the Department Heads must be instructed as to how it was to be handled. The Council also discussed the policy of severance pay. The Mayor asked where severance pay was involved other than vacation pay. Councilwoman Williams stated that in several instances when an employee has left he has been given severance pay. Councilman Hopper said that he felt severance pay should only be given when a job was taken away from an employee. The other Council .membexs.seemed to be in agreement with this and that it would have to have approval before submitted. Councilwoman Williams pointed out that the portion regarding the Veterans' Preference must be added as there has been problems with this. There being no further business, the Meeting was adjourned at 4:35 p.m. APPROVED AS written.
