COUNCIL CHAMBERS
MARCH 2, 1964
8:00 P. M.
The regular monthly meeting of the City Council met in the Council Chambers of the City Hall, with
Mayor N. E. "Coley" Smith presiding.
Upon Roll Call, the following Councilmen animered presents E. L. Passer, Max Luby, James W. "Bill''
Keys, and Charles W. Carpenter. Absents V. Jay Martin and C. A. Davenport.
Waiver of License Fees on carnival - Caldwell Junior Chamber of commerce
Mayor Smith presented a letter he had received from the Junior Chamber of Commerce which read in
parts "Regarding application for waiver of permit and license fees for carnival." "The Caldwell Junior
( Chamber of Commerce proposes to sponsor a carnival in the City of Caldwell for the week of May 11, 1964 thru
May 16, 1964. The carnival involved is the Inland Hspirs Shows which operates out of Twin Falls, Idaho.
The Secretary of the Chamber of Commerce at Twin Falls gives the show excellent recommendations. As part of
the contract with this show, the Caldwell Junior Chamber of Commerce is required to pay any and all license
and permit fees to the City of Caldwell for the show to operate. For it's share of the receipts the
Caldwell Junior Chamber of Commerce will receive $10.00 per each side show engagement which would be approx-
imately 20 to 25 shows a day and will receive 20$ of the gross receipts on the rides which consists of six
to eight rides, It has been represented to us that if the show does well, we will receive approximately
$1,000.00 for our efforts. Also interested in this project is the Agricultural Commdttee of the Chamber of
Commerce which is planning some type of fund raising project to complete the new Field House at the Multi -
Purpose Stadium, so it will he usable for 4 -H shows and the like. They would like to co- ordinate any such
project with our carnival. Also interested is the Caldwell Businessmen's Association which would like to
plan some business promotion during the stay of this carnival.."
Mayor Smith stated that the City Code did not provide for reduced license fees for any of these
things and provided for waiver of fees only in conjunction with the Rodeo.
In answer to the question, City Attorney William F. Gigray, Jr. stated that he thought, since the
City Council was the body who created these ordinances in question and governs these matters, it was within
their powers to waive these things if they were of a mind to do so. It was a matter of polioy.
Mr. Harbart Andrews who was present representing the Junior Chamber of Commerce stated that he had

called the Chamber at Twin Falls, had found that they were a locally owned business and licensed in the
State of Idaho and that they have reports from where they have played in the last ten years and they were
very good people to deal with.
Councilman Vassar stated that, personally, he would be in favor of doing anything he could,
consistant with good business, to permit the Junior Chamber of Commerce to have the concession and that any
time they could get $1,000.00 into the treasury here in Caldwell to help boost the City, he was for it.
It was moved by Councilman Keys, seconded by Councilman Vassar that the City waive the license
fees for this enterprise. H vote was taken and the motion unanimously carried.
City Flnployees complimented for participation in raising funds for Armory equipment
Mayor Smith explained to the Council the Armory Committee's plan for raising funds for equipment
at the Armory through contributions from employees of one week's saving on the Federal Income Tax and said
that he had called a meeting of the city employees and had received 100$ indorsement of the idea which he
thought was terrific. He referred to a prepared chart showing the schedule of deductions and said that
actually the most money it would coat anybody, even on a $500.00 salary, was about $5.20 and that their
checks at the and of the month would still be for more take -home money that before even though they had put
a contribution into the fund.
Mayor Smith continued by saying that it was interesting that the city employees were highly enthus-
ed about it and took the lead. That they were real happy about it and thought it would help get the ball
rolling; that this idea was terrific and they had real high hopes of getting the Armory equipped. He said
that this, together with the stadium and the baseball program should begin to make it a little convention
town.
Councilman Vassar, as Council representative to the Armory Committee, stated that: "I want to say
that I want to compliment the city employees to the very utmost for taking that position. They are not only
contributing money to the Armory Fund, but they are the first ones to open the gates to invite the others in
and believe me, that is really a feather in the City's hat. I sure proud of them."
Contract with Rural Fire District approved
The next order of business taken up was consideration of the contract with the Caldwell Rural Fire
District which had been agreed to by them. Mayor Smith stated that it was the same as the previous contracts
excepting for clarification of the actual liability of the City in the way of fire protection to the rural
fire district in that in this present contract, the City was not obligated to send more than one man to a
rural fire if the manpower was not available. The term of the contract was for one year.
It was moved by Councilman Carpenter, seconded by Councilman Vassar that the contract with the
Caldwell Rural Fire District be approved and that the Mayor be authorised to execute the same. A vote was
taken and the motion unanimously carried.
Increased rates at Swim Pool discussed
Mayor Smith informed the Council that it had been suggested by the people that were in charge of
the swimming pool last year, that the Council give consideration to the raising of charges per swim in the
public swimming pool for adults only. He said that it had been 15¢ for a long time, which was probably
proper for children, but there had been no differential between adults and children and they were rapidly
reaching a point at the swimming pool where they were going to have to make some substantial investments
with one of the things necessary this year being a new chlorinator. This, he said, was not going to be the
long range curing of things because of the system of induction into the pool being wrong, the construction
was buckling badly during the winter too and they were going to be faced with new dressing rooms and other
improvements. He further stated that he knew the Council's thinking was to keep the swims cheap for the
children and that he didn't quarrel with this but he didn't think it was good business to leave the charges
for adults dawn there with those for children.
Councilman Vassar stated that he knew the receipts were falling behind the expenditures for the
last few years.
Councilman Kays suggested that other Cities might be contacted in order to determine what they
charging and no further action was taken at this time.

In answer to the question, City Attorney Wm. F. Oigray, Jr. presented a prepared renewal of lease
with the Idaho Service Company which is "Gem Motor Club" for the upstairs portion of the police building at
605 Main Street. He informed the Council that the lease was based on the same rental as the last lease with
the term of the lease being for three(3) years commencing on the 20th day of April, 1964 and ending on the
20th day of April, 1967, both inclusive. He said that the tenant was agreeable to the term of three (3)
years in view of the city's plan for the police department building.
It was moved by Councilman luby, seconded by Councilman Keys that the lease be approved and that
the Mayor and Clerk be authorized to execute the same on behalf of the City of Caldwell. A vote was called
for and the motion unanimously carried.
Delinquent garbage accounts discussed
Mayor Smith referred to the larger delinquent garbage accounts and the pending suits for collection
afterwhich he inquired of the City Attorney if he would check on them and try to expidite the closing of
those accounts.
Councilman Why suggested placing them as leins against the property when the City Attorney stated
that the question was whether or not the City could place these as a lain against the property and that he
didn't think the judication had ever been resolved; that he thought it was started but had just been handled
on the docket for a long, long time,
Mayor Smith stated that he would like to have these suits expedited and the City Attorney stated
that he would check into it.
Request for reduced fee on Season Tickets at Golf Course approved
Mayor Smith presented a written request from the Board of Controll reconmiending that people 75
years old or older be permitted to play on the nine (9) hole golf course (Purple Sage Course excluded) for
the old charge of $60.00 per year. The request stated that the group had a limited income and that apparent.
ly it was a hardship to pay $85.00 per year.
Mayor Smith informed the Council that he had had a delegation of these older persona in to see him
and that some of them had said that they didn't play over six (6) holes when they played. He further stated
that this would probably affect about fifteen (15) persons.
It was moved by Councilman Why, seconded by Councilman Carpenter that the recommendation of the
Board of Control be approved. A vote was taken and the motion unanimously carried.
As a matter of information, Mayor Smith informed the Council that the Board of Control would be
submitting a schedule of green fees at the two courses for their approval and said that he understood they
planned on requesting a reduction in green fees at the nine (9) hole course from $1.25 for nine holes and
$2.50 on week -ends to $1.00 for nine holes and $1.25 on week -ends.
Exchange of property with Elks Club referred to
Mayor Smith referred to the matter of an exchange of property with the Elks Lodge when the City
Attorney, Wn. F. Oigray, Jr. stated that he had talked to W. Dean Miller on four or five occasions and that
Mr. Miller had said that he was going to furnish him with the descriptions but, as yet, he hadn't received
the information.
Request for re- zoning referred to
Mayor Smith referred then to the matter of the request for re- zoning of three blocks at the and of
North Kimball near the overpass and stated that the Zoning Board had resubmitted their recommendation.
Councilman Vassar suggested that in as much as there were two councilmen absent and there being no
great rush for taking action, that any action be deferred until the other councilmen were present. This was
agreed to and action was deferred at this time.
Application for Bartender Permit
An application for a Bartender.Permit from Joyce E. Daniels was presented for the consideration of
the Council. Said application was accompanied by a receipt for the required fee in the amount of $2.50 and
had been approved by the Chief of Police.
It was moved by Councilman ruby, seconded by Councilman Vassar that the application be approved
and that a Bartender Permit be issued. A vote was taken and the motion unanimously carried.
Request for oiling of Crookham Street denied
Mayor Smith informed the Council that the City Engineer had received a request for information from
ale Dredge, office manager of the Stiener Company, as to when Crookhem Street would be surfaced as his
mpany had understood that this was going to be done by the City in the same manner that Evana had been done

by the City. He had said that one of the reasons Stiener had built in the area was because of this antici-
pated surfacing.
Yw. lewis, City Engineer had informed him that this would be a direct order from the Council.
Mayor Smith stated that he had informed them that there was nothing in the official records of the
City in this connection and that he doubted very much that the City would be very interested in the free
black - topping of this Street or any other street, particularly in view of the tight financial circumstances.
The matter was discussed when Mayor Smith and Councilman Vassar stated that they had no knowledge
of such a commitment on the part of the City and in answer to the question, City Attorney Wm. F. Gigray, Jr.
informed the Council that there would have to be some kind of a committment on record obliging the City to
do this.
It was moved by Councilman Vassar, seconded by Councilman Luby that the request be denied. A vote
was taken and the motion unanimously carried.
Approval given for vacation portion of Street right -of -way
Mayor Smith informed the Council that, with regards to pending Street work, it had bean brought to
his attention by the City Engineer that on Airport Avenue, running south from the Wilder Highway and on the
east side of Airport Avenue, In addition to the regular 110 foot right -of -way, there was an additional 34
feet which appeared to be of no real use to the City.
City Engineer Mel Lewis explained that this involved the 110 foot right -of -way for which part of
It was deeded to the United States Government for a drain. He said that he understood that the Dude drain
used to go to the river in this area and then it was changed and it went down the west side of the airport,
that it went most on the south side of the airport and there then, was no use for this, and all the deeds,
even the ones to the City for the airport, had either shown evidence of an agreement for this 110 feet or
had actually deeded it prior to the time the city got the airport.
Mr. Lewis continued by saying that when the industrial site was platted, there was an additional
34 feet, plus or minus, platted which gave the City a total width of 144 feet and that, actually, they had a
better claim to the 34 feet probably that they did to the 110 feet, but the way the Street was now located,
he doubted that they would want to move it over. He said that one reason was that they didn't have the 34 P
where the Crookham property was and where the Western Idaho Potatoe Growers was, next to the railroad, and
this would have to be acquired and, secondly, it would line up with the drain ditch that they were going to
fill on south and the third reason would be that they would be building the road over that part of the ditch
that is now filled and that this wouldn't be to good; that, for these reasons, he would recom end vacating
the thirty -four (34) feet.
After some discussion as to the location of the right -of -way under consideration, it was moved by
Councilman luby, seconded by Councilman Vassar that the recommendation of the City Engineer be approved. A
vote was taken and the motion unanimo carried.
Mr. Lewis stated that he would obtain the proper descriptions necessary for the City Attorney to
prepare the necessary documents.
Consideration given to vacating right -of -way
Mayor Smith presented, for consideration of the Council, a request from Mr. Beryl Morris for the
City to release back to him certain street right -of -way which was partially described as Florida Avenue ex-
tended between Cleveland Boulevard and Linden Street which was not being used and had never been opened.
City Lnginser Mel Lewis pointed out the approximate location by use of a City map and explained
that the State had required this property back when Mr. Edgar Oakes was Mayor in that they were going to
make a by -pass of Caldwell. Mr. Lewis stated then, as he understood it, the plans for US 20, where it is
now located came about and this was dropped but the surveys were made during WPA days and that he had spent
a half of a day in the District office trying to find the notes so that he could relocate some of it. He
stated that this was necessary because the descriptions were described from that original survey but he
,ould find nothing on it; that they had thrown the books away and apparently there wasn't even a map of it;
lowever, the State said that they had given the right -of -way back to the City but he didn't know by what
means and at this point, he didn't know whether the City had any right to give anybody title other than by

After some further brief discussion, it was agreed that the matter should be deferred until more
inate information was available.
