The Regular Monthly Meeting of the City Council met in the Council Room of the City Hall, with the Mayor, Emery L. Vassar, presiding. On Roll Call the following Councilmen answered present: Edger L. Oakes, F. D. Mumford, W.S. Boynton, G.17. Montgomery, G. 1 1 1. Fenrich and W.R. Hollingsworth. The Minutes of ''March 3rd, were read and approved as read. Mr. Dave 7'crsey appeared befo-e the Council an asked permission to rebuild the 'Weitz Produce Co., warehouse on Albany Street. This matter vies left on the table. Thereupon the following preamble and resolution was presented to the Council for its consideration. RESCLUTIuN By Fenrich. WHEREAS, There as been levied and assessed against Lot 7, in the New Home Ad- dition to the City of Caldwell, Idaho, for sidewalk improvements, the sum of $88.19, and wHEREAS, Cecil Soper has recently acquired the said to --s by tax sale from the County of Canyon, State of Idaho, and WHEREAS, The City of Caldwell, on or about the 28th day of December, 1925, began In the iistrict Court of the Seventh Judicial District of the State of Idaho, In and for the County of Canyon, an action wherein the City of Caldwell was plaintiff and Irvin Gold- smith and others were defendants, to foreclose its lien upon the above described lot and other property, for the construction of sidewalk within the said district, and LMREAS, On the 14th day of Mareh, 1927, a Judgment and decree was entered in so action, and in which said judgment the foreclosure action was ordered continued on said Lo' 7 under an extension agreement entered into between said City of Caldwell and J. Jester, X and others, then owners of said lots, and WHEREAS, A sidewalk was constructed by the City of Caldwell under the local im- provPment district laws of the State of Idaho, along said lots, on and prior to the ®th- day of July, 1920, and 17HEREAS, The levy for state and county taxes was made against the above describe( property after the levy was made for the said iGAroverdents, to -wit: In the year 1923 and 17AEREAS, It appears that the lien for state and county taxes was a prior lien to said local improvement assessment, and it further appears that none but the Cit of Caldwe: Is interested in said assessments against said lots for said sidewalk local improvement; az that the said lien for said assessment is probably lost, and WHEREAS, The owner of said lot, to -wit; Cecil Soper, has offered to pay to the City of Caldwell the sun of 012.50, which said sum the said treasurer is hereby authorized to accept as compromise of the lien of said assessment of said local improvement; the said treasurer be, and he is hereby authorized and directed to receive the same in full eatis- action of said assessmnnt; and the Mayor of the City of Cyld>rell, under the seal of the aid City, duly attested by the clerk, shall thereupon make, execute and deliver a satis- action of the lien of the assessment and deliver the same to the said Cecil Soper. IT IS FURTHER RESOLVED That upon the payment of the said sum of money and the slivery of said satisfaction, the city attorney of the City of Caldwell be, and he is ereby, authorized and directed to cause the said action to be dismissed as against the abc escrived Lot 7 of the New home addition to the Cite of Caldwell. A RESOLUTION _UTHORIZING TIDE CAI?CELLATION OF CERTAIN SPECIAL CITY TAXES, LEVIED AND ASSESSED AGAINST PE PROPERTY HERE- IN -AFTFZ DESCRIBED, Alm NOW DELIIIQUENT. Whereas it has been made to appear to the satisfaction of the Mayor and the City Council, that the property herein particularly described, have been assessed by the City for special taxes including sprinkling, weed cutting and etc., and none of said taxes have be.eir paid, and that the same are now delinquent against said properties, and .Whereas it has been made to appear that Mrs. Rex Johnstone who is aquiring title to this. property, by tax title from the County is desirous of improving said premises, d when so improved will place them on a tax paying 'oasis, and Whereas, application has been made to cuncel all ouch delinquent taxes against said property, and Whereas it appears to the best interest of the city to cancel the same, Now 1 herefore•it it ordered and this does order that the City Treasurer cancel the delinquent axes now'levied against -Lots 19 to 21 in Block 101 Orginal Addition to Caldwell. i Passed by the Council this 2nd day of IsMeh; 1936. -Approved by the Mayor this 2nd day of Mon, 1936. v E. 'The Bills for February were read and on iiotion made by Boynton, seconded by Hall- ngsworth, that these bills be allowed and Warrants be ordered drawn for the various amount 11 of which had been approved by the Chairman of the Finance Committee. Holling�tvorth. WHEREAS, Under and pursuant to a resolution d1zly adopted by the Mayor and Counci: of the City of Cantwell, Canyon County, Idaho, on the 3rd., day of February 1936, E. L. Vassar, Mayor of the City of Caldwell, enterod into a certain contract with Frank U. Uyematau and Y. Shinya, under date of the lat day of March 1936, a copy of which said Contract is hereto attached, and by reference thereto made a part hereof, and It appearing to the Council that the said Contact was in due form, and in all manner• conforming to the desires and wishes of the City Council of the City of Caldwell, NOW, THEREFORE, BE IT RESOLVED That the said Contract, be and the same is, here- by approved, and the act of the Mayor of the City of Caldwell in executing said Contract, and the attestation of the City Clark of the City of Caldwell, be, and the same are, here- by approved and adopted as and for the act of the said City of Caldwell; Councilman Hollingsworth moved the adoption of the said preamble and resolution, which motion was duly seconded by Councilman Boynton. A yea and nay vote was had thereon, with the following results: Yes: Councilmen Oakes, Rumford, .ontt;omery, Boynton, Fenrieh, and Hollingsworth No: None. Absent and not voting: None. Thereupon, the Mayor declared the motion duly carried, and the preamble and re- solution duly.adopted. Whereas, the Mayor and City Council of Caldwell, Idaho, received a letter from the Pioneer Irrigation District dated February 16th., 1936. Copy of which letter is as follows: � ]1f 9 Honorable Mayor and City Council, Caldwell, Idaho, Gentlemen: Owing to a change in the manner of making assessments for funds for the op- eration and maintenance of water distribution in the City of Caldwell it is impossible for us to make the usual lump payment of 55% of the amount required by the Council. We made no assessment for that purpose in the fall end are just now getting out a toll assessment payable before water is allowed this 4pring. This will be mailed out in a week or ten days. We are assessing an amount approximately ten ter cent above the 09,500.00 required and will remit to you by the loth of each month the total amount collected in the preceding month as collected to an amount not exceeding the amount asked for. y�f Your ditributors can aid very materially in the amount you will receive by making sure that persons using •mater have paid before Earning water to them or assigning them a time to water. We will give each person who pays a card showing they have done so. Very truly yours, Fred L. Evans, Secretary. Whereas the said letter is uncertain in a number.of particular matters. There - be it resolved that the City Attorney write a letter to the Pioneer Irrigation Distr request them to make.a complete explanation of the matters and things mentioned in id letter Councilman Hollingsworth moved the adoption of the resolution, which motion was conded by Councilmen Oakes. A Yea and Nay vote was had thereon, with the following results: Yea: Councilmen Oakes, Mumford, Montgomery, Boynton, ?enrich and Hollingsworth, Nay: None. Absent and not voting: None. Thereupon the Mayor declared the motion carried and the resolution duly adopted. There being no further business to come before the Council, it was..on motion ly seconded and carried declared adjourned. Mayor City Uerk COUNCIL CHAMBERS, MARCH 23rd., 1936. g:00 P. M. The Council met on call of the Mayor, with the Mayor, Emery L. Vassar, presidi On Boll Call the following Councilmen answered present: Oakes, Mumford, Mont - ;omery, Boynton, Fenrich and Hollingsworth. The Mayor informed the Council the m=eting visa called to take up unfinished Mr, Dealer, Mr. Taylor, Mr. Brown and Mr. Caldwell appeared before the Mayor and Council and requested that the City Council cc- operate with the Federal Goverment in its lay,ground undertaking in munlcipaltiea and requested the City of Caldwell to appoint one member of the City Council on the Board and to contribute $300.00, and stating that the Board of Directors of the School District had agreed to co- operate and to advance a lik sum of 4300.00, if the City would so co- operate. . mss ' The Mayor thereupon appointed Edgar L. Oakes on said Recreation Board but no action was taken on the appropriation of $300.00. Whereupon, the following preamble and resolution was presented to the Kayor and Council by Councilman Montgomery. RESOLUTION q By Montgomery. Whereas, The City of Caldwell now owns several tracts, lots and parcels of real estate situated within its city limits, and which have not been acquired for or used as a L blic park, playground or public building site, and which is not necessary to be used by the City for any municipal purpose, either for public park, playground or public building site. That the property first hereinafter described was dcquired by a deed from the owner thereof in consideration of a lien on such property for a pub31C improvement, to -wit: sidewalk tax, which-said lien the City of Caldwell had theretofore to foreclose in the District Court of the Seventh Judicial District of the State of Idaho, in and for the � /V
