Council met-'n regulax session pursuant to law, with Mayor M000nnel presiding and Councilmen ; Bollman, Dickens, Gordon, Johns, Leighty and Sandmeyer present. Absent none. Owing to the absence of the City Clerk the Mayor appointed Mr.W. C. Dyer, Acting City Clerk, and announced that the Council was in session for the consider- ation of any business which might lawfully tonne before it, Mr. H. J. He Neel appeared before the Council and requested favorable consid- ation on his bill for construction of pavement on Cleveland Boulevard in front of the College of Idaho. Afterdiecuseing the matter by members of the Council it was moved by Councilman Leighty and seconded by Councilman Bollman, that the City pay :BONeel L1mber'Yaxd $543.50 in settlement of his claim. Motion carried. Mr. MCNeel also asked that the City+supoly hiin with fifty yards of crushed gravel to -apply on hisgravel contract with the city. His request was referred to the City Engineer, Mr. H. L. Granger appeared before the Council and asked permission to rent Block 89 Mountainview Addition to Caldwell, belonging to the city, The Mayor ap- ppinted Councilman Bollman, as a committee to investigate the matter and report back to the Council. A comrnittee from the Lions Club appeared before the Council and discussed the matter of building and graveling a cross- runway at the airport. They requested that the City assist in the graveling of the runway. The Mayor referred the request to the airport committee. Thereupon Councilman Johne introduced Bill No.24, by Johns entitled: AN ORDINANCE CONFIRMING THE CREATION AND ESTABLISHMENT OF LOCAL IMPROVEMENT DISTRICT NO. 11, FOR THE CITY CALDWELL, IDAHO, AS AN ENLARGED IMPROVEMENT DISTRICT; APPROVm ING THE ASSESSMENT ROLL FOR SAID DISTRICT AS FILED IN THE OFFICE OF THE CITY CLERK ON MAY 12,1930, AND APPROVED AND CONFIRMED BY THE COUNCIL ON MAY 26, 1930; PROVIDING FOR THE PAYMENT IN INSTALLMENTS OF THE COST AND EXPENSES OF THE IMPROVEMENT MADE IN SAID DISTRICT; ASSESSING A PORTION OF THE COST OF THE SAID IMPROVEMENT AGAINST THE PRO?ERTY THEREIN LYING BEYOND THE LIMITS OF 111PROVEPENTDISTRICTS AS DESCRIBED IN S;;OTION 5 OF CHAPTER 257, LAWS OF 1927 OF THE STATE OF IDAHO, AND ASSESSING THE SAL ANOE OF THE COST AND EXPENSES OF SUCH IMPROVEMENT AGAINST THE LOTS, BLOCKS, AND PARCELS OF LAND IN SAID DISTRICT CONTIGUOUS OR TRIBUTARY TO, FRO:TING OR ABUTTING UPON, SAID IMPROVEMENT; AND DESCRILING THE MANNER FOR THE COLLECTION AND PAYMENT OF SAID ASSESSMENTS. was read for the first time, and the Council proceeded to a consideration of Bill No. 24. It was moved by Councilman Sandmayer, duly seconded by Councilman Johns that all rules requiring the reading of a Bill on three separate days be suspended and that Hill No.. 24 be read the second time by titla and the third time in full and olaced on its.final passage. The Mayor directed the Clerk to call the rollon the motion with the following results: those voting in the affirmative: Bollman, Dickens Gordon, Johns, Leighty and Sandmeyer. Those voting in the negative: None. Absent and not voting: None. So the Hlayor declared the Motion had passed by the necessary three- fourtha, majority and directed the Clerk to read Pill No. 24 the second time by title and the third time in full, section byseetion. The Clerk read•the bill as directed. The question being °Shall Bill No. 24 pass?" The Mayor directed the Clerk to tail the rgll with with the following results: Those voting in the affirmitive Bollman, Dickens, Gordon, Johne, Leighty and Sandmeyer: Those votingin•the negative: None. Thereupon the Mayor declared that Bill No. 24, had passed acul in open sess- ion of the Council tae Mayor d_.ly signed and approved said bill, and the Clerk duly signed and attested the same, which became Ordinance No, 491. Thereupon the Mayor directed the Clerk to make proper entry of the same and to cause Ordinance No.491, to be published in the Caldwell News- Tribune the official newspaner of the city of Caldwell, Idaho. Thereupon Councilman Johns introduced ?ill No. 25, entitled: AN ORDINANCE CONFIRMING THE CREATION AND ESTABLISHMENT OF LOCAL STREET I1PROVE',.''INT DISTRICT 110. 12, FOR THE CITY OF CALDWELL, IDAHO; APPROVING THE ASSESSMENT ROLL FOR SAI DISTRICT AS FILED IN THE OFFICE OF THE CITY CLERI{ ON OCTOBER3, 1930, AND ACCEPTED AND C N FIRMED BY THE COUNCIL ON OCTOBER 20, 1430; PROVIDING FOR THE PAYMENT II'I INSTALLMETTS OF THE CO:T AND EXPENSE OF THE IMPROVEMENT MADE IN SAID DISTRICT; ASSESSING THE COST OF T IatPROVEMENT AGAINST THE LOTS, BLOCKS AND PARCELS OF LAND I17 SAID DISTRICT, COT.'TIGUOUS OR TRIBUTARY TO, FRONTING OR ABUTTING UPON SAID IMPROVE MINT, AND DESCRIBIPiG THE MANNER FOR THE COLLECTION AND PA7: :117 OF SAID ASSESSMENTS. was read for the first time, and the Council proceeded to a consideration of Bill No. 2 . Thereupon the Llayor declared Bill No. 25 had passed, and the Manor in open session of tie Council duly signed and approved said Bill and the Clerk duly signed and attested the same which became Ordinance No., 492. The Mayor directed the Clerk to faake the proper entry of the same amd to cause ordinance No. 492 to bepubliahed in the Caldwell News - Tribune the official newspaper of the City of Caldwell, Idaho. Motion carried. Thereupon the Clerk presented and read the followingwritten communication from the city attorney, Frank E. Meek. February 28, 1931. Hon. Fred H. McConnel, Mayor of the City of Caldwell, Caldwell, Idaho. Dear Sir: Due to my recent appointment to the position of Prosecuting Attorney of Canyon County, Idaho, I feel that it becomes my duty to resign the position of City Attorney for the reason that there might be a conflict between the duties of the two positions. I therefore herewith tender to you my resignation as City Attorney to take effect March let., 1931- I wish to express to you and thru you to the Council and other City offi- eiale my sincere appreciation for the many courtesiee of the past. Thereupon it was moved by Council. ;ian Sandmeyer and dulyseconded by E Councilman Leighty that the resignation of Frank E. Meek as City Attorney be accepted to be effective at once. Motion carried. The Mayor appointed M. H. Eustace, an attorney at law of Caldwell, Idaho, as City Attorney for the unexpired term caused by the resignation of Frank E. Meek, and submitted the name of 21. H. Eustace, to the Council for confirmation. Thereupon it was moved by Johns and seconded by 3ollma.n that the appointment of UiH. Eustace as City Attorney of the-City of Caldwell, Idaho, to serve for the remainder of the present term, or until the appointment and qualification of his successor, be confirmed. Motion carried. Thereupon the Mayor declared M.H. Eustace appointed as City Attorney to serve for the remainder of the present term, or until the appointment and qualification of his successor, and directed the Clerk to issue a co.¢:iission to 14. H. Eustace, as City Attorney. Thereupon it was moved by Councilman Boll and seconded by Councilman Johns that the Council adjourn to reconvene on -onday March 30, 1931, at 6 :00 oielock P.X. Motion carried. Thereupon the Council adjourned pursuant to the foregoing motion. APPROVED; Mayor. Acting City Clerk
