The Mayor requested that everyone stand and dive the Pledge of Allegiance to the Flag. The Roll of the City Council was called with the follov�nq members present: Carl or, Mallea, Marcus, Cowles, Raymond, an-c Norman. Abi bent: none. (AUDIENCE PARTICIPA`PION) The Mayor stated that he was aware that Mr_. Bruce Papanietro was present at the meeting and desired to bring in i to the attention of the City Council at this time, Mr. rapapietro stated that the Parks and Recreation Commission would like to ads, a line item to the Park and Recreation Budget for future park and recreation development in the City of Caldwell. This was so that there wouldn't he problems as there was with the Wilson Park Project a few years ago when they had to go to the General. Fund and Revenue sharing, In the past they have had a carryover fund from a surplus in budget and if possible, they would Like to start the future monies with this fund and every gear add to it. The Mayor stated that he thought this was an excellent idea. This would be a dedicated fund for future development of Parks. It could be started with monies that was left over from previous budgets and then every year take some money and put into it. Councilworian Mallea pointed out that they were not doing budgets at this time, It was her suggestion that this request be given some study by a Committee; perhaps the Finance Committee. Hr. Papanietro further said he realized that the work had not _'.tarted ! on the budget as yet, but they would like to know if they should include in the budget the coming year. It was determined by the Mayor that this request would be studied by the Finance Committee and a report made in a month. Councilwoman miallea asked for a written recommendation from He Commission with regard to this request. Mr. Papapietro stated that they were meeting on the 5th of March and he would get that written recommend at that time. O L I� i3'�i S I i•J E S S (F'L MEXICO AND ICHA£700' S BEEN? LICENSES) The Mayor stated that the next item on the Agenda was to give consideration to the beer license at Ichabod's, He called on the Police Chief to address this item.. Police Chief Dormois state; that 'ne received a copy of a letter to the Council and the Building Department with regard to the work that they are doing in an attempt to stet the problem recitifed as to the illumination of the parking lot. Mr. Dor:mois said that he was satisfies; that they were working on it nos.. The Mayor stated that he would like permission from the City Council to grant the license ,upon completion of the work. Khen the Police Chief assured him that: the work was done, the license would then be issued and the license would not have to be suspended as discussed previously. t °ir.. 'Iar.ris was on a temporary License at this time. The Police Chief said that the license was issued by the City Council with the stipulation that the worl� would be done in thirty days. The Mayor further said that the Council determined at the last meeting that the license would be Book 25 Page 45 taken away the next day if the work was not startei, They bid start the action to conform to the stipulations. The City Attorney was in contact With Mr. Harris's Attorney at this ti�' e. The Mayor then stated that also to be discuss ec at this time was the request for a beer license from El Me The , , , ayor read an extensive letter from the Police Chief to the Mayor and City Council giving the recommcndatiori that the City Council the application of Maria j. Paz to sell beer and wine at the 01 Mexico, 410 Main Street. This letter 0 attached to the minutes for reference. The Mayor stated that taking in consideration the recommendation from the Police Chief, he would now ask for action on t'ne part of the City Council. '10TION Cl',R',=D NEW BUSINESS (A`,', DID FOR CITY 1 RUITLDII-c) The Mayor stated that the first item under New Business was to award the bid for the new City Hall and he was going to request that the City Council put consideration of this item into Committee. Mr. Redmond explained that the bids for the Block Grant werc opened on Friday. The Week Grant was street construction of Chicago front Boise Avenue to the Northwest Connector, Centennial. ni, the —3y. All mei ors of Council were given an abstract of the bids. It was Mr. Redwand's recomnienJ2aticn, that the ` )id 1)e awarded to the low bidder, Na, Pavin, ,j and Aspbalt. MOVED by Carter, SECONDED by Raymond that the bit for the Block Grant project be awarded to the low bidder, Nampa Paving and Asphalt as reco',T.mended by the City Tzng j i neer .'- � 0 T 10L C?, R 1R 1 1- E'D (A'.,A!'D BID' POLICE DEPAR"f1.7,,iN1T Boob 25 Page 46 Dennis Davis, the Buil6ing Official, was recognized by the mayor and discussed the bids for the Police Department remodeling with the City Council. Thwe was seven bidders on this project and the apparent low bidder was C.T.C. Corporation, Their bid was less than the budgeted amount for the project, but there was a problem with C.T.C. and their licensing. They do not have at this time the proper license to perform the. work at the Caldcaell Police Station. They are licensed under Public Works, but they are licensed in a specialty category. The Specialty Categories, from what they have been able to ascertain, does not make up the fifty percent of the total project which would allow there to participate in this bidding. The State Law also says that they do not necessarily have to have their contractor's license until the bid has been awarde(?. f;r. Davis fur't'rher said that he had a copy of the Public Gvorks Licensing Board which states that C.T.0 - -- Corporation has filed an application with them and the 'Board will be reviewing that application next P4onday. If the City Council wanks to aware', the contract today, C.T.C. Corporation could be disqualified and the City would have to -Dove to bestern Idaho Builders which was the second low bidder and the cost difference caas $1,577.00. This would still be within the budget range. Councilman Raymond asked `4r. Davis if he stated when the bids would be awarded in his instructions to the bidders, Mr. Mavis stated that he did not. Councilman P.ayrrond. said that his concern here was that if, in fact, the State Lacy provides that the licensee has the time between submitting the bid and the time for award to actually become rjualified, he would be concerned about the legal standing of the City. The Company made the bid in good faith anticipating that they would be c {ualified to make the bid. mr. Davis state': that the specifications said that they must have a public works contractor license and they do have that, but it is in a specialty category, Greater than fifty percent of the work does not fall in a specialty category. Their applicati on was submitted to the 1 �onrd four days before the Did was made. The Mayor stated that the City Council could award the bid based on the secondary bid subject to an interpretation by the City Attorney. Councilman Raymond stated that he would certainly like__ - an Attorney's opinion with regard to this bid. It was MOVED by Mallea, SPC0NDPD by Cowles; that the bid be award to Nestern Idaho Builders as the lowest, responsible bidder subject to the interpretation of the other bider from the Attorney. There was further discussion from the City Council. Mr_. Redmond staled that the way he read the Code was that at the time of submitting a bid, the bidder doesn't necessarily have to have this license unless it was stated in the specs. The bidder doesn't have to hold the license. It says he has to hold the license at the time of the award. It appeared that he was maki.n<'.r, a valid attempt to obtain the license within a reasonable time. Mr. Red mond felt it would behoove the City to delay the award for a week and base the award decision on whether he gets the license on Monday. If not, award to the second Bidder. It was then MOVED by Carter, SECONDED by Raymond that this item be tabled until the next meeting of the City Council. It was pointed out that there was already a motion on the floor. Councilman Carter stated that it was his understanding that a motion to table takes precedence over the other motion. After further discussion with rec�Frd to the ,notions, both Councilwoman Mall.ea and Councilman Carter withdrew their motions with the - approval of the seconds, Councilman COwleS and Councilman Raymond. The '-ayor stated that he requested Mr. Derrol Nockett, Coordinator of Canyon 'Cou Cities Disaster Service, to be present, at this meeting to discuss the 91' Program with the City "unci1 The Mayor further informed the Council that he did, d iscuss this program with the Police Chief and they have taken the prerogative to start the action in motion to put the iii Program in Caldwell. Since that discussion, the Ma yor said that he had so qualms about the outside area those people who live in the County. Mr. Hackett explained at some length the problems he felt were going to be happenin; with the installation, of the 91 Program, In summation, 'Mr. i ockett pointed out that there was a need for central dispatching and cooperative ag reements. With the trade -ins, I think we can get the four vehicles for a figure within that budgeted amount. Another memo was addressed to the Mayor and Council from the Police Chief dated 23 February 1984 as follows: Book 25 Page 48 Referring to our workshop meeting, l,riclay, 17 February I.l<= and my memorandum to you 17 February, the Mayor advised me you desired more information in the way of figures. Patrol Units 1. and 3 have 91,240 and 94,816 miles respectively and the 1977 !lodges in detective use have 36,312, 77,951, and 76,416. it is envisioned that the stock mid range cars will probably come in at something around Q8,300 each and with the trade --ins of the .five cars we will be well within the $31,000.00 budgeted for cars this year. I see an overall_ cost savings in t_he ipurchase, much less_ maintenance on the vehicles and one less car ih the fleet causing a decrease in the insurance premium. This can be accomplished without a reduction in the service level. There will be a backup vehicle for loatrol in the event one of the cars goes in th ,._._, shop. The City Council. discussed this request with the Police Chief at some length. It was MOVED by Raymond, SEC0NDE'D by Cowles to allow the Police Chief to bid for the cars as requested. MOTIO1I CARRIED (C0t9r1I':[" 7T', T2PPORTS) Councilwoman 1.lallea reported that she had quite a collection of Personnel Policies which she would give to Councilman Carter and Councilman Norman. The Council President requested that there be a tentative Personnel Policy by the Council on the first of A- pr il and a final on the first of T-lay. Therefore, next Monday morning_ there will be a City Council meeting on Personnel Policies. The Mayor pointed out that he had appointed Councilwoman Mallon and Donna Talley to this Committee. Councilwoman Mall-ea further said that the Council President requested that the Council. members wort; on one policy and the t?orson,nel Department work on another. Each would establish ideas and then nut those all together. The t agreed to this procedure. The time for th Greeting on Monday was then set for 8.00 a.m. Councilman Carter stated that he had a discussion with Don Woolery of the Police 'Department. lie in�,..icatod that some action was needed on the Traffic Ordinance as they could not take action on parking fines with the existing Code. The Police Chie=f said that his information from the Prosecuting Attorney's Office was that they were going to issue warrants with the current Code. fie had not confirmed this with Mr. Harris, but there was warrants served under the present Code. (MAYOR'S COMMENTS) The Mayor stated that he would like to rear the following letter to the Manor and City Council from The Underground Investors which he was very pleased to present: At the end (tire hope) of the most severe winter in the history of Caldwell, we, the undersigned, wish to commend Superintendent Dennie Shippy for the terrific management of the streets of Caldwell through this most difficult .season. Day after clay, morning after morning, we vegan driving on ice and snow, finding the intersections sanded, volume traffic areas salted and sanded and school areas well sanded. Heavy snows were quickly removed with traffic :roving almost without delay or interruption. All this by the good management and efficiency of Superintendent Shippy and his crew. We, the undersigned, compliment Mayor McCluskey and the Caldwell City Council for having such a fine Street Superintendent and staff and express our appreciation for a job well done by Street Superintendent Dennie Shippy and his cre,r.
