Zoning, Cori=`.ssion concern regar,_ing Book 31 Page 33 solar access and the affect on solar access that may occur as a result of adopting an ordinance to increase building height. However, through the Special Use Permit process, such concerns could be evaluated on a case by case basis. The recommendation to the City Council from the Planning and Zoning Commission was to approve the proposed code amendment to the Caldwell Zoning Ordinance. As there was no one signed up to speak to this issue, the Mayor closed the public hearing. (PUBLIC HEARING ON VACATION OF STREET AND PLAT ON JOLIET STREET) Mayor Dakan opened the public hearing and requested that the Planning and Zoning Director present the background information on this issue. Mr. Crooks presented the material as outlined in his memo to the Mayor and Members of the City Council as follows: The item before the City Council was a vacation to vacate a portion of a plat and also that portion of Joliet Street between Ninth Avenue and the intersection of Illinois and Marble Front. Presently, this portion of Joliet Street is already blocked off as a result of some redesign of this intersection performed by the State in conjunction with putting in the on and off ramps to the freeway. In December of 1989, representatives from the Maverik Country Store approached and informed the City of Caldwell of their option to purchase property located on the east side of Illinois Avenue south of Marble Front Road and formerly occupied by a veterinary clinic. Additionally, Maverik Country Store indicated their desire to correct the odd configuration of the property through the vacation of presently unused Joliet Street and /or a possible purchase of a portion of park property from the City with the ultimate objective of constructing a retail facility at that location. The purpose of the requested street and plat vacation is to facilitate a more orderly development of property at and near the intersection of Illinois Avenue and Marble Front Road. Typically, with a street vacation, each of the abutting property owners would acquire a proportionate share of the vacated right -of -way based on the amount of street frontage. Also, it should be noted that if Maverik Country Store pursues the purchase of additional property from the City, it would be through a separate standard bid process and would not be considered part of the vacation request. As part of the review and evaluation of the requested vacation, notices were sent to affected utility companies and other agencies. Responses were received from Idaho Power and U.S. West Communications. Essentially, their response requested that their improvements within the areas for vacation would be honored. It is not anticipated that any other objectives or concerns with the requested vacation are forthcoming. The recommendation was to approve the vacation request subject to the following terms and conditions: 1. Prior to final recordation of the vacation: a) Final plans shall be submitted for the review and approval of the City Engineer. b) Final plans shall be submitted for the review and approval of U.S. West Communication for the purpose of identifying telephone cable, pedestals and other improvements with provisions made to maintain and /or repair any of these improvements. Any relocation costs will be borne by the party requesting this vacation. c) Final plans shall be submitted for the review and approval of Idaho Power for the purpose of establishing an easement for existing power lines located on the BnDk 31 F- 34 no aeast _rife of - liet The Mayor stated that several people did sign up to speak to this proposed vacation of street and plat on Joliet and eac!. of tham� - , , as i--c.:DqnizeC by the .',syor as : Dan Murray. 140.
