REGULAR MEETING
February 20, 1996
7 :30 p.m.
The Meeting was called to order by Mayor Winder.
The Mayor requested that everyone stand for the Pledge of
Allegiance.
The Roll of the City Council was called with the
following members present: Houchins, Evans, Earl,
Langan, and Wells. Absent: Nancolas.
ADDITIONS OR DELETIONS TO THE AGENDA.
Since there were no additions or deletions to the
prepared Agenda, it was MOVED by Houchins, SECONDED by
Earl to accept the Agenda as prepared.
Roll call vote. Those voting yes: Houchins, Evans,
Earl, Langan, and Wells. Those voting no: none. Absent
and not voting: Nancolas.
MOTION CARRIED
INTRODUCTION OF SPECIAL VISITORS.
Mayor Winder noted that there were several special
visitors, but believed they would be taking part in the
meeting and would introduce themselves at that time.
AUDIENCE PARTICIPATION.
The Mayor asked if there was anyone in the audience who
cared to address the City Council at this time on an item
that was not included on the Agenda.
Keith Eisberg, 2114 Wisconsin, was recognized by the
Mayor. Mr. Eisberg explained that he was the owner of
Skydive Idaho and wanted to make a small presentation to
the City of Caldwell. Skydive Idaho was the first group
to jump into the Boise State University Football Stadium.
A lot of support was received from the City of Caldwell
and this was his way of saying thank you. He then
presented a photograph of a skydiver about to touch down
in Bronco Stadium and noted that he was that skydiver.
REPORT FROM THE TOWNSITE COMMITTEE
Tom Ronchetti, owner of Bill's Service Parts in Caldwell
and also the Chairman of the Townsite Committee was
recognized by Mayor Winder. Mr. Ronchetti informed the
Mayor and Council that the Committee currently consists
of twenty -one members. He continued stating that his
purpose in appearing before the Council at this time was
- for a resolution of support for the formation of a
Business Improvement District. Some literature was
handed out to the Council with a short mission statement,
the membership list, and also the Idaho Statutes
governing the B.I.D.s. The purpose of this District was
to improve the business area in downtown Caldwell, to
promote a positive image, and to encourage business
growth in the downtown and outlying areas. Mr. Ronchetti
also informed Council that they were in the process of
gathering information on a District at this time, but
would like to know how the City Council felt about this
project and if they would be supportive.

Mayor Winder responded to his comments presenting some
background information on how the downtown area has
changed over the years. This was due primarily to
Karcher Mall, changes in the way people shop, and the
ease of transportation. The downtown dried up because of
these factors. However, there has been considerable
progress made to change the direction and much of the
credit belongs to the Townsite Committee. The Committee
has been working for more than two years to come forth
with some kind of recommendation as to what they would
like to see accomplished in the downtown. The downtown
has been the number one area of concern on the part of
the citizens. The Mayor further stated that he felt the
Council was prepared to help the Committee in any way
they could to establish the B.I_D. and accomplish the
goals they have set.
Councilman Langan commented that he attended one of the
Committee meetings at the Depot and how impressed he was
with the group's response and process in having the Nampa
representatives present a report on their trials and
tribulations with regard to their downtown
revitalization. Mr. Langan complimented them on their
work and stated that he would support their efforts.
Both Councilman Wells and Evans stated that they were
proud of the progress being made in Caldwell and how they
wanted to be a part of seeing the Community grow.
Mayor Winder thanked Mr. Ronchetti and other members of
the Committee and stated that their efforts were
appreciated.
CONSENT CALENDAR
Mayor Winder presented the following items on the Consent
Calendar for consideration by the City Council:
1. Dispense with the reading of the minutes of the
February 5, 1996, Regular City Council Meeting and
approve as written;
2. Accept the minutes of the Caldwell Golf Board
Meeting of January 9, 1996;
3. Accept an easement from the Caldwell School
District that specifically covers that portion of the new
sewer line for the Vallivue High School that was on the
Easterly boundary of Jefferson Junior High School;
4. Accept the low bid submitted by Roundtree
Chevrolet for the purchase of a new service truck for the
Sewer Treatment Plant;
S. Accept the low bid from Idaho Sand and Gravel,
Inc. for the City Paving Contract which includes work for
L.T.D. 95 -2, L.I.D. 95 -3 and the new Airport Taxiway and
other additional work as circumstances require it;
G. Accept the low bid from Park Towne Construction
to perform the work of the City Miscellaneous Concrete
Project (L.I.D. 96 -1) and other additional work as
circumstances require it;
7. Accept the low bid from Qualitree, Inc., to
perform the work of removing dead, diseased and /or dying
trees from street right- of - way•'and adjacent property
(L.I.D. 95 -5) and other additional work as circumstances
require it;
8. Pass following Resolution authorizing the
execution of a Boulevard Signal Agreement with the Idaho
Transportation Department:
WHEREAS, The Idaho Transportation Department,
hereafter called the STATE, has submitted an Agreement
stating obligations of the STATE, the CITY OF CALDWELL,
hereafter called the CITY, for the modification of
Signalization of Ustick Road and Nampa /Caldwell Boulevard

(U -84B) and the construction of signalization of Happy
Day Blvd. /Laster Lane and Nampa /Caldwell Blvd. (I -84B).
WHEREAS, Certain functions to be performed by the
STATE involve the expenditure of funds as set forth in
the Agreement; and
WHEREAS, The STATE can only pay for work associated
with the State Highway system; and
WHEREAS, The CITY is fully responsible for its share
of project costs;
NOW, THEREFORE, BE IT RESOLVED:
1. That the Agreement for Federal Aid
Project NH -F -M- 7963(021) is hereby
approved.
2. That the Mayor and the City Clerk
are hereby authorized to execute the
Agreement on behalf of the CITY.
3. That duly certified copies of the
Resolution shall be furnished by the
Idaho Transportation Department.
9. Approve a Public Improvements Deferral
Agreement with Allen Pieper which defers construction of
sidewalks for property frontage along the Southeast side
of 21st Avenue and the Southwest side of Chicago Street.
MOVED by Houchins, SECONDED by Earl that the Consent
Calendar be accepted as presented by the Mayor.

(DECISION ON WHETHER TO AMEND THE CITY CODE WITH REGARD TO
APPLICATION FOR RENEWAL OF LIQUOR, BEER, AND WINE LICENSES)
Mayor Winder explained that there has been an ongoing
response to the questionnaire that was mailed out to the
owners of licenses. Twenty -two responses have been
received out of fifty -four mailed out which was a
reasonably good response. The questionnaire asked if
they felt it was too restrictive to require the renewal
application to be in the City Clerk's Office by November
1st. Seven said it was and fifteen said no. The next
question was whether the penalty of losing their license
for each day late in submitting their application was
fair. Six said it was fair and sixteen said no. Also,
would they prefer having a fine for each day late instead
of the penalty of losing their license for each day they
were late. Sixteen said yes and six said no. When asked
how much they felt the fine should be, the amount ranged
from $1.00 to $50.00. The Mayor further stated that the
Council has discussed this matter previously and some
felt that $50 was not an adequate amount to fine them if
they were late. The decision at this time was whether to
change the existing policy which was that they were
required to have their application submitted by November
1st. For each day they were late after November 1st,
their license to sell was delayed for one day.
Several of the Council Members responded stating that
they did not really believe there was a major problem at
this time_ The response indicated that they did not
believe the deadline of November 1st was too restrictive.
Councilman Houchins pointed out that there was a problem
with only two or three a year. With the present Code,

the business would be closed down for each day late.
This would be taking away tax money. Therefore, he would
prefer seeing the fine system instead of closing them
down. Mr. Houchins believed the amount of the fine
should be enough to get their attention. His suggestion
for the amount was $100 a day. However, the impact on
the employees of the business who would be out of a job
was also to be considered.
Councilwoman Earl asked if the suggestion was to maintain
the deadline date, but to have a fine instead of the day
lost for each day late. The Mayor stated that a Bill
could be developed with the fine included and then give
the businesses an opportunity to respond.
MOVED by Houchins, SECONDED by Langan to direct the Mayor
and Staff to draft a Bill to present at the next Regular
Meeting regarding a change in the Chapter of the City
Code governing the license renewal for beer, wine, and
liquor licenses changing it from a daily closing penalty
to a daily fine penalty not to exceed $50.00.
Councilman Wells suggested that the motion indicate that
they could be given an option of either penalty.
Councilman Houchins stated that the penalty in place now
was not working. Therefore, he would not want the motion
to read that they could be given the option.

At this point in the Meeting, the Mayor introduced Boy
Scout Troop No. 143 from Melba and welcomed them to the
meeting.

(CONSIDER BILL NO. 3 TO CHANGE THE NAME OF A STREET IN THE CITY OF
CALDWELL)
Mayor Winder informed the City Council that a request was
received from the Fire Marshall, Joe Silva, to change the
name of a street in the Manchester Park Subdivision.
This was a new Subdivision and this street was not
developed. The request was due to the similarity of a
named lane in the County which might cause emergency
response personnel to respond to the other named street
rather than the one where service was needed. The
proposal has the support of the property owner and if
Council determines to support the Bill, it was suggested
that the rules be suspended and the Bill passed with only
one reading.
The Mayor read Bill No. 3 by title only as follows:
AN ORDINANCE OF THE CITY OF CALDWELL, IDAHO, PROVIDING
FOR THE CHANGE OF A STREET NAME WITHIN THE CORPORATE AREA
OF THE CITY OF CALDWELL.
Councilman Wells was recognized by the Mayor and stated
that he had some questions with regard to this Bill. He
was unsure as to why this situation was not noticed
before platting if it was going to cost the City; what
kind of confusion it was going to make if it was not
replatted; and what part of the County would have the
same name.
The Mayor stated that the request from the Fire Marshal
was to attempt to eliminate the similarity in name that

might lead emergency response personnel to go to the
wrong address which does happen. The Idaho Code does
provide a method for changing a street name by Ordinance.
At this time, the implications were relatively minor. If
building had already occurred, there would be other
considerations.
After further discussion, it was agreed that the Council
would prefer that the Fire Marshal, Joe Silva, attend the
next City Council Meeting to present more information on
this matter.
It was then MOVED by Langan, SECONDED by Wells that the
Fire Marshal, Joe Silva, be invited to the next City
Council Meeting so they could discuss Bill No. 3.
Councilwoman Earl suggested that Mr. Silva also be
requested to address how to alleviate this kind of
problem happening in the future.

(CONSIDER APPROVAL OF STREET FUNCTIONAL CLASSIFICATION MAP)
Mayor Winder requested that the City Engineer address
this item on the Agenda.
Mr. Law informed Council that the Functional
Classification System Map has a very specific, definite,
and important purpose for being in existence. The
purpose of the map was to define the level of use of the
major streets in the City and to allow those streets that
have that higher classification to be funded in their
improvements by the Federal Highway Funds. With the
recent increase in the impact boundaries for the City, it
was necessary to extend those streets that were affected
of the higher classification into the Impact Area so they
could qualify for Federal funding as they were annexed
into the City.
Councilwoman Earl asked if the map would be updated as
the City completes the Traffic Study. The City Engineer
answered that there was a process involved in updating
the map. He would assume that if the Traffic Study
indicates a needed change, it would be accommodated. The
changes made in the Traffic Study would be within the
boundaries so it would not be necessary to go through
this particular process again.
After other comments from Council, the Mayor read the
Resolution as follows:
BE IT HEREBY RESOLVED That the Mayor and Council of
the City of Caldwell, Idaho, adopt the 11 2005 Caldwell
Urban Boundary and Functional Classification System Map"
as the official urban area and street classification map
for said City of Caldwell.
MOVED by Houchins, SECONDED by Earl to pass the
Resolution authorizing the adoption of the 11 2005 Caldwell
Urban Boundary and Functional Classification System Map ".

(FINANCIAL STATEMENT)
Councilwoman Earl reported that the Finance Committee has
reviewed current accounts payable in the amount of
$446,031.24 for the period ended February 14, 1996, and
a net payroll of $105,490.83 for the pay period ended
February 3, 1996.
MOVED by Earl, SECONDED by Langan that accounts payable
in the amount of $446,031.24 represented by check numbers
46235 through 46452 and payroll for the amount of
$105,490.83 represented by checks number 54493 through
54605 be accepted, payment approved, and the vouchers
filed in the Office of the City Clerk.

(COMMITTEE REPORTS)
Councilwoman Earl reported that she attended the
Community Services Board Meeting. Councilman Houchins
spoke to the Board regarding the Events Center.
(MAYOR'S COMMENTS)
The Mayor reported that a meeting was scheduled tomorrow
morning with the Nampa City Council to discuss the Idaho
Power Franchise; the New Ways Worker has requested that
the City consider participating in a summer youth
employment program; attended along with Councilman Evans
the Chamber of Commerce Board Retreat in Sun Valley.
At this point, Councilman Evans reported briefly on the
meeting in Sun Valley.
In addition, the Mayor stated that he met with T.C.I.
Cablevision people regarding their Franchise Agreement;
a Town Meeting was held on the 13th pertaining to the
Fire and Police Departments; the Traffic Study was going
forward; met with the Senior Center Board to talk about
the Hispanic population and extending them an invitation
to use the Center; a letter was received from the Canyon
County Sheriff's Office informing the City that they were
starting an inmate labor detail; the City of Bellevue
sent a letter to all Idaho Mayors asking for financial
support for those cities that have been flooded.
Councilwoman Earl reported briefly on the new Bill being
introduced with regard to annexations.
Since there was no further business, the Mayor adjourned
the Regular City Council Meeting at 8:25 p.m.

EXECUTIVE SESSION
CALDWELL CITY COUNCIL
FEBRUARY 15, 1996 - 6:00 P.M. - CITY HALL
The Roll was called with the following members present:
Houchins, Evans, Earl, Langan, and Wells. Also in
attendance: Mayor Winder, City Attorney Richard Harris,
and the Mayor's Assistant Robert Vasquez.
(DISCUSSION OF POSSIBLE LITIGATION)
Pursuant to Idaho State Code, Section 67 -2345, the
Caldwell City Council, met in an Executive Session as
called by the Mayor and properly noticed for the purpose
of discussing possible litigation with regard to a real
estate matter.
(ADJOURN)
After discussion, the Executive Session was adjourned.
