The Council met pursuant to recess and acknowledgment of notice in the following form: We, the undersigned Mayor and Members of the City Council of the City of Caldwell, Idaho, do here- by acknowledge notice of a Recessed Meeting of the said City Council to be held in the Council Chambers in the City Hall in the City of Caldwell, Idaho, at the hour of 8:00 P. M„ on the 20th day of February, 19 in for the transaction of all business in connection with the following object: New and Unfinished business. Witness our signatures this 20th day of February, 1967, — T, mayor Mayor N. K. «Coley" Smith presiding. Upon Roll Call, the following Councilmen answered present: Charles C. Banks, James W. "Bill" Keys, William S. Harrison, Charles W. Carpenter and V. Jay Martin. Absent: C. A. "Chet" Davenport. Vacation of Maple Street Dean Dennis, representing the School Board of the Gem State Grade School reported they are anticipating spending about $7$,000 for new school buildings. At the present time they own Block 19, College Heights Addition and have had the opportunity to buy half a block lying north of Walnut Street which will tie in with their present property if they can get the City to vacate that portion of Walnut Street. This street is not open at the present time. After a brief discussion, it was moved by Council- man Martin, seconded by Councilman Carpenter that the City Attorney prepare an Ordinance for the notice of f vacation of Maple Street between Wisconsin Avenue and Ohio Avenue in Block 16, College Heights Addition. A vote was taken and the motion passed. The Mayor informed Ms. Dennis that it is customary for the beneficial parties to pay the advertising costs, and that it wand be a matter of at least 30 days before a definite determination could be made. Mr. Dennis thanked the Council and left the meeting. Airnort Improvement Program J. L. Driscoll, of the Caldwell Airport and Jim Syme of the Aviation Committee of the Chamber of Commmree were recognized by the Mayor and presented the following proposed six -point improvement program for the coming year: 1. 300 foot runway extension, cost of material. ML5.00 with the work to be done by the City. This would make a total runway length of about 3,000 feet. Move the threstihold lights as far West as possible, which would be 200 feet from where they are now. Add two new runway lights, one on each side. I A taxiway extended on the and of the 600 foot extension at a cost of approximately $727.00. Also gravel a strip at the end of the taxiway 30 wide by 750 long. Cost of gravel $1h5.00. Total cost of material around $1$17.00 to be subsidized out of street department budget. 2. An additional parking and tie -down area south from McCur77 Hangar and Madden's Hangar, 223 between it and the taxiway area. This would give 18 more tie downs 240' x 240 which the 3 taxiways. Cost - $1920 plus drains at approximate cost of $535.00 3. Scheduled maintenance plan for Airport which would include mowing weeds, sweeping the taxi -ways, etc. Mr. Driscoll suggested the taxi -ways and ran -ways should be swept at least once a month and the mowing done more regularly. 4. Seal coating of the existing taxi -ways and aoron in front of the administration building, which is breaking up quite badly. Cost - approximately $900.00. 5. Close gate off by the old shop building and move the spray operation, which will necessitate moving the fence. 6. Build a fence between the street right -o£ -way and Kit Manufacturing Co. to keep Kit Manufacturing Co. employees out of the existing tie -down area. This would prevent possible damage to narked planes and petty theft. Approximate cost - $280.00. After a brief discussion, the Mayor stated the plans would be considered and while he felt sure they could not all be taken care of this year, he and the Council would do all they could to take care Of as many of the projects as possible from this year's budget. Renewal of Idaho Service Leasc A renewal of the Lease between the City of Caldwell and the Idaho Service Company dated April 20, 1967, expiring April 20, 1970 located at 605 Main St on the second floor of the Police 9uilding was presented to the Council by t;he City Attorney. It was moved by Councilman Keys, seconded by Councilman Banks that the Mayor and Clerk be authorized to execute the lease. A vote was taken and the motion carried. Wet Garbage Agreement Renewal A renewal Agreement dated February 20, 1967 and expiring December 31, 1967 between the City of Caldwell and W. W. McDowell for collecting and disposing of Green Garbage was presented to the Council by the City Attorney. It was moved by Councilman Harrison, seconded by Councilman Banks that the agreement be accepted and the Mayor and Clerk be authorized to execute this contract. A vote was taken and the motion carried. Sundowner Sign The City Attorney reported that briefs had been submitted in the Sundowner sign case bat that there is a legal waiting period of 6C days before a decision has to be made. Shit to abate a nuisance at 9th and main St. The Mayor asked the City Attorney for a report on the property at the corner of Main Street and Ninth Avenue South - Lots 11 and 12, Block 77 of Original Townsite - noon which there is an excavation making for a very dangerous situation. The Attorney replied he was prepared to file a suit against the responsible parties. After a brief discussion, it was moved by Councilman Martin, seconded by Councilman Keys that the City Attorney be authorized to file a suit in District Court of Canyon County against Tri West Constmction Company of Boise to abate a nuisance. A vote was taken and the motion carried. Clerk for Police Court The following portion of the Proposed Police Court Budget for 1967 asking that a Police Clerk be added to the Police Court Department was read by the Mayor; Honorable N. E. Coley Smith, Mayor Member oft he City Council Caldwell, Idaho Res Police Court proposed budget for the year 3.967 February 17, 1967 Gentlemen: As the Chief Judicial Officer of the Judicial Branch of the City of Caldwell, State of Idaho, I submit herewith a proposed budget for the fiscal year of 1967 for the Police Court of the City of -- Caldwell. Initially, I am sure you will observe the proposed 'increase over the budget for the year 1966. Primarily, this increase is reflected in the employment of a Court Clerk, together with the obligations assured by the city for a new employee. It is proposed a Court Clerk be hired at a salary of $3600.co per year on a full time basis, and in my opinion this addition to the budget and employment of a clerk is well justified in light of the existing circumstances. I an now entering into my sixth year as the Police JudFe for the City of Caldwell, during which time no revolutionary changes have taken place in the operation of the Judicial Branch of the government of the City of Caldwell. It is now proposed that a clerk be hired on a frill time basis, working five days a week, receiving the salary as pronosed and assuming the following duties and obligations: 1. To provide a judicial officer to be present in court throughout the normal working hours each day of the working week as required by law. 2. To receive and issue receipts for all bail bonds posted daring the normal working hours. 3. To be accountable to the City Clerks office for all mono" received as clerk of the court. 4. To keep adnouate records in respect to the fines and costs le•ried against defendants, and to sake a daily transfer of these funds to the City Clerk. I _ 5. To prepare the docket entries of all court proceedings taken so as to insure adequate and competent records for the judicial branch of the city government. 6. To attend court and record pleas of defendants and judgments of the court and fines imposed. 7. To notify all defendants, counsel and prosecuting attorneys of trial dates. To prepare and issue subpoenas to witnesses. To assist in summoning a Jury. To prepare proper verdict --,l 225 and attest to the normal functions of a Clerk of Court in a jury trial, 8. To prepare an adequate index to the police court dockets, maintaining the police court dockets in a current condition. To prepare the necessary documents and orders in respect to appeals from the police court. y. To provide secretarial service to the Court in respect to court minutes. To maintain adequate files in reference to all complaints and warrants of arrest and citations issued and anpearances made by or on behalf of the accused. 10. To maintain and preserve adequate records of all complaints made to the Court upon which no warrant of arrest was issued. 11. To maintain, protect and preserve all matters of evidence admitted into evidence on trial before the police court for proper transfer to the District Court in the event of an appeal. 12. To prepare certificates of service and claims for witnesses and jurors attending court proceedings, as well as claims for interpreter's fees. 13. To maintain and prepare tar reports to the Department of Law Enforcement as required by law, and to maintain and submit the annual - eoorts to the court administrator of the Supreme Court of the State of Idaho. The foregoing is not submitted as a comDlets list of the duties and functions of the Court Clerk, but only those that are Presently apparent and necessary. Additional duties in the future would naturally arise. The office of the Judicial Branch of the city government; The primary function of the judicial branch of the city government is to provide justice to the citizens of the city, and to those who are accused of crimes within the jurisdiction of the court; and as an incident to this function, the court collects as bail fines and forfeitures moneys in excess of $20,000 per year. Although the Court is not a revenue producing agency, it still handles a great deal of funds and has the responsibility of these funds and provision should be made for the appoint— ment of a clerk to handle the bulk of these funds during the normal business hours of each day, rather than imposing this responsibility upon the police department. I also might state, from my own personal observations, from a public relations standpoint, and from the standpoint of administration of justice, the payment of a fine through the Clerk of Court, or bail forfeiture through the Clerk, is not nearly as oppressive to the public as the payment of moneys through a police officer who may have been the same officer who issued the citation. I respectfully submit that this proposed budget be granted consideration so that we may at least be in somewhat of a comparable position to the surrounding city in the administration of justice, even though our police court salaries are $200.00 a month less than our sister city of Nampa, Idaho. Respectfully yours, /s/ Richard Rosenberry Richard Rosenberry Police Judge RR:MN The City Attorney stated he thought the Police Judge has a point in making this request but that he also thought it might be a dual positicn- -one that ml;,ht be performed by someone already employed in the Police Department. He mentioned that in Nampa the girl only worked half days. The Mayor suggested it might be a part Lime job an older retired person could do. It was pointed out by the Attorney, however, that this was a clerical job and one which most older People would not be qualified to handle. The Mayor stated he felt there was sore merit in the request, but that if possible it should be done on a part time basis for if another full time personnel was needed he thought it had better be another officer. The Attorney pointed out again twat it would have to be someone who could do clerical work, and that no doubt some of the various reports that have to be prepared in the Police Department could also be handled by this person. Mayor Smith stated he would discuss the matter further with the Chief Hof Police and renort to The Council. Resolution No. 6 - Salaries Councilman Martin sconsored the following Resolution and moved its passage: RE90LL - -10N NO. 6 BY COUNCILM- M WHEREAS, It appears to be equitable and necessary under existing economic conditions that certain salaries and wages of the employees of the City of Caldro: all which are rot otherwise set and determined by Ordinance should be adjusted by the Mayor and Council of the City of Caldwell. I approve disposition of these temporary water records in accordance with Section 50 -2011 of the Idaho Coda, and that the City Clerk be authorized to destroy the records in compliance with said Code. A vote was taken and the motion carried. FCC License The Mayor presented to the Council a request regarding application for a license from the Federal Communications Commission to operate an aeronautical advisory radio station in connection with the airport now operated by Flight Service, Inc. After a brief discussion, a motion was made by Councilman Banks, seconded by Councilman Keys that the license be approved for a five year period, subject to a provision requiring the assigning of this radio right in the event the Present airport operators contract is not renewed at the and of this year. A vote was taken and the motion carried. The City Attorney was asked to prepare the contract. Golf Beard of Control i The following letter from the Golf Board of Control was read by the Mayor: i Caldwell, Idaho February lh, 1967 The Honorable Coley E. Smith Office of Mayor Caldwell, Idaho Subject: Regulations Governing Use of Caldwell Golf Courses for Schools Dear Sir: Rae to a few unpleasant incidents on the golf course this past summer and to the ever increasing use of the courses requested by the schools, the Board of Control is submitting the attached regulations which we request be given consideration for handling of this problem. We are submitting two copies of regulations adopted at our last Board of Control meeting. An annual fee of $25.00 will be required for each of the following activities: a. Golf Teams b. ?. E. Classes 2. Schools must furnish a list of eligible participants. List will be limited to eight, after April lat. 3. Schools must furnish an advance schedule of inter - school matches. 4. Free practice permitted only Monday through Friday. On league nights, l school participants may not tee off after 4:30 p.m. 5. Participants must sign register at Club House before play. 6. Irregularities occurring during practice sessions will be reported to coaches for correction. 7. All infer- school matches must be supervised by the host coach. B. Free golfing privileges, during inter - school matches, for visiting coaches Will be limited to one for each foursome entered from his school and a maximum of two. 9. Golf teams will use only Purple Sage Course. P. E. Classes will use only i l it Fairview Course. After an explanation by the Mayor of the incidents relating to the reasons for these controls, a motion was made by Councilman Martin, seconded by Councilman Banks that these regulations be adopted. j A vote was taken and the motion carried. 228 ulance Service The following letter was read from Walter Fry, County Clerk & Auditor of Canyon County: i February 10, 1967 City of Caldwell John L. Englehart City Hall Caldwell, Idaho Gentlemen: Per agreement entered February 7. 1966 with Midway Ambulance service and Canyon County, $650.00 per month was to be naid to hadway Ambulance Service by Canyon County. Of this Canyon County was to be reimbursed from the City of Nampa and the City of Caldwell at the rate of $75.00 each per month until the end of the fiscal year, ending December 31, 1966, The amount due from your office is $75.00 for 10 months or a total of 3750.00. Preliminary Plat - Terrace Addition No. 2 City Engineer Melvin Lewis presented a preliminary plat of a subdivision to be called Terrace Addition No. 2. This plat had been approved by the planning commission. After a brief discussion on the naming of two streets within the Addition, a motion was made by Councilman Banks, sedonded by Councilman Harrison that the preliminary plat be apnroved. A vote was taken and the motion carried. Bartender Permits Approved Applications for Bartender Permits for 1967 from Sue E. Burnie, Philip Barrett, Jewell Story and William Alan Markle were presented for the consideration of the Council. Each apnlication bad been approved by the Chief of Police and were accompanied by a receipt from the Clerk for the required fee, It was moved by Councilman Martin, seconded by Councilman Banks that the applications for Bartenders Permits be approved and permits be issued. A vote was taken and the motion carried. Canopy - Garber Motor Co. The following letter was read by the Mayor: Garber Motor Company 903 Cleveland Boulevard Caldwell, Idaho Dear Sire: February 3, 1967 Attention has been called to the Office of the Building Inspector that the time alloted by the City Council at the council meeting of August 23, 1965, to move the canopy at your used car lot back to the property line terminated on September 1, 1966. Failure to comply with the Council's instructions undoubtedly has been an oversight as time moves more rapidly than realized. In view of the mild weather, I feel that this would be an excellent time to accomplish this. Please contact me at this office within five (5) days of receipt of this letter to make arrangements for a definite date of completion. The regular monthly meeting of the City Council met in tha Council Chambers of the City Hall with Mayor IS. E. "Coley" Smith presiding. Upon Roll Call, the following Councilmnen answered present: James W. "Bill" Keys, V. Jay Martin, Charles W. Carpenter, and C. A. "Chet" Davenport. Absent: Charles C. Banks and William S. Harrison. Representatives of Boy Scou. Troop welcoed Mayor Smith welcomed members of Boy Scout Troop No. 266 sponsored by the Church of Jesus Christ of Latter-day Saints in Caldwell. The boys were working on merit badges for citizenship in the comaanity and were accompanied by Mr. Joel Brown. Sale of Bonds of Local Improvement District No. 59 The City Attorney informed the Council that there had been a series of bidders for the Bonds of Local 1norovement District No. 59; this being the time set for sale, and they had made manifest to the City Treasurer their desire to bid the bonds with the maturities all at 5% per annum. It being determined that no one was present for this meeting for the purpose of bidding the bonda; Councilman Carpenter sponsored the following Resolution and moved its passage: i RESOLUTION NO. 7 _ BY COUNCILMi N CARPENTER A RESOLUTION CoNT'IRMING THE SALE, ISSUANC,-_ PRINTING, 'E7ZCUTION AND DELIVERY OF THE BONDS OF LOCAL IMPROVE- MENT DISTRICT N0. 59 OF THE CITY OF CAIDWELL, IDAHO, TO THE PURCHASF:S.S THEREOF. WHEREAS, The City of Caldwell, Idaho, on the 6th day of February, 1967, at the hour of 8e00 o'cloc. u. M., pursuant to due and legal notice did offer for sale the bonds of Local Improvement District No. 59 of the City of Caldwell in the principal sum of $30,500.00, and WHEREAS, Bids were received from seven bidders to purchase said bonds at their principal amount with a rate of interest thereon at five per cent per annum, with the purchase money therefore being tendered with the bid, and the Mayor and Council by motion having accepted the bid of said persons as being the only .and best bid therefor, and WffEREAS, Since said action of the City Council, said bonds have been printed, issued, executed, and delivered to the purchasers therefor, and it appears desirable that the action of the City officials in this connection be ratified, approved and confirmed; NOW, THEREFORE, BE IT RESOLVED By the Mayor and Council of the City of Caldwell, Idaho: Section 1. That all acts heretofore taken by the Mayor and Council of the City of Caldwell, Idaho with respect to the issuance, orinting, sale, execution and delivery of the bonds of Local Improvement District No. 59 of the City of Caldwell, Idaho, to the purchasers thereof, be and the same is hereby ratified, approved and confirmed.
