Those voting in the affirmative wares Vassar, Blomquist, Shorb, Luby Eldredge and Finley. Negative: None. Absent and not voting: None. Thereupon the Mayor declared the motion Carried. Moved by Blomquist, seconded by Shorb final payment on contract with C. W. Watkins & Son be ized with the exception of $1000, to be held until minor adjustmebts are made. Upon Roll Call it appeared the motion was unanimously carried. The following letter was read from Dunlap & Rettig: Miss Ada Hartenbower City Clerk Caldwell, Idaho For the Attention of the City Council Rat Firs, Ara Garland, 2124 S. Michigan Avenue, Caldwell, Idaho My file #2795 Gentle-en: February 10, 1958. I represent Mrs. Ada Garland of 2124 So. Michigan Avenue, Caldwell, Idaho who was injured an Decemberl5, 19$7 when she fell into a hole in the street in front of her premises left by the employees of the City of Caldwell after the installation of a water meter. At that time , according to her doct-r, Gerald E. Wesche, M. D. of Nampa, Idaho, she received an avulsion of a piece of bone from the os calcis of the right foot, and a severe bruising of the left arm at the insertion of the deltoid. The injury to the ripht foot resulted in considerable damage and swelling of the soft tissue of the foot and ankle, and by reason of this injury she as totally disabled from doing any of her housework or participating in her usual activities from December 15, 19$7 until approximately February 1,1958. According to Dr. Wesche she also suffered shock and by reason of her ale, which is 67 years, has been considerably disturbed and upset mentally by reason of this accident. At the time of the accident she was rendered unconscious and was taken to the Samaritan Hospital in Nampa where she was first examined by Dr. Wesche. Dr. Wescha estimates that she has a per- . manent partial disability of at least 5% as compared with the loss of her right leg at the hip. By reason of these injuries Mrs. Garland has incurred s bill with Dr. Wesche in the amount of Fifteen (815) dollars, and a bill w;th the Samaritan Hospi al at Nampa of Sixteen (4-16) dollars and in addition to said expenses has been further damaged in the sum of Five thousand ($5000) dollars, by reason of her permanent partial disability, shock, permanent disability for the time above indicated and for her vain and suffering. By reason of the above and foregoing, claim is hereby made on behalf of Mrs. Garland of the City of Caldwell for the sum of Thirty -one ($31) dollars special damages, and Five Thousand ($5D00) dollars general damages. In the event this claim is not allowed within sixty (60) days from the recei t:ne�eof by you, and action will be filed by me on behalf of Mrs. Garland in the District Court of the Seventh Judicial District of the State of Idaho in and for the County of Canyon for recovery of the damages incurred by hers. The Council met pursuant to call and acknowledgment of notice in the following form: CALL AND ACKNO'WLED(99ENT OF NGTICE Ia We, the undersigned Mayor and Members of the City Council of the City of Caldwell, Idaho, do each 'I hereby acknowledge notice of a snecial meeting of the said City Council to be held at the Council Chambers in the City Hall in the City of Caldwell, Idaho at the hour of 5:00 o'clock P. The Mayor informed the Council this was the time set for receiving and opening bids for Control Structure for Outfall Sewer Line at Dairymen's Co -op Creamery. II The following bids were opened and read: A. L. Bruick 4 694.00 J. 0. Young & Son 658.00 Don Stewart 573,77 Moved by Vassar, seconded by Shorb the City accept the bid of Don Stewart, subject to the ap- proval of the City Engineer. Upon Roll Call it a -eared the motion was unanimously sl carried. II I The City Engineer reported that he had checked the petitions filed with the Mayor and Council, November hth, 1957, petitioning the creation of a Local Improvement District for the purpose of constructing, curb, gutter and oiling and found that more than 60% of the property owners within the proposed district had signed the petition. No further action was taken on the petitions at this time. Councilman Luby reported a gift to the City from the Soroptimist Club of 88500.00, to be used for lighting the North -side Play Ground. I. There being no further business to come before the Council it was moved by Councilman Shorb, seconded by Councilman Eldredge that Council adjourn. Motion carried. � 7 J , Mayor. City Clerk COUNCIL CHAMBERS MARCH 3, 1958 8.00 P. M. The Regular Monthly Meeting of the City Council met in the Council Room of the City Hall, with the Mayor, Ed Simmerman presiding. Upon Roll Call the following Councilmen answered present: E. L. Vassar, Fran Blomquist, Max Luby, Emile Shorb, L. P. Eldredge and Leland Finley. Mayor Ed Simmmerman presiding. Rev. Hayman was present regarding the opening of an alley between Colorado and College, Oak and Ash. Rev. Hayman stated at present the alley was not opened and he wes using it for a garden and if the alley was to be opened he would appreciate kno in advance. This was referred to Councilman r - inlay and City Engineer. The Mayor informed Rev. Hayman he would be notified if the alley was to be opened. A petition was presented to the Mayor and Council, signed by property owners, petitioning the Mayor and Council to create a local improvement district for the purpose of constructing curb, gutter and standard road mix on Maple Street from Colorado Avenue to College Avenue, Colorado Avenue from Ash Street to Linden Street, Oak Street from Montana to College.
