M.'B'ettis.'.Abeents 'Ernest Weick City Engineer reported that he had checked the petition filed with the Mayor and Council petition- ing the creation of a sewer district on GanYon Hill and found that more than 60% of the property owners in the proposed district had signed the petition, also, he had checked the property descriptions and had made an estimate of the cost. Upon motion by Myers, seconded by Bettis the following Resolution was preposedt RESOLUTION BY COUNCILMAN WEICK. NOW, THEREFORE, Be it resolved by the Mayor and Council of the City of Caldwell, Canyon County, Idaho: Section 1. That it is hereby declared to be the intention of the Mayor and Council of the City of Caldwell, Canyon County, Idaho, to create and establish within said city a local improvement district for sewer to be known as and called "Local Improvement District No. 19 for the City of Caldwell." Section 2. That said proposed improvement is an original improvement and the general character or improvement to be made in the said proposed improvement district is the purchasing, building, and constructing of sewers, ditches, drains, conduits, and channels for eanitary and drainage purposes, or either or both thereof, with outlets, cesspools, manholes, cgf<oh basins, flush tanks, septic tanks, and all other sewer appurtenances necessary for the comfort, convenience, health and well-being of the municipality on hand contained in said improvement district, to be constructed of sewer tile, Portland Cement, concrete, earth, sand, gravel, stone and such excavation as may be necessary, all in accordance with the plans and specifications therefor to be hereafter adopted by the Mayor and Council of the City of Caldwell and placed on file in the office of the City Clerk of the City of Caldwell. Section 3. That said local Improvement District No. 19 shall constitute and include all of the lots and lands abutting, adjoining, contiguous and adjacent to said improvements and all of the lands and lots benefited by such improvements within the following boundaries, to -wit: Beginning at the point of intersection of the center line of the Cemetery.Road and the North line of Savanah Street, Meadow View Addition, Caldwell, Idaho, and running thence West on the North line of Savanah Street to the East line extended of Lot 23, Block 3, of Meadow View Addition, thence North and on the said East line extended a distance of 125 feet, thence West and parallel to the.North line of Savanah Street a distance of 198.0 feet to the center line extended of Rice Road, thence South on the said center line to the center line of Rochester Street, thence East on the center line of Rochester Street to the East line extended of Lot 10, Block 3 Meadow View Addition, thence South on said extended lot line to a point 125 feet South of the South line of Rochester Street, thence East and parallel to the South line of Rochester Street to the East line extended of Lansing Ave., thence South on said extended East line to the Northeasterly line of Quincy Street, in Golden Gate Addition, Caldwell, Idaho, thence Southeasterly on the said Northeasterly line to the West line of Cemetery Road, thence South on the said. That the estimated cost of said improvements herein provided for is $27,200.00. section 5. That the cost and expense of the construction of said improvement shall be assess- ed upon the abutting, adjoining, contiguous and adjacent lots and lands benefited and included in the improvement district formed, each lot and parcel of ]and being separately assessed in proportion to the number of square feet of such lots and lands abutting, adjoining, contiguous and adjacent thereto or included in the improvement district to the distance back from such street, if platted in blocks to the center of the block, if platted in lots, to the center of the lots, and if not platted, to the distance of 125 feet, and in proportion to the benefit derived to such property by said improvement, sufficient to cover the total cost and expense of the work, the cost and expense to be assessed as herein provided for, which includes the contract price of the improvement, engineering and clerical services, advertising, cost of inspection, cost of collecting assessments, interest upon warrants if issued, and for legal services for preparing proceedings and advising in regard thereto. Section 6. Pursuant to Section 50 -2906 of the Idaho Code the total costs and exepnses of all improvements within the intersections in Local Improvement histrict No. 19 shall be assessed against all of the property in said district in proportion to the benefits derived from such improvements. Section 7. The Mayor and Council of the City of Caldwell shall assume and retain full and complete jurisdiction of all construction work necessary to construct said necessary improvements and to do the same by con ( tract or otherwise as provided by law. The committee on sewers, together with the City Engineer shall, under the direction of the Mayor and Council, supervise said construction work and see that the same is done in strict accordance with the plans and specifications provided by the City Engineer and . approved by the City Council and such contracts as may be hereinafter entered into by said city and those to whom the contracts may be awarded after due notice for bids has been published as provided by law. Section S. That all the property owners who may desire to protest against the making of said improvements and against the creation of said improvement district, may file such protests against the said improvements in the office of the City Clerk of the City of Caldwell, at any time before 5:00 o'clock P.M., on the 3rd day of Maroh, 1952, and that the city council of said city will meet on the 3rd day of March, 1952, at the hour of 8 :00 o'clock P.M., in the City Council Chambera, in the City Hall in Caldwell, Canyon County, Idaho, the authorized and usual meeting place, to hear and pass upon such protests thereto- fore filed and determine whether or not to proceed with the proposed improvements. Section 9. That the City Clerk is hereby authorized and directed to give due and legal notice thereof and of the time within which protests against said proposed improvements or the creation of said district may be filed, and the date when said protests will be'.heard and considered by the Council, which notice shall describe the general character of the improvements proposed to be made and the estimated total cost thereof, and shall cause notice to be published in three consecutive issues of The Caldwell News - Tribune, a daily newspaper printed and published in Caldwell, Canyon County, Idaho, the official newspaper of said city, the last publication thereof being at least five days preceding the 3rd day of March, 1952, being the date fixed in this resolution within which protests may be filed; and said City Clerk shall cause the publisher's affidavit of said publication to be filed irw herroffice on or before the time herein fixed for the hearing of such protesta; a copy of such notice shall be mailed at least five days preceding the 3rd day of March, 1952, to each owner of property, if known, or his agent, if known, within the limits of said proposed improvement district, addressed to such person at his post office address, if known, or if unknown, to the post office of the City of Caldwell where said improvements are to be made; proof of publication of said notice in said daily newspaper must be filed with the City "lerk of the City of Caldwell, Idaho, and the City Clerk of the said City of Caldwell must make and file in her office the affidavit showing the filing and mailing of such notices, said notice to be given by the said City Clerk of the said City of Caldwell and shall be in substantially the following forms m NOTICE � *wt OR Notice of passage of resolution declaring the intention of the Mayor and Council of tha 1 M i City of Caldwell, Idaho, to create and establish Local Improvement District No. 19, for the purpose of constructing a sanitary sewer system with necessary appurtenances thereto in said district and fixing the time within which protests may be filed in the office of the City Clerk and the time when the same will be heard and considered by the Mayor and Council. That the estimated cost of said improvements provided for in said resolution is the sum of $27,200.00, said improvements to be constructed of pipe, Portland Cement, concrete, earth, sand, gravel, Stone and such excavation as may be necessary, which resolution is on file in the office of the City Clark of the City of Caldwell, to which reference is hereby made for further information Yn regard thereto. Notice is further given that owners of lands and lots within the boundaries of the proposed improvement district who may desire to protest against the making of said improvements or against the creating of said improvement district may file such protest in writing in the office of the City Clerk at any time before 5:00 o'clock P.M., on the 3rd day of March, 1952, and the Mayor and Council will meet in the City Council Chambers in the City Hall of the City of Caldwell, Idaho, the authorized and usual meeting place, on the 3rd day of March, 1952, at the hour of 8:00 o'clock P.M., to hear and consider all such protests theretofore filed and determine whether or not to proceed with the said proposed improvements. That bonds shall be issued and sold to meet the payments of the costs and expenses of said improvements within the boundaries of Local Improvement District No. 19, which is chargeable to the abutting, adjoining, contiguous and adjacent property and shall be paid for in ten equal annual installments, first installment to mature within one year from date, and the last installment in not more than ten years j from date, and shall be numbered from one (1) upwards, consecutively, and shall bear interest payable semi- annually and said bonds may be sold at not less than par value and the city, for the purpose of meeting the costs and expenses of such improvements as the same are installed prior to the sale of said bonds, will 1 Ra issue warrants against the improvement , payable to the contractor or the proper person, upon estimates of the City Engineer bearing interest at the rate. of not to exceed seven per cant per annum, which warran together with the interest thereon at the date of the issue of said bonds shall be redeemed and retired f the proceeds of the sale of said bonds. Section 11. That the construction of said improvement is necessary for the immediate pre— servation of the public peace, health and safety and therefore an emergency exists and this resolution shall be in full force and effect from and after its passage and approval.
