The Council met pursuant to call and acknowledgment of notice in the following form: CALL AND ACKNOWLEDGMENT OF NOTICE We,. the ruundersigned Mayor and members of the Citr Council of the City of Caldwell, Idaho, do each hereby acknowledge otice of a special meeting of said City Council to he held at the Council Chambesr in the City Hall it the City of Caldwell, Idaho, at the huur of 8:00 P. M. on tht 17tK, day of February. 79531 L for tr:e transaction of all business in connection with the following object: Opening of Bids for the construction of L. I. D. No 20, sewer. S presi 'a . •Upon Noll Call the followi g C uncilmen answered present: Fran Blomquist, L. E. Burrell, John I Myers,Ernest Weick, Dale i'enrich an d J. Bettis. . This being the time set by notice for receiving of bids for constrneti.on of a sewer system in Local Improvement District # 20. One bid was received as follows: C. L. Strang 3 17, 885.25 This bid was examined by the Mayor and Council and the City Engineer. RESOLUTION By Councilman. Myers. Moved by Councilman Blomquist, seconded by Councilman Weick that the following R be adopted: WHEREAS, C. L. Strang of Nampa, Idaho has presented a bid in the amount of $ 17,885.25, for the construction of a sewer system in Local Improvement District N 20, and WHEREAS, it appears to the best advantage of the City of Caldwell to accept this bid; NOW, THEREFORE BE IT RESOLVED that the Mayor and City Clerk, on behalf of bbe City of Caldwell be authorized to execute a contract agreement with Mr. C. L. Strang for laying sewer in Local Improvement District # 20. Upon Roll Call the following Councilmen voted in the affirmatives Blomquist, Burrell, Myers, Weick, Fenrich and Bettis. Negative: None. Absent and not voting: None. Thereupon the Mayor declared the motion carried and the Resolution adopted. Application for Beer License was read from the Fraternal Order of Eagles, the fee accompanying the application. Moved by Burrell, seconded by Blomquist that this License be granted. Upon Aoll Call it appeared the motion was unanimously carried. The City Engineer informed the Mayor and Council that Mr. Lee Huggins of Boise would prepare a plan and an estimate on the coat of bridging Indian Creek from Seventh Avenue to Sixth Avenue. Moved by Blomquizt,.aeconded by Weick that the City Engineer be authorized to have Mr. Huggins prepare this estimate and plan. Upon Roll Call it appeared the motion was unanimously carried* The Mayor informed the Council that the Safety Committee of the Chamber of Commerce had requested permission to place an "Entering Caldwell" sign on the Roy Abe property near the new Boise River bridge on Highway 30. J 1 ]Ig It was unanimously agreed by the Council that a plan of this sign be presented to the Mayor and and Council for their consideration. City Attorney, rim F. Gigrimy, Jr., inquired of the Council as to whether,or not formal easements should be' obtained from the persons whose property is crossed by sewer lines in local improvement districts. Attorney Gigray stated that such were not obtained in the past and he had in mind particularly, Local Improvement District # 19 as five of the lines in that district pass through private property being served b the district, that the same situation.will apply to Local Improvement District # 2J. Mayor Smith then called upon Gity Engineer Lawrence Porter as to the city practice in the past and Engineer Porter stated that formal easement's had not been retpd.red as no opposition had ever been voiced in the passage of a sewer line through the property of persons being served by it. He further stated that maintenance of,the lines after once laid presented no problem because the lines are cleaned from manholes. After a discussion by the council of this problem the following resolution was proposed by Council Weick. RESOLUTION By Councilman Weick. Resolved that the City Attorney of the qty of Caldwell is instructed that formal easements need not be obtained in connection with sewer lines passing through private property where the same is laid with consent of the property owners In connection with local improvement districts. Moved by.Councilman Wers, seconded by Councilman Bettis that this R solution be adopted. Upon Roll Call it appeared the motion was unanimously carried. Thereupon the Mayor declared the Resolution adopted. There being no further business to come before the Council it was moved by Councilman Fenrich, seconded by Councilman Rurfell that Council adjourn. Motion carried. Mayor. In compliance wit;: your verbal r_(uest, 1 have prepared a preliminary estimate of cost for nhanging the charnel of India: Creek to a location in Blai:se` Avenue are? bridging the creek from tine westerly line of Seventh Street to the northerly line, of Bl ne west of Sixth Street, a length of approximately 640 feet. The cost of this work is estimated to be L'ne Hundred Ninety Five Thousand Dollars 0155,000) includir:g engineering. .This estimate is based on a reinforced cm erete structure providing a 33 foot width of water way with foundations approximately si c feet below bottom of channel and supported on timber foundation piles.
