Council met in regular session pursuant to adjournment with Mayor
Ward presiding, the following councilmen were present;
Dickens Dunlap Fouling Hayman Moore and Sutton.
The resignation of Wm March was presented and on motion Moore
seconded by Fouling same was accepted.
R W Oakes Jr appeared before the council relative to the oar track
on Indiana Ave. and on motion same was referred to the city Engineer for
investigation and report at neat meeting.
The following resolution was presented;
R E 5 0 L U T I 0 A.
WHEREAS the irrigation ditches as now constructed, maintained
and operated by the pioneer Irrigation District. on the following
named streets and alleys to -wit;
Cleveland from Kimball to 84th. Street
Kimball from Freeport to Irving
Blaine from 7, to 9,
9, from Arthur to Cleveland
are not in conformity with the provisions of Ordinance No 145, approved
October 27, 1909; and.
WHEREAS the said irrigation ditches as now constructed maintained and
operated by the Pioneer Irrigation District are a public nuisance and menace to
the health, peace, comfort, convenience and wall being of the inhabitants
and tax payers and general public of Caldwell;
Noe therefore be it resolved by the Mayor and Council of the o ity of
Caldwell that the said above mentioned irrigation ditches are hereby determined
to be and are a public nuisance and are hereby ordered to be abated and
removed and reconstructed, maintained and operated in compliance w%CX and
conformity with said ordinance No 145 approved October 27, 1909 and with the
ordinances of of the said City of Caldwell and the laws of the state of Idaho.
On motion Dunlap seconded by Sutton 6he above resolution was
unanimously adopted.
On motion Dunlap seconded by Dickens it was voted to extend water mains
400 feet on Indiana Ave t® the House being constructed by 0 H Sovereign.
The petition of H A Griffith at al for the vacation of streets in
Golden Gate Addition along blocks 88, 89,91, and 92 First Avenue and admake
and seventh street between blocks 88, 92 89, 90 and 91 as shown on the
said plat in the city of Caldwell, Canyon County Idhho.was presented and
on motion Dunlap seconded by Sutton same was granted.
The roll call on the motion was as follows;
Ayes; Dickens Dunlap Fouling Hayman Moore and Sutton.
The petition of H W Dorman and others for the establishing of a sewer
District in Arlington Addition was presented and on motion same was granted -
with the understanding that same was to be dumped into the Drain Ditch, tpp
vote on the motion was as follows;
Ayes Diokens, Fouling Hayman Moore and Sutton
Neyes Dunlap.
The petition of 0 0 Robinson for and increase in salary of 50.00 per

was presented and on motion game was tabled.
Ordinance No 332 was read the first time as follows;
ORDINANCE NO 332 ENTITLED
AN ORDINANCE DECLARING THE INTENTION TO CREATE AND ESTABLISH
LOCAL SEWER DISTRICT 30 7 IN THE CITY..OF CALDWELL. STATE OF IDAHO FOR TIE
PURPOSE OF CONSTRUCTING A SUITABLE SEWER SYSTEM AND DISPOSAL WORKS THEREIN.
FIXING THE SPECIFIC BOUNDARIES OF SAID PROPOSED DISTRICT
THE GENERAL CHARACTER OF SAID PROPOSED IMPROVEMM AND THE ESTIMATED COST OF
THE SAME AND PROVIDING FOR SUCH COSTS TO BE ASSESSED AGAINST THE PROPERTY IN
CLUDED WITHIN SUCH SEWER IMPROVEMENT DISTRICT. AND PROVIDING THAT THE COST
AND EXPENSE OF SAID SEWER B[PROVECIF.NTS MADE IN THE PLACES FORMED BY THE
JUNCTION OR INTERSECTION OF STREETS AND AVENUES AND IN THE PLACES OPPOSITE ALL
IN SUCH DISTRICTS SHALL BE BOURNE BY THE PROPERTY ABUTTING. FRONTING.
CONTIGUOUS OR TRIBUTARY TO SAID INTERSECTIONS AND WALL BE A LIEN UPON
SAID PROPERTY THE SAME AS ANY OTHER ASSES&,= AGAINST SAID PROPERTY IN
SAID DISTRICT: AND FIXING THE TIME WITHIN WHICH PROTESTS AGAINST SAID
PROPOSED IMPRBVEMEN.: MAY BE FILED IN THE OFFICE OF THE CITY CLERK: AND
DECLARING THE INTENTION OF THE BAYOR AND CITY COUNCIL OF THE SLID CITY
OF OALDWELL: TO PROVIDE FOR THE PAYMENT OF THE COST AND EXPENSE OF
SUCH DMOVEMENTS BY ISSUING IMPROVENFNT BONDS OF THE SAID DISTRICT: RE
PEALING ALL ORDINANCES. RESOLUTIONS OR ORDERS OR PARTS THEREOF IN CON
FLICT HEREWITH AND DECLARING AN EMERGENCY.
Before arty aotion was taken on the above ordinance IT was
agreed that tiling was to be layed 200 feet beyond where the drain
ditch opens.
Motion made by Hayman and seconded by Dickens that the rule
requiring the reading of an ordinance on three operate dates be dispensed
with and that ordinance So 332 be read the seeond time #1Wj1A by
title and the third time in full and placed on its final passage, the
vote on the motion was as follows;
Ayee Diokene, Dunlap, Fouling, Hayman Moore and Sutton.
Nayse none.
The clerk thereupon read the ordinance the seoond timeby title
and the third time in full and the mayor announced that the ordinance
stood for final Passage and on the roll being called on the mationshall
Ordinance No 332 page the vote was.
Ayes, Dickens, Dunlap, Psuling, Hayman Moore and Sutton
Reyes none.
The Mayor announced that Ordinance No 332 had passed by more
than the neoesearg three fourths and the clerk wag instructed to
make proper entry thereof and cause same to be published in the Ca1dw11

Motion was made by Dua�ap and seconded by Sutton that the rule
regUring the reading of an ordinance on three separate dates be suspended
adn that Ordinance No 333 be read the second time by title and the third
time in full and placed on its final passage, on the roll being called on the
motion the vote was as follows;
Ayes, Dickens Dun3)ap Fouling Hayman Moore and Sutton
The clerk then read the ordinance the second time by title and the
third time in full and the Mayor announced that the ordinance stood forits
Final passage and stated the motion the vote was,
Ayes Dickens, Dunlap, Feuling, Hayman. Moore and Sutton
Neyee none
The mayor announced that ordinance No 333 had passed unanimously and
the clerk was instructed to make proper entry and cause same to be published
in the Caldwell News thr official News paper of the city of Caldwell.
John Smead and C H Turner appeared before the council relative to
drainage on the North side of town. The mayor announced that a committee
had been appointed for this matter and they were requested to meet with
the committee from the commercial club and take such steps as may be deemed
necessary.

The following resolution was presented and on motion Dunlap seo4nded

RESOLUTION BY DUNLAP.

WHEREAS the city of /Caldwell has been notified that the owner
of lots No 9, 10, 11 and lk Block 85 of Original Townsite now city of Caldwell
is building a small temporary building on said premises which said house fronts
on Dloveland Blvd.
And whereas as the Chief of the Caldwell Fire Department has
notified the Council that said building is a Fire hazard and that such
building if occipied as a dwelling house will bee a fire menace to the
surrounding property,
Therefore be it resolved by the Mayor and City Council of said
city that said temporary dwelling house is a fire hazard and is a fire menace
to the surrounding buildings
Be it further resolved that the Chief of the Fire Department
be and hereby is p[ y gf / directed and authorized and instructed to cause
said bullding to be immediately removed from its present location.
The salary committee made the following recommendations in salaries
Teamsters #110.00 per month Sexton $110.00 per month. Driver of Street
Flusher $115.00 per month and SOV per hour for over time Street Cleaner
$100.00 per month
Motion Dunlap seconded by Sutton that report of and reoomm-
endation of committee be adopted.
The Mayor announced the appointment of Earl McCulloch as night
poile and on motion Dunlap seconded by Fouling same was confirmed.
City Clark instructed to advertize for bids for rental for Lake Howard
tract. n/
Motion Sutton seconded by Hayman counoul adjourned to the 23,W4J
