The Mayor and Council discussed assessing liquidated damaged against the contractor.�I There�oon Ceuncil_:an Blomquist moved the City waive liquidated damages against the contractor, seconded by Councilman Shorb. q Councilman Vassar moved the above motion be. tabled until February 15th,5 o'clock P. M., seconded by Councilman Luby. Upon Roll Call it gppeared the motion was unanimously carried. Mayor Simmerman reported Roy Roark and Willard McCleskey had signified their willingness to re- quest the City to annex their properties on West Logan. Mayor Simmerman announced the appointment of Councilman Leland Finley as Council member on the Planning Board. Moved by Vassar, seconded by Blomquist that this appointment be confirmed. it Upon Roll Call it appeared the motion was unanimously carried. Theca being no further business to come before the Council it was moved by Councilman Shorb, ' seconded by Councilman Luby that Council adjourn. Motion carried. Mayor. City Clerk. The following letter was read from Dunlap & Rettig: February 10, 1958. Miss Ada Hartenbower City Clerk Caldwell, Idaho For the Attention of the City Council Re: Mrs. Ara Garland, 2124 S. Michigan Avenue, Caldwell, Idaho My file #2795 Gentle-en: I represent Mrs. Ada Garland of 2124 So. Michigan Avenue, Caldwell, Idaho who was injured on Decemberl5, 1957 when she fell into a hole in the street in front of her premises left by II the employees of the City of Caldwell after the installation of a water meter. At that time , !� according to her doct-r, Gerald E. Wesche, M. D. of Nampa, Idaho, she received an avulsion of r a piece of bone from the os calcis of the right foot, and a severe bruising of the left arm at the insertion of the deltoid. The injury to the right foot resulted in considerable damage ane swelling of the soft tissue of the foot and ankle, and by reason of this in-ury'she ­as totally disabled from doing any of her housework or participating in her usual activities from December 15, 1957 until approximately February 1,1958. According to Dr. Wesche she also suffered shock and by reason of her ae, which is 67 years, has been considerably disturbed and upset mentally by reason of this accident. At the time of the accident she was rendered unconscious and was taken to the Samaritan Hospital in Nampa where she was first examined by Dr. Wesche. Dr. Wesche estimates that she has a per- - manent partial disability of at least 5% as compared with the loss of her right leg at the hip. By reason of these injuries Mrs. Garland has incurred a bill with Dr. Wesche in the amount of Fifteen (815) dollars, and a bill w:.th the Samaritan Hospi al at Nam of Sixteen (816) dollars and in addition to said expenses has been further damaged in the sum of Five thousand ($5000) dollars, by reason of her permanent partial disability, shock, permanent disability for the 1 time above indicated and for her pain and suffering. By reason of the above and foregoing, claim is hereby made on behalf of Mrs. Garland of the City of Caldwell for the sum of Thirty -one (431) dollars special damages, and Five Thousand ($5000) dollars general damages. In the event this claim is not allowed within sixty (60) days from the recei)t t:ne by you, and action will be filed by me on behalf of Mrs. Garland in the District Court of the Seventh Judicial District of the State of Idaho in and for the County of Canyon for recovery of the damages incurred by Mrs. Garland.
