The Mayor requested that everyone stand for the Pledge of .'` Alegi <r ; :o to the Flag. The Roll of the City Council was called with the following members present: Nancolas, Jarboe, Houchins, and Valdes.. Absent: Murdoch and Raymond. (RESOTUTION 71RING '.77 ASSESSMENTS OF THE CALDWELL MUNICIPAL IRRIGATION SYSTEM) Mayor Dakan explained that pursuant to Idaho State Code, 50- 1307, the Mayor and City Council shall on the 2nd Monday of February each year meet and makea.n estimate of the necessary fume=s for the expenses of maintaining, operating, improving, extea - ding and enlarging said City irrigation syste-m for the ensuing calendar year.. Therefore, a Special Meeting was called this time for that purpose. Also, during this meeting, a Resolution wit I be presented to the Council for their consideration which will establish the rates for the irrigation saason. After the rate is .set, the bills are sent out to the property owners wit their assessment. A hearing is then c for no later than March 20th_ to hear protests to the assessments. :'-_'his is not a c'.AZance for users to protest the rates, but to ask questions with regard - to their assessments. A memo was receive- l from - the Irrigation Superintendent to the Mayor and Council as folloe, , ,s: The assessments for operation and maintenance of the Caldwell Municipal Irrigation District for the fiscal year from -- October l., 1990, to September 30, 1991, amount to an estimated total of 5222,000. It wo,,ld be my recommendation that with. $222,000 in operation and maintenance and 5210,OCC in a Miscellaneous Construction Fund carried over from past years, that probably there is rc need for a rate increase at this time. My reasoning behind this recommendation is that we are still uncertain of the District's future course of new construction. I give the Council the assurance that the Ligation Department has the money to accomplish the repair woi : for t1,_i.s coming year. Mayor Dakan sated that he would recommend that the rate continue as was sstablisl -ed last year and that March 4, 1991, be established as the time when the City Council would meet as , Board of Corrections where any person desiring to make objections to the assessment so levied and assessed may appear. The Hearing would be conducted during the Regular C.ty Ccu-, „cil Meeting on i 4, 1,991, at 7:30 p.m. The Resolution was then presented to the City Council as follows: RESOLUTION NO. RESOLUTION FIXING ASSESSMENTS OF THE CALDWELL MUNICIPAL IRRIG .TION SYSTEM FOR T14E YEAR. WHEREAS, This is the time provided by Statute for levying an assessment of the necessary funds for expenses of maintaining,, operating, improving, extending and enlarging the -T „ter w ::ks and system. of "The Caldwell Municipal IrrigaQ on System” for the ensuing fiscal year, upon all lands wi'clin said "Caldwell Municipal Irrigation Syste;, and Book 32 Page 25 WHEREAS, It appearing to the Mayor and City Council of the City of Caldwell, Canyon County, Idaho, that the City Clerk, as assessor of such irrigation system, prior to the fourth Monday in January of the year 1991 prepared the Assessment Book of said irrigation system according to Statutes providing therefore; and WHEREAS, It appearing to the Mayor and City Council of the City of Caldwell, that the estimate amount of money necessary for said purposes, for the use of said Municipal Irrigation System, for the ensuing fiscal year, beginning October 1, 1990, and ending September 30, 1991, as provided by the estimate on file in this office, is the sum of $ 432,009; and WHEREAS, It has been determined that the size of a lot for assessment purposes shall be 3,000 square feet. WHEREAS, Based on aforementioned estimate, each lot would be assessed at $ 32.00 and. each acre at $ 83.00 ; WHEREAS, It has been determined that all property shall be assessed at a per lot basis with the exception of property that is used by the general public, such as schools, municipal parks, and golf courses; and private property when there is sufficient adjacent vacant property under one ownership to aggregate more than three fourths of one acre, may be charged on an acreage basis. WHEREAS, the "Caldwell Municipal Irrigation System" shall include all or part of the following: Calloway Addition Arlington Addition Blatchley Boone Addition College Height Addition Dever's Addition Dorman's Addition Fair Acres Addition Foote Addition Hasbrouck's Addition Memorial Park Addition Mountain View Addition Mountain View Addition ##2 New Home Addition Original Townsite Parkside Addition Second Parkside Addition Pasley Addition Steunenberg Acreage Strahorn Addition Washington Heights, Steunenberg and Hand Addition Third Parkside Addition Goandu Addition The following land will be assessed in the Calloway Addition of the City of Caldwell: All Block 2 excepting therefrom State Department of Transportation right of way. All Block 3 excepting therefrom State Department of Transportation right of way and an allowance for Indian Creek. And such unplatted lands that are within the boundaries of the Caldwell Municipal Irrigation District. And with the exceptions as listed in Exhibit A; and WHEREAS, the assessments herein levied shall become due and payable at the time and in the manner provided by law; WHEREAS, on the 4th day of March, 1991, at the hour of 7:30 p.m., the Mayor and Council will meet as a Board of Correction to review and correct assessments as provided by statute. NOW, THEREFORE, it is ordered and this does order the following, towit: Book 32 Page - 6 (I) That the assessments £cr operation and maintenance OF 7- 'he Cald Mu- Irrigation District for the ensuing fiscal year Octcb�r 1, 1900, and ending Septemb-r 30, 1 tot .1 and be in the amount $ 432,009.
