SPECIAL MEETING
February 11, 1980
4:00 p.m.
The Special Meeting was called to order by Mayor Pasley.
The Roll of the City Council was called with the following members
present: McCluskey, Betts, Williams, Raymond, and Carter. Absent:
Hopper.
(RESOLUTION NO. 8 -80 - FIXING ASSESSMENTS OF THE CALDWELL MUNICIPAL
IRRIGATION SYSTEM FOR THE YEAR 1980.)
The Mayor explained that the purpose of this meeting was to pass
a Resolution fixing the assessments of the Caldwell Municipal
Irrigation System for the year 1980. The Mayor read the Resolution
in full as follows:
RESOLUTION FIXING ASSESSMENTS OF THE CALDWELL MUNICIPAL
IRRIGATION SYSTEM FOR THE YEAR 1980.
WHEREAS, This is the time provided by statute for levying
an assessment of the necessary funds for expenses of maintaining,
operating, improving, extending and enlarging the water works and
system of "The Caldwell Municipal Irrigation System" for the ensuing
fiscal year, upon all lands within said "Caldwell Municipal Irrigation
System "; and
WHEREAS, It appearing to the Mayor and City Council of
the City of Caldwell, Canyon County, Idaho, that the City Clerk, as
assessor of such irrigation system, prior to the fourth Monday in
January of the year 1980, prepared the Assessment Book of said
irrigation system according to statutes providing therefor; and
WHEREAS, It appearing to the Mayor and City Council of
the City of Caldwell, that the estimated amount of money necessary
for said purposes, for the use of said municipal irrigation system,
for the ensuing fiscal year, beginning October 1, 1979, and ending
September 30, 1980, as provided by the estimate on file in this
office, is the sum of $ 108,796.00; and
WHEREAS, It has been determined that the size of a lot
for assessment purposes shall be 3,000 square feet. Each lot will be
assessed at $13.50 and each acre at $35.00; and
WHEREAS, It has been determined that only property that
is used by the general public such as schools, municipal parks, and
golf courses may be assessed on an acreage basis, although not
mandated to be so assessed, and whereas the "Caldwell Municipal
Irrigation System" shall include all or part of the following:

and such unplatted lands that are within the boundaries of
the Caldwell Municipal Irrigation District.
That the assessments herein levied shall become due and
payable at the time and in the manner provided by law.
The 4th day of March, 1980, at the hour of 7:30 o'clock
p.m. is hereby fixed and determined as the time for the Mayor and
Council to meet as a Board of Correction to review and correct
assessments as provided by statute; that at such time the Mayor
and Council shall continue from day to day in session, so long as
may be necessary, not exceeding three days, exclusive of holidays
and Sunday, and the Clerk of said City is hereby instructed and
directed to give proper notice by publication in the official
newspaper of the City of Caldwell, Idaho, of the time, place and
purpose of such meeting as provided by law.
IT IS FURTHER ORDERED, That within five days after the Mayor
and Council shall have adjourned as a Board of Correction, the Clerk
shall complete the assessment books and certify the same, and deliver
said books to the City Treasurer, who shall publish a notice in the
official newspaper of said City, that the assessments herein levied
shall be due and payable on or before April lst, 1980, and that
such notice shall be so published twice at intervals of not less
than six days.
NOTICE OF MEETING TO CORRECT ASSESSMENTS LEVIED ON
ASSESSMENT ROLL OF CALDWELL MUNICIPAL IRRIGATION SYSTEM.
WIIEREAS, On the 11th day of February, 1980, the Mayor and
Council of the City of Caldwell, Idaho, did make an estimate
of the necessary :funds required for the expenses of maintaining,
operating, improving, extending and enlarging Caldwell Municipal
Irrigation System for the calendar year 1980, which estimate
did also include a reasonable sum, not to exceed ten percent
(100) of the total estimate, for the anticipated unpaid
delinquent taxes; and

WHEREAS, Such assessment has been carried out by the Clerk
of the City of Caldwell and entered under appropriate columns
on the assessment roll of said Caldwell Municipal Irrigation
Systems;
NOTICE is hereby given that the Mayor and Council of the
City of Caldwell, Idaho, will meet at a Board of Corrections
on the 4th day of March, 1980, at the hour of 7:30 o'clock p.m.
in the Council Chambers in the City Hall of the City of
Caldwell, Idaho, to correct the assessments so levied and
assessed; when and where any person desiring to make objections
to the assessment so levied and assessed may appear.
Dated this llth day of February, 1980.
To be published February 18th and February 25th, 1980.
The Mayor further explained that the Council was required by law to
set the assessments the second Monday of February of each year.
It was further stated that the toll rate was exactly the same as
last year; $13.50 a lot and $35.00 an acre. The estimated amount
of money necessary for the use of the municipal irrigation system
was a little bit more than last year. The Mayor also said that
Pioneer raised their rates for this year by 25¢ an acre which would
make it $12.75 an acre and the City has to pay two - thirds of this
amount.
Councilwoman Williams questioned as to whether the City had this
raise before the City's budget was adopted. The Mayor and Councilman
McCluskey both agreed that they were sure the City found out this
raise before the budget was completed. It was also pointed out that
it did not amount to a lot of money and was only a minor part of
the City's irrigation system.
MOVED by Williams, SECONDED by McCluskey that Resolution No. 8 -80
be passed fixing the assessments of the Caldwell Municipal Irrigation
System for the year 1980.
Roll call vote. Those voting yes: Williams, Raymond,
Carter, McCluskey, and Betts. Those voting no: none. Absent and not
voting: Hopper.
MOTION CARRIED
The Mayor explained that a notice would be published in the paper on
the next two Mondays giving the time set, which was March 4th, for the
City Council to meet as a Board of Corrections. The Mayor further
informed the Council that the City Treasurer will have to publish a
notice stating when the toll was due and he would like to delete one
sentence which stated that no water would be supplied to anyone who
did not pay their toll by July lst. Councilman Raymond suggested that
it might be better to say that the water may be turned off if the
assessments are not paid, rather than to state that no irrigation
water will be supplied to any lot, pieces, or parcels of land within
the boundaries of the Caldwell Municipal Irrigation System after
July lst if the toll was not paid. Council agreed to it being changed
to may be turned off as there was no possible way to enforce taking
the irrigation water away from anyone who has not paid their toll.
There being no further business, the meeting was adjourned at 4:30 p.m.
