ABSMIT, None. Owing to the absence of the City Clerk, the Mayor appointed Mr. rt. C. as Dyer/Acting Clerk, and announced that the Council was in session for the consideration of any business which might lawfully come before it. This being the date set for opening bide called for in Local Street Improvement District No. 10, for the furnishing of the Labor for the installation of an ormamental street Lightilig system in said district, the Clerk presented to the Council the affidavit of Puollcction of the Notiee of Reociving Bids in Local Street Improvement District No. 10, which affidavit wqs and is in words and figures as i I l � J follows, towit: AFFIDAVIT OF PUBLICATION ; it STATE OF IDfiH0 ) ) as. It was moved by Gordon, seconded by Johns that the Clerk be instructed to insert said affidavit of Phblication as a part of the minutes of this meeting, Notion carried. Forbes Caldwell, Idaho 10,916.00 After a careful consideration of the bids by the Mayor and Council, it was .moved by Bollman and seconded by Dickens that the Proposal of Gabbey & McNeil, for the doing and furnishing of the labor for the complete installation of the ornamental street, lighting system In Local street Improvement District No. 10, in socordanas with the plans and specifications and the furnishing of all labor for the complete installation of said electric lighting system for the sum of $8,660.50 be accepted, and that the Contract for the same be awarded to said Gabbey & McNeil, and that the Mayor and City Clerk be authorized and directed to sign such Contract on behalf of the City of Caldwell. The Mayor direct6d the Clark to call the roll on the motion with the following results; Those voting in The affirmative; Bollman, Dickens, Gordon, Johna, Leighty, sandmeyer. Those voting in the negative; None, Absent and not voting: None. Thereupon the Mayor oeclared the motion carried. Mr. Frank Bodine representing the Intermountain Electric Company presented the following written proposal relating to the Paragon Top for lighting standards: Salt Lake City, Utah Feb. 10, 1930. RESOLUTION NO. 23 By Leighty A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK OF THE CITY OF CALDWELL, IDAHO, To ENTER INTO A CONTRACT WITH THE IE man AUTOMOBILE COMPANY FOR THE PURCHASE OF A STREET FLUSHER. Whereas the City Council has heretofore decided in open meeting that the present street Plusher of the said city was no longer in a usable condition, and that it wss� necessary to purchase anew street flusher, and Whereas, the said City Council authorized the appointment of a committee of the acid council to investigate the purchase of said street flusher, and Whereas, the Mayor did appoint said committees, and said committee received from the manufacturers of said equipment, bide on street flushers, and submitted all of said bids to the consideration of said Council, and Whereas the Council did after a full and complete consideration of all of said bids, accept the bid of the Dufresne Automobile Company for the supplying 'of a street flusher at the price of $4902.50. NOW THE4EFORE BE IT RESOLVED BY the Mayor and Council that the Mayor aid City Clerk be and they are by this resolution authorized and empowered to enter into an agreement with the said Dufresne Automobile Company for the purpbeae of said street flusher at the said prloe of $4902.50 Passed by the Council this 10th dpy of February, 1980. And 6YHEiiEAS, The City 06uncil of the City of Caldwell, met at the Council Room of the City Hall of amid City at the hour of 8:00 P.M., on the 3rd day of February, 1930, being the time and plice appointed for hearing said protests and proceeded to the hearing of said protests and all and each of them, and VPHF,REAS Said Mayor and Council having by motion duly made, seconded, passed and entered in the minutes of said meeting, continued the further consideration and Im ar- ing of said protests to the 10th day of February, 1930, at 8:00 P.M., in the council .Chambers in the City Hall, of said city, at which said time and place suoh further ii consideration and hearing was continued by the Mayor and Council, and ��. WHEREAS, All of said protests having been duly and regularly heard by the said City Council as required by law, end pursuant tc said notice; NOW, THEREFORE, BE IT RESOLVED By the Maycr wad City Council of the City is Caldwell, Idaho: Section 1. That the said protests so filed were made by the owners of less than two thirds of the abutting, adjoining, contiguous end adjacent lots and lands within I T the said proposed Local Street Improvement District No. 9. That after due, timely and careful consideration of said protests, being ell of the protests filed in said matter, said Council is of the opinion that said protests do not present any sufficient 'or legal reason against the creation or establishment of said Local Street Improvement District No. 9, as provided in skid' Resolution of Intention and said protests and each and all of them, are therefore, hereby passed upon, denied and overruled. Section 3. That the Mayor and Council proceed with Bnd complete the work of establishing and creating Local Street Improvement District No. 9, in the City of Caldwell, Idaho, and proceed with and complete the construction of curbs and gutters therein, and the improvement as contemplated by said resolution No. 21, passed and approved by said Council and Mayor, January 14, 1930. Thereupon Councilmen Sandmayer moved the adoption.of said ResAlution which motion was duly seconded by Councilman Dickens. The Mayor then stated the question "Shall the Resolution No. 24 pass?" and directed the Clerk to call the roll. Those voting in the affirmative were Bollman, Dickens, Gordon, Leighty and Sandmayer, Councilman Johns voted in the negative. Absent and not voting: nors . WHEREUPON, the Mayor declared the motion duly carried and declared Resolution No. 24 adopted; thereupon the bleyor directed the Clerk to record the same upon the Journal of the Proceedings of the Council as a part of the minutes of this meeting; and thereupon the Mayor duly signed and approved and the Acting Clerk duly signed and attested said Resolution in open session of the Council. 1930.
