Council Chamber, City of Caldwell, Idaho, Pebruary 9, 1917.
Council meet in regular session, pursuant to adjornment with President of the
Council H. H. Hayman presiding. Present Councilmen 0. if. Ackley, James A. Dement Jr.,
J. H. Forbes and Charles Sanberg, S. Ben Dunlap, Clerk. The following business was
transacted:
Mr. M. L. March, representing the local G. A. R. appeared, stating that the
organization planned to erect a monument to.the memory of deceased soldiers, and they
desired the Council to donate a lot in the Cemetery on which the monument could be placed.
The matter was referred to the Cemetery Committee.
Mr. E. L. Johnston appeared and complained that the January water bills against
himself and Rex Johnston were excessive.
It was voted on motion of Forbes that the matter be referred to the § water
Committee.
Mr. Frank Gilbert appeared and requested that that part of the Ordinance
governing the passanger livery business, which fixes the charge for hauling passengers
any where in the City limits at 25 cents each be repealed. He also stated that thero were
several people in this City engaged in this business who had failed to take out a City
license.
In the matter of those engaged in the passenger livery service and who had
not secured a City license, it was voted on motion of Ackley, that it be referred to the
City Attorney.
The minutes of the sessions held January let., 2nd., 5th., 8th., and 29Th.,
respectively were read. It was voted on motion of Dement, that the same be approved.
The City Rngineer stated that the Street Light at the intersection of Aven
Street with Cleveland Boulevard was not in the proper place, that he had taken the matter
up with the light company on several occasions requesting them to change it so as to
give offective service, but that nothing had been done. Be recommended that the rental cost
of this light be deducted from the light Company's bill.
It was voted on motion of Dement that ;,3.00 be deducted from the claim of
the Idaho Power Company for the month of January, 1917, in conformity to the suggestion of
the Engineer, and that a like sum be deducted each month until the light is installed in
the proper place.
The following claims, which had been 0. F'd by the Finance Committee, were
read and it was voted on motion of Forbes that the same be allowed and that tho Clerk be
and hereby is instructed to draw warrants on the several funds in payment of the same as
follows;

The complaints of a number of City water users to the effect that they had
allowed water to waste in order to keep their systems from freezing and wanting the City
to rebate the excess.charges were presented. The matter was referred to the Clerk.
The reports of the following officers for the month of January, 1917, were
read. Police Judge, City Clerk. Supt of Streets, City Engineer, Supt of Water Works,
City Librarian and Sexton. The reports of the City Treasurer and of the Librarian for the
month of December, 1916, were also read. It was voted, on motion of Dement, that the
reports be approved.

It was voted on motion of Forbes that the City Attorney be instructed to
confer with the - County _ttorney relative the right and probability of the ,Iity
receiving aid from the County in the construction of a bridge over Indian creek at
Third Avenue in said City.
Petition of G. J. Atchison et -al to have the oil tanks located near the
intersection of Cleveland Boulevard with Avon Streat, removed, was read.
The following resolution was introduced by Councilmen Ward,
RESOLU'T'ION.
WHEREAS there has been duly presonted to this body
by the Citizehs and Taxpayers of a portion of our City, a petition,
praying that prompt action be taken to have those certain tanks,
owned and controlled by the Continental Oil Company and now located
near the intersection of Aven Street with Cleveland Boulevard and
used for the storage of gasoline and oil, immediately removed from
their present location because of the menace to the safety of life
and property situated near the said premises, and
WHEREAS it appears upon investigation that the said tanks have
a combined capacity of 48,000 gallons and that because of this great
quantity of imflamablo material being stored in a section of our
City, where a slight degree of carelessness in handling the same
might result 14 the lose of life and great property damage, and
WHEREAS it is believed that every possible precaution should
be taken to safeguard the life and property interests of citizens,
and that they should not be subjected to risks and inconveniences
for which there is no valid reason, and
WHEREAS the future development of this portion of the City as
a residence section is serioesly hindered by reason of the present
location of the said tanks,
NOW THEREFORE Br IT RESOLVED, By the Mayor and Council of the
City of Caldwell, Idaho, that the City Attorney be and hereby is
directed and instructed to take whatever steps are necessary and
proper to have the said tanks immediately removed from their present
location, and
BE IT FURTEER RESOLVED, that in the event another location is
sought in said City for the placing of these or other tanks used
for similar purposes, that the consent of the Mayor and City Council
to use the said premises for such purpose must first be obtained
before installation is permitted, and that said installation must be
made in conformity to rules and regulations prescribed by the
Council therefor.
The petition and resolution wore referred to the City Attorney.

The matter of making a charge to those usuing the auditorium of the City

Hall for meetings, to cover the cost of lighting and heating the said room, waq discussed

and referred to the building committee for investigation.
On motion of Dement the following election of 'icers and polling - places ,ere
selected for the regular biennial City Election to be held April 24th., 1917.

No further business appearing before the meeting it was voted, on motion of
Dement, that Council adjorn.
