Council Chambers, City of Caldwell, Monday evening, February 7, 1910,
Council met in regular session with Mayor J. B. Gowen, presiding and Councilmen Elmer
A. Clark, M. J. Devers, R. Farrar, J. G. Gartin, T. TT. Paynd3br present. C. J. Shorb,
Clerk, when the following business was transacted:
Resignation of Jas. H. Gipson, councilman of the Third Ward was read and a mo-
tion was amde by Gartin that the same be accepted. The roll being called on the motion
the vote resultede
Ayes -- Clark, Devers, Farrar, Gartin, Paynter--5.
Nays - -0. Absent -- Gipson. So the motion prevailed.
The Mayor appointed James Harris councilman for the Third Ward to fill the un-
expired term of Jas, H. Gipson, resigned. A Motion was made by Clark that the appoint-
ment be confitmed. The roll being called on the motion, the vote resulted:
Ayes -- Clark, Devers, Farrar, Gartin, Paynter - -5.
Nays and Absent - -0. So the appointment was confirmed.
Voted, on motion of Clark, that council adjourn until Wednesday evening, Feb-
ruary 9, 1910, at 7230 P. si.
Wednesday, February 9, 1910. Council met in r•eguldr session pursuant to ad-
journment with aresident of the Council Clark presiding, and Councilmen Devers, Farrar,
Gartin, Paynter present; Shorb, Clerk.
James Harris qualified as Councilman for the Third 'hard and took his seat.

Minutes of the regular and adjourned meetings in January were read and a pprdved.
L. R. Clough appeared and made verbal petition for extension of main to Hazel-
wood. Creamery and for a better rate on water. The matter was referred to the Water
committee,
Mr. McGee appeared and addressed the council relative to cemant siderialk -rcon-
tracts , stating that he had completed some of the sidewalks advertised and had contract
for several others and wanted to know what effect the contracts let by the city would
have on his contracts. Mr. IJoGee was asked to file a statement with the City Clerk
showing what sidewalks he had laid and the contracts he had for sidewalks.
The following reports wend read and on motion of Devers accepted and Ordered f
filed: Sanitary Inerector, City Clerk, Treasurer, Street Commisioner, Chief of Police,
Sexton, Litrarian, Chief of Fire Department, Superintendent of Water Works.
Petition of the Ladies of the Forward Club praying the city council to pass
an ordinance requiring that at least two members of the Library Committee be appointed
fromr members of the 7orward Club, selected by the members of the Forward Club, was
read. Voted, on region of Farrar, that. the petition be laid on the table.

A motiom visa made by Paynter that the claim of G. A. Dew be allowed on the
Water Works Fund in the sum of $436.20. The roll being called on the motion, the
vote resulted:

So the motion was lost.
Voted, on motion of Gartin, that the claim of G. A. Dew be allowed on the
Water Works Yund in the sum of 4391.20 in full for all services rendered by him to
the city,
Claim fo Nellie S. Williams for typewriting in the sum of 020.00 was
disallowed.
Claim of Nellie M. Sterling was cut in the sum of $10.00

Bill N0.26 by Clark, entitled, "An Ordinance authorizing the issuande of Im-
provement Bonds bf the City of Caldwell, in the sum of 4`100,365.18, for the purpose of
paying the cost of the construction and laying of pavement and curbing in Loval
Improvement District No.l, providing for the payment of said bonds out of the collec-
tion of assessments levied in said district," was read the first time.
A motion wan made by Harris that the rules be suspended and the readings on
three separate days be dispensed with and that Bill No. 36 be read the second time by
title and the third time in full and placed on its final passage. The poll being
called on the motion, the vote resulted:
Ayes -- Clark, Devers, Farrar, Gartin, Harrid, Paynter - -G.
Nays and absent - -0. So the motion prevailed.
Bill No. 36 read second time by title,
Bill No. 36 read third time in full and placed on its final passage. The
question being, Shall Bill No.36 pass? the roll being called, the vote resulted:
Ayes -- Clark, Devors; Farrar, Gartin, Harris, Paynter - -6.
Nays and absent - -0. So Bill No. 36 passed, becoming Ordinance No. 151.
Bill No. 34, entitled, "An Ordinance repealing Ordinance No. 134, entitled,
'An Ordinance providing for the licensing of drays, trucks, express and ,job wagons,
numbering the same in the City of Caldwell, Idaho, and providing a penalty for the

violation thereof,' passed and approved by the wtayor and Council of the said City of
Caldwell, on the 19th day of July, 1910," was read the second time.

A motion was made by Devera that the rules be s&apended and the readings on
three separate days be dispensed with and -that Bill No. 34 be read the

called on the motion, the vote resulted:
Ayes -- Clark, Devers, Farrar, Gartin, Harris, Paynter - -6.
Nays and absent - -0. So the motion prevailed.
Bill No. 34 read third time in Pull and placed on its final passage. On the
question, Shall Bill No.34 pass? the roll being called, the vote resulted:
Ayes -- Clark, Devers, Farrar, Gartin, Harris, Paynter - -G.
Nays - -0 Absentl4-0. So Rill No. 34 passed, becoming Ordinance No. 152.
Bill No. 35 entitled, "An Ordinance providing for the removal pf snow, hail and
sleet from the sidewalks within the fire limits of the City of Caldwell, Idaho, by the
owners or tenants of the property fronting on said sidewalk and providing a penalty
for the violation of this ordinance" was read the second time .
A motion was made by Gartin that the rules be suspended and the readings on three
separate days be didpensed with and that Bill No. 35 be read the third lime by title
and placed on its final passage. The roll being called on the motion, the vote result-
ed:
Ayes -- Clark, Devers, Farrar, Gartin, Harris, Paynter - -6.
Nays and absent - -0. So the motion prevailed.

Bill No. 35 read third time by title and placed on its final passage. On the
question, Shall Bill No. 35 pass the roll being called, the vote resulted:
Ayee-- Claris, Devers, Farrar, Gartin, Barris, Paynter - -G.
Nays and absent - -O. So Bill No. 35 passed becoming Ordinande No. 153.
Voted, on motion of Harris, that Council adjourn until Monday, February 14, 1910,
at 7:30 p• m.
