The Council met pursuant to adjournment of February 5th, 1946, On Roll Call the following Councilmen answered present: J. R. Sloop, Leo J. Mason, Pete Clasen, L. E.Burrell, 0. L. Thornock and R. H. McNeill. The Mayor informed the Council this was the timeset by notice for the third meeting of the Board of Correction to review and correct assessments of the Caldwell Municipal Irrigation System. There was no one present for or against. There being no farther business to come before the Coundll it was moved by Councilmen Twornock, seconded by Councilman McNeill that Council adjourn. In response to roll call upon said motion, Councilmen voting "Aye" were: Sloop, Mason,,Olessn, Burrell, Thornock and McNeill. Nay: None. Absent and not voting: None, Thereupon the Mayor declared the motion carried and the Resolution adopted. RESOLUTION By Councilman Sloop. It was moved by Councilman NoNeill, seconded by Councilman Mason that the follow. ing Hpolution be adopted: "RESOLVED: "(a) That it is the determination of this body that an urgent need for ad- ditional housing for war veterans exists in the City of Caldwell, Idaho. "(b) That the City of Caldwell enter into a Contract with the Federal Public €ousing Aut`?ority on formFPRA -SP -1481, Rev. 1- 15 -46, to provide temporary housing pursuant to Title V (as amended) of the Hanham Act. "(c) That the mayor and Clerk of the City of Caldwell, Idaho be authorized to execute such Contract in the name of and on behalf of the City of Caldwell, Idaho." In response to roll call upon said motion, Councilmen voting "Aye" were: Sloop, Mason,.Olesen, Burrell, Thornock and McNeill. Nay: None. Absent and not voting: None. Thereupon the Mayor declared the motion carried and the Resolution adopted. Application for Tex# -cab license was read from Cecil Rohan. Moved by Olesen, seconded by Burrell that this license be granted. Sisty rillcrest Total Motion carried. , 9 Thereupon Councilman Sloop introduced Bill No 22, entitled; AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF, AND OWNERS OF PROPERTY IN THE CITY OF CALDITRLL, T14AT AN APPLICATION HAS BEEN PRESENTED FOR THE VACATION OF A PORTION OF MICHIGAN AVENUE AND 23rd AVENUE IN THE CITY OF CALDWELL, IDAHO; PROVIDING FOR FILING OBJECTIONS THERETO AND FOR FILING CLAIMS FOR DAMAGES SUSTAINED THEREBY; PROVIDING FOR A °AERTAINING SUCH DAMAGES BY THF. MAYOR AND COUNCIL OF THE CITY OF CALDWELL, AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE. which was read for the first time and the Council proceeded to a consideration of Bill No. 22. It was moved by Sloop, seconded by Mason that the rules requiring that the reading - of,a Bill on threeseparate days be suspended and that Bill No 22, be read the second time by title and the third time in full section by section and placed on the final passage. The Mayor directed the Clerk to call the roll on the above motion with the following i result; Those voting in the affirmative were: Sloop, Clasen, Mason, Burrell, Thornock and McNeill. Negative: None, Absent and not voting; None. The Mayor declared the motion had passed by the necessary three - fourths majority and directed the Clerk to read I Bill 22 the second time by title and the third time in full section by section. The Mayor directed the Clerk to make proper entry i of the same and to cause Ordinance No 657, to be published in the Caldwell News- Tribune the official newspaper of the City of Caldwell, Idaho. F'ASTERLY SIDE OF BLOCKS 57 TO 68 INCLUSIVE OF MOTTNTAIN VIEW ADDITION TO CALDWELL, IDAHO, AND THE VACATION OF TPAT PORTION OF COLLEGE AVENUE IN CAI.D°IELL, IDAHO, 22.5 FEET ITWIDTH AND ADJOINING THE WESTERLY SIDE OF BLOCKS 74 TO 85 INCLTISIVR OF MOUNTAIN VIEW ADDITION TO CALDWELL, IDAHO; HAS BEEN MADE OR FIL D AND THAT NO CLAIM OR CLAIMS FOR DAMAGES WFICH WOULD BE SUSTAINED BY REASON THERE OF RAVILED; DETERMINING TTTAT THE, VACATION OF SAID PORTIONS OF COLLEGE AVENUE IS TO TEE BEST INTEREST AND ADVANTAGE OF THE CITY OF CALD?rPLL AND ITS CITIZENS AND ITS PROPERTY OWNERS; DETERIATPING TRAT NO DAMAGES WILL BE SUSTAINED BY ANY CITIZEN OF OR PROPRRTY OWNER IN THE CITY OF CALDWELL, IDA70, BY REASON OF THE VACATION OF SAID PORTIONS OF SAID COLLEGE AVFAT'T; VACATING SAID PORTIONS OF gAID COLLEC E AVENUE; PROVIDING THAT TIIE TITLE TO THE VACATED PORTIONS OF SAID COLLEGE AVENUE SHALL REVERT TO TH^ OWNERS OF THE ADJACENT REAL ESTATE.; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PRO - VIDING FOR TAE PUBLICATION OF TINS ORDINANCE AND ITS TAKING EFFECT; which was read for the first time and the Council proceeded to a consideration of Bill No 24. It was moved by Thornock, seconded by Mason that the rules requiring that the reading of a Bill on three separate days be suspended and that Bill No 24, be road the second time by title and the third time in full, section by section and placed on the final passage. The Mayor directed the Clark to call the roll on the above motion with the following result. Those voting in the affirmative were; Sloop, Clasen, Mason, Burrell, Thornock and McNeill. Negative: None. Absent and not voting; None. The Mayor d eclared the motion had passed by the necessary three - fourths majority and directed the Clerk to read Bill No 24, the second time by title and the third time in full section by section. The Clerk read the Bill as directed. The question being "Shall Bill No 24, pass? The Mayor directed the Clerk to call the roll on the above question which resulted as follows: Those Voting in the affirmative were; Sloop, Olesen, mason, Burrell, Thornock and McNeill, Negative; None. Absent and not voting; None. Thereupon the Mayor declared Bill No 24, had passed and the Mayor in open sessior of the Council duly signed and app -oved the Bill, and the Clerk duly signed and attested the same which became Ordinance No 659. The Mayor directed the Clerk to make proper entry of the same and to cause Ordinance No 659, to be published in the Caldwell News - Tribune the official newspaper of the City of Caldwell, Idaho.
