The Regular Monthly Meeting of the City Council met in the Council Room .of the
City Hall, with the Mayor, W.R. Hollingsworth, presiding.
On Roll C the following Councilmen answered present; Edgar L. Oakes, F. D.
v Mumford,, W. E. Bsbcnck, G. M. Fenrich and Norvil T. Hinds, Absent: W. H. Odle.
The Minutes of the previous meetings were read and approved.
Mr. Odle appeared and was marked present.
There being several persons in waiting the Mayor asked them to state their busi-
ness and Mr. Ed Campbell acting as spokesman stated that the new owners of the Packing
_I House ware going to feed and fatten hogs there and asked that the City take some action
to prevent it. After quite a lenghty discussion the Mayor stated that this matter would
be taken care of.
The Mayor appointed Mr. E. L. Vgssar to set on - the arbitration board in case of
City of .Caldwell vs. Furs. Martha Gilgan Sarehett.
Moved by Oakes, seconded by Mumford that this appointment be confirmed. Motion
carried.
The Hills for January were read and on motion by Oakes, seconded by Fenrich that
these B7,lla be allowed and Warrants be ordered d yawn for the various amounts all of wlich
had been approved by the Chairman of the Finance Committee. Moticnrarried.

"WHEREAS" a petition signed by sixty per cent, of the resident owners of property
a the s treats and avenues, adjoining, abutting and adjacent to the lotsand lands here-
inafter described has been filed with the City Clerk, requesting the organization of a
local gtreet improvement district in the City of Caldwell, Canyon Oounty, Idaho, for the
purpose of surfacing, grading and oiling the streets and avenues in said district and re-
questing thht the cost and expense of improvements, including intersections, be assessed
against e.11 the property in tho district in proportion to the benefits derived; and
"WHEREAS, it is deemed advisable and to the best interest of the City of Caldwell
Idaho, that a local street improvement district shall be established in said city, includ-
ing the property abutting, adjoining and adjacent on the portions of thestrests and avenues
hereinafter in this resolution specifically set forth, and that there be constructed in the
said_distriet suitable surfacing, grading and oiling of the streets therein and that the
cost of said improvements shall be levied and assessed against the lots and lands included
wit' said improvement district as and in the manner provided by law;
"NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Caldwell,

Canyon County, Idahos
"Section 1, It is hereby declared to be the intention of the Mayor and Council
of the City of Caldwell, Canyon County, Idaho, to create and establish within sild city a
local street improvement district to be known as and called 'Local Street Improvement
District No. 16t for the City of Caldwell, Idaho.
"Section 11.. That said proposed improvement is a further and additional im-
provement and the general character of the improvement to be made in said proposed local
street improvement district is grading, surfacing, and ogling of the streets and avenues
therein, to be constructed of earth, gravel and oil, all in accordance with the plans and
specifications to be hereafter admpted by the Mayor and Council and placed on file in the
office of the "ity Clerk of the City of Caldwell, Idaho.
"Section 111. That said Local Street Improvement District No. 16 shall consist
of and include all the lots and lands abutting, adjoining and adjacent to the following
named streets and parts of streets and avenues inssid city, between the points herein-
after named, to a 'istanee back from such streets and avenues if platted in blocks to the
center of the block, if platted irn lots to the center of the lot, and if not platted to
the distance of one hundred twenty =five feet as shown by the accompanying map, said streets
are designated end described as follows: U
"Beginning at the southeasterly side of the intersection of 4th Avenue
and Everett Street; thence southeasterly along Everett Street to the
Northwesterly side of the intersection of Everett Street and Kimball
Avenue;
"Beginning at the southeasterly side of the intersection of 5th Avenue
and rillmore Street,thence southeasterly along Fillmore Street bo
the southeasterly side of the intersection of Fillmore Street and 10th
Avenue,
"Beginning at the northwesterly side of the intersection of Grant Street
and 5th Avenue, thence southeasterly ale g Grant Street to the southeast-
erly side of the intersection of "rant Street and fOth Avenue; j
"Beginning at the southwesterly side of the intersection of Everett
Street and 10th Avenue, thence southwesterly along 10th Avenue to the
southwesterly side of the intersection of 10th Avenue and Grant
Street;
"Beginning at the southwesterly side of tre intersection of Fverett
Street and 9th Avenue, thence southwestery along 9th Avenue to the
Southwesterly side of the intersection of 9th Avenue and Grant Street;
"Beginning at the southwesterly side of the intersection of 7th Avenue
and Dearborn Street, thence southwesterly along 7th Avenue to the south -
westerly side of the intersection of 7th Avenue and Grant Street;
"Beginning at the southwesterly side of the intersection of Dearborn
Street and 6th Avenue, thence southwesterly along 6th Avenue to the
southwesterly side of the intersection of 6th Avenue and Harrison
Street;
01 Beginning at the northeasterly side of the intersection of Grant
Street and 5th Avenue, thence southwesterly along 5th Avenue to the south -
westerly side of the intersection of 5th Avenue and Harrison Street.
"Section 1V. Thet the estimated coat of said inprovement herein provided for
is the sum of $9000.00.
"Section V. That the cost andexpense of said Local. Street Improvement District
I go. 16, and the construction of said improvement shell be assessed upon the abutting,
adjoining, contiguous and adjacent lots and lands, and upon lots and lands benefited,
and included in the improvement district formed, on such streets and avenues proposed to be
improved as[ hereinbefore described and said cost andexpense shall be assessed upon the
abutting, adjoining and contiguous and adjacent lots and lands and upon lots and lands
benefited and included in the improvement district formed, each parcel of land being se-
parately assessed gor the debt thereof in proportion to the number of square Peet of such
lots and lands abutting, adjoining, contiguous and adjacent thereto, or included in the
improvement district to the distance back from such streets and avenues, if platted in b
blocks to the center of the block, if platted to the distance of one +hundred twenty -
five feet and in proportion to the benefits derived to such property by said improvement
sufficient to cover the total cost and expense of the work. The cost ends xpense to be
assessed as herein provided for shall include the contract price of the improvement, en-
gineering and clerical service, advertising, interest upon warrants if issued, and all legs
services for preparing proceedings @nd advertising in regard thereto.. �

"Section V1. The resident owners of property within stch district subject to
assessment, having requested b petition that tl,e cost and expense of the improvement in-
�clVding intersections, be assessed against all the property in the district in proportion
to the benefits derived, it is hereby determined that sixty per cent; of the resident ownersj
of property within such district, subject to assessment, have signed said petition, the
total cost andexpense of all improvements within the intersections in Local Street Improve -
ment District No. 16, sh @11 be assessed against all of the property in a aid district in
proportion to the benefits derived from such improvements.
"Section V11. The Mayor and council of the City of Caldwell, shall assume and
retain full and conplete jurisdiction of all construction work necessary to construct said
improvement and to do the same by contract as provided by law. The C ommittee on Streets to-
gather with the City Engineer, shall under the direction of the mayor and council supervise
said construction work and see that thessme is done instrict accordance with the plans
and specifications provided by the City Engineer and approved by the City Council, and
such contracts as may hereinafter be entered into by said City and those to whom the con-
tracts may be awarded after due notice for bids has been published as required by law.
"Section V111. That all property owners who may desire to protest against the
making of said improvement and against the creation of said improvement district, may fil
such protests in the office of the City Clerk at any time before 5:00 o'Clook p.m., on the
17th., day of February, 1939, and that the City Council of said City will meet on the 17th

day of February, 193 0,at the hour of 8:00 o'clock P.m., in the C ity Council Chnmbers, in
the City Hall in Caldwell, Canyon County, Idaho, the authorized and usual meeting place,
to hear and pass upon sv.ch protests theretofore filed and determine whether or not to prop
coed with said proposed improvement.
"Section 1R. That the City Clerk is hereby authorized and directed to give due
and legal notice hereof and of the time within which protests against said proposed Im-

derived, each lot and parcel of land shall be separately assessed for the debt thereof in
proportion to the number of square feet of such lots and lands abutting, adjoining, con..
tiguous and adjacent theretc, included in the improvement district; which resolution is
on file in the office of the C ity Clark of the City of Caldwell, to which reference is
hereby made for further information In regard thereto.

"Section X. That bonds shall be issued and sold to meet the payments of the
costs and mcpenses of said improvements within the boundaries of Local Street Improvement
District No.16 which is chargeable to the abutting, adjoining, coltiguous and tributary
property and shall be paid for in ten equal annual installments, the first installment
to mature within o -.e year from date and the last installment is not more than ten year@
from date, and shall be numbered from one (1) upwards, consecutively, and shall bear in..
terest payable semi- ann and said bonds may be sold at not less than par value and
the city, for the purpose of meeting the costs and expenses of such improvements as the
same are installed prior to the sale of said bands, w ill issue warrants against the im-
provemant disbict, payable to the contractor or the proper person, upon estimates of the
City Engineer bearing interest at the rate of not to exceed seven percent, per annum,
which warrants together with t!s interest thereon at the date of the issue of said bonds
shall be redeemed and retired from the proceeds of the sale of said bonds.

"WHEREAS, there is much traffic upon the s tracts and avenues hereinafter named
In the City of Caldwell, Canyon County, IdaYn, e nd that the same are in ill repair and
during the winter months become muddy and almost impassible and in the summer months becoml
so dusty and full of holes making the conditions of the winter and summer almost intoleraI
along the streets and avenues-, and that said streets and avenues are not in a condition toy
traveled by the traffic that ordinarily would pass along such streets and avenues during
the greater part of the year; and �I
"WHEREAS, it is necessary that said streets. nd a venues be improved and put in i
s condition to carry the traffic on and along them and it is necessary for the City to impra
grade, gravel, surface, oil and pave; and
"IT °URTHPR APPEARING to the Council send the Council finds that the said streetdl
and avenues are in such a condition as to require repair and improvement and if they are n`
so repaired and improved the City might become subject to expensive suits for damages that
might occur to persons and property, and that such suit might reasonably be expected to
create greater axpense-to the City than the improvement and repair of said streets and
avenues, and that said streets and avenues ought to be graded, graveled, surfaced and
paved with oil paving in order to<carry the said traffic;
