The Regular Monthly Meeting of the City Council met in the Council Rooms of the City Hall, with
President of the Council, ?mery L. Vassar presiding.
Upon Roll Call the following Councilmen answered Present: "mile Shorb, .Alvin Y. Rates, V. Jay
Martin, N. E. "Coley" Smith and c, L. 7assar. Absent. Mayor Simmerman.
Assessments of huni.eical Irrigation System
President of the Council, Vassar informed the Council that this was the time set by notice for the
Mayor and Council to meet ae a Board of Correction to review and correct assessments of the Caldwell
Municipal Irrigation System.
There was no one present for or agains the Assessment Roll.
Moved by Councilman Bates, seconded by Councilman 9horb that the Assessment Roll of the Caldwell
, unicipal Irrigation System be accepted.
Upon Roll Call, the motion was unanimously carried.

Rev. Rohn thanked Air. Vassar and the members of the City Cokmcil and said that they were present
m behalf of a certain parcel of land that the City owns and which they would very much like and hope that
.hey could lease it. He said that he would like to introduce Reversed Reynolds who is the District Superin_
endent of their Church Organization in this Northwestern District which comprises five States and a part of
ritish Columbia; Reverand Reynolds is also the President of their College in Portland. He said that he
ould state their case better than he could he would like for him stats the case that they have to the Council

suitable location with it being their desire to locate here in the Boise Valley with the chief reason being
that this is the geographical center of their work. He said that he had travelled extensively and that he
liked this valley; that he had recently looked at property in Long Valley and that last fall he had made two
trips into Sun Valley and that of all the property they had looked at, he felt that this property here known
as Curtis Park is the choice as far as he was concerned and he was sure that he could speak for the Board of

Directors in this respect. He said that they had been here in Caldwell a couple of years ago and had looked
at this property at that time; that it was what they - were looking for as it was about, the right size, there
was plenty of water and it was accessible from the Highway and thusly to the various narts of their District.
He said that it had —ny advantages to then for locating here and that if the Council was favorable disposed
to grant their request and they were able to get possession of this park, then they would immediately start
the development of a Church Conference Grounds and Camp and that they would be prepared during the first
year or two to invest 315,000.00 to 3 to start. lie said that it had been his experience with these
projects ttat they would possibly develop it to an approximate cost of 430,000.00 to $40,000.00 or $50,0(
investment. They would have to put in plambing, wash rooms and cept_c tanks; that they would want to build
a tabernacle to seat several hundred people; build a kitchen and a dining hall; undoubtedly a residence for
the caretaker; put in recreational facilities such as a ball park and tennis courts, swimming pool and swing:
for the young people; dorms for the boys and girls and for the adults who may be attending the annual summer
conference and camp.
Reverand Reynolds then pointed out the advantages to the City from their investment at the ground
and from the money spent in the City by those in attendance and said that what they were asking was to lease
it and that of course if the City was to decide to sell it they would plan on bidding. He said that they
would prefer to lease as they would prefer to invest the money necessary for purchase into the development
of the ground. He stated further that he didn't believe they mould be interested in anything less than a
fourty year lease so that they could go ahead and develop it as they would want it to be developed. He said
that they would agree in the lease that they would remove no trees, etc., without permission of the City
Council and the rental would be paid in advance and they would also desire that upon termination of the
lease, they would have permission to remove their buildings From the property. He stated that this was
their case and that if there were any questions, he would be happy to answer them.
President of the Council thanked Reverend Reynolds for the presentation of their request and said
that he would like to ask as to what kind of materials would they plan to use in the buildings.
Reverend Reynolds stated that of course the erection of these buildings would be subject to the
City Codes and that he could only speak as one of the Board and for himself in that they had no plans as
yet but that thei would desire to build buildings that would have a minimum of fire hazard and a mininmum
maintenance; that he thought, ad far as possible, they would put up block buildings with corrugated iron
roofing, lie said that there may be a few frame buildings but that these would be kept painted and in
proper condition.
Councilman Shcrb said that a question came to his mind when he speaks of ample water out there;
he said that there is a well out there but that it has a sulfur content in it and that it might be object-
ionable for drinking water. It was pointed out however, that it probably wouldn't be any problem to get
good water there.
Councilman Smith inquired of Reverend Reynolds if, when they had this other Camp, whether other
Churches used it rather extensively. Reverend Rs molds stated that it wasn't in that it was never developed
lie said that this was one of the reasons that it was sold. }le stated further that they know of other Churct
that have Camps that they rent and to him, it is the right thing to do.
President of the Council, Vassar inquired as to how soon they would have to have an answer on this
Reverend Reynolds stated that their Board of Directors would be meeting next Monday in Portland
and they thought if it has convenient to the Council and the Mayor that next Monday evening they would
telephone to see if they couldn't get an answer while they were in session. He stated further that this
meeting would be only for the one evening and that their next meeting would be in Twin Falls, probably the
first week in May and that if the Council was not favorably disposed towards them, that they wanted to keep
looking.
President of the Council, Vassar then called upon the City Attorney and asked if he had any
comments to make.
Mr. Dean Miller stated that he would have to loo4: at it again lnct that it seemed to him that
something came up on this several years ago and that his recollection was at that time, that there was
something in the deeds of conveyance of the property that would prohibit the City from entering into this
type of an arrangement. He said that legally, so far as leasing the land or selling it, if this land has
not been dedicated to a public park purpose, we could lease it or sell it without an election but if it had
been dedicated to a public park purpose, it watild require an election to dispose it or to lease it.
Councilman Smith inquired of Reverend Reynolds if they would be interested in a lease of twenty
years rather than a forty year duration. He said that they could pretty well depreciate the buildings in a
twenty year period and that forty years is a long time.
Reverend Reynolds stated that he would have to take this up with their Beard of Oirectors but for
their interests, they would want to lease it for as long as they possibly could.
Councilman Martin inquired as to how much of their District Area did they contemplate this Camp
world serve.
Reverend Reynolds said that for their immediate future, it would serve their entire District but
that they had discussed having two or more Camps but that they desire to have the one Camp and that is the
one reason they would like to lorate here in the Boise Valley.
Councilman Marten questioned further if they planned on this primarily for a summer activity and
Reverend Reynolds said they they ware thinking primarily of a Summer Bible Conference.
Councilman Smith inquired if they were the ones who had applied for this same thing several years
ago.
Reverend Rohn stated that it was he who had made the request a little over two years ago; that thi.:
was the center of their District and that their Camp should have been here years ago. At that time, it was
their understanding that the City couldn't sell it or lease it because of a clause that the ground was
donated and that if it was used for anything else but a public park, it would revert back to the heirs. He
said however, that there seems to be a little different light on it now and that is why they had come back
for the second time.
President of the Council, Vassar then stated that they would take the request under advisement;
that he would report to the Mayor upon his return and if they had to have an answer by next Monday they would
attempt to have an answer for them by that time.
Reverend Reynolds stated that if it worked out, he would come back and that they would get An
Attorney to work with the City Attorney; that they vrould prefer the City net the amrnrnt of the lease and let
them kncrna about this b;v next M also.
Reverend Rohn and Reverend Reynolds then excused themselves from the meeting.
Bids on Police car
President of the Council, Vassar stated that the next order of business was the opening of Bids
for a new Police car.
Chief of Police Astleford stated that there were seven bid forms out, A bid had not been received
from Bunny Buick; that Christensen Motor Sales could not meet the specifications and that he had checked with
Lodge N at four o'clock. The bids were supposed to be in his office by ten o'clock this morning. Mr.
Lodge had told him that if they were going to hid, the bid would be in his office within fifteen minutes and
that the bid had not been received at fifteen minutes to eight, tonight.
President of the Council, Vassar then opened and read the following bids:

Moved by Councilman Smith, seconded by Councilman Shorb that the low bid of Curt and Hal, Inc. in
the amount of $1,188.39 ba accepted providing it met the specifications.
Upon Roll Call, the motion was unanimously carried.
Recodification of Ordinances
President of the Council, Vassar announced that the Mayor w.,ald like to have authorization to
submit the Code to Sterling Codifiers in Weiser the following week so that they could start printing it
and that he had said there were no material changes in anything that the Council had discussed that he was
aware of but that if anything should be discovered in the meantime, it could be corrected. E
General comments were that the Code shoeld be delivered for printing even if there were to be some
corrections later. Ffoved by Councilman Shorb, seconded by Councilman Smith that the Mayor be authorized to
submit the Code to Sterling Codi,fiers as corrected for printing.
Upon Roll Call, the motion was unanimously carried.
Adoption of Assessment Roll - L.I.D. /1119
The Sewer Committee presented the Assess Roll of Local Improvement District to the Council.
Thereupon Con - noilman Shorb presented the following Resolution and moved the adoption thereof. The
motion for adoption was seconded by Councilman Bates.

laim of' Hospital and Doctors (Dale Turner)
^resident of the Council, Vassar called upon the City .Attorney, Dean Miller, with regards to a
Caim from the Caldwell Memorial Hospital in an amount of w576.?5 a claim from Dr. Neilson for ?300.00 and
claim from Cr. 9techer in an amount of t
The City Attorney stated that the facts were that a young man by name of Dale Turner, an ex- convict,
in caught. by ore of the City's Police officers in an attempted robbery of a building at night. He had tried
escape by rarrring his car into the Police car in the hope of knocking the Police car out of the way no
rat he could get away, he guessed. The cars entangled and Turner ,jumped out and started to run; the
)liceman called for him to stop and fired one shot into the air and finally shot him. The Police had taken
.m out to the Nosnital where he had a large Hospital bill and a big dortor bill -- nmi, the question is,
rho is goin,7 to pay that bill in as much as Turner is not financially responsible''. He stated further that
Le City Police have had a practice, and they followed it this time, that after they took him out to the
snital, he was left and not arrested formally until he was released from the Hospital; then he wns charged
th a Felony which puts him in the jurisdiction of the County.
Mr. Y111cr stated further that the County doesn't went to pay the bill but, that he thought they had
fund out of which to pay this tyre of claim; that the City does not have a fund set up for this purpose and
e. not budgeted for it. fie said that lie had done some work on the legal liability and his oninion was that
obcbly there v!as rot any legal liability on the City for this bill. He then made reference to the bills
on the Doctors in that the City police call on them for assistance at any time and they always come. He
id that the City may not have a legal responsibility to pay the Doctor bills but in the interest of the
ty's relationship with them, he thought that perhaps the City should consider them where the Hospital was
little different matter -- it was a community Hospital and everyone wanted to see it get along but he didntt
li.eve there was any legal lia'oility on the City to pay their bili.. He suggested that perhaps the City
ould have scrne understanding with the Hosnital on such an occasion.
Councilman Shorb said that he would like to see it negotiated.

Councilman Smith inquired as to whether or not the County had any legal responsibility to pay the
claims and City Attorney Filler stated that he didn't know; that tt:ey may not. He stated further that he
was not recommending that the City pay the Doctors but thought it wan a consideration.
Police Chief Astleford informed the Council that the warrant had been turned directly to the
13heriff for serving.
Councilman Smith moved, Councilman Martin seconded that the claims be rejected.
City Attorrey, biller inquired as to whether it would be the desire of the Council, before taking
action on these, for him to see what the Prosecuting Attorney and County Ceruidssioners could do. He
suggested that they might hold up any action until the 19th of this month in the interest of public
relations.
It was pointed out that Turner was a County prisoner and that the City had no jurisdiction in the
case.
After some further discussion, Councilman Smith withdrew his motion and Councilman Martin withdrew
his second kith further action being po5tr until Fol rcary 19th which world allow time for the City
Attorney to take the matter up with the County.
Request for promotion (Jack 'dinslow)
The following letter was read to the Council:

Gentlemen.
Your approval is requested for the promotion of Jack M. Winslow from the
grade of Patrolman to Meter Sergeant.
Jack Winslow is in charge of the meters in the cii,y which number
approximately 606, and is rcrponsible for their maintenance ana repair.
Jack Winslow has been with the department since June 3, 1957, and has
been a meterman since his 'Winslow has attCnded the meter repair
school at Orlando, Florida, also the FBI School at Pocatello, Idaho.

the grade of Patrolman to Meter Sergeant be approved.

Police report, monthly
President of the Council, Vassar then read th,: monthly report of the Police Department and it was
ordered filed. In connection with this report, the President of the Council inquired as to how the Parking
Lot permits were moving out and Police Chief Astleford replied that they had either 18 or 19 so far and that
they wauld get more when the weather breaks, prubably in March. IIe said that there was a great deal of
interest being shown in the program.
The Pills for December ending were read and on motion of Councilman Smith, seconded by Councilman
Bates, they were ordered allowed and warrants ordered rrawn for the various amounts as approved by the
Finance Committee. The motion carried.
