1946. Chairman Thornock then called upon three persons in attendance at the meeting for
presentntion of objections and clams for damages arising from the vacation of those
portions of streets. Oral objections , -:Jere presented.
NO claim oP claims for damages to any citizen or owner of property in the City
of Caldwell, arising from the vacation of those portions of streets were presented either
In wfiting or verbally at or prior to this meeting.
After the verbal objections had been heard, it was moved by Councilman McNeill,
seconded by Councilman Burrell, that the following Resolution be adopted:
RESOLUTION.

WHEREAS, This is the meeting and the time set by Ordinance No. 654 for filing
and consideration of objections end claims for damages by citizens and property owners of
the C9ty of Caldwell, Idaho, arising from the Application of t! College of Idaho, for
the vacation of portions of 23rd Avenue and Hazel Street in the City of Caldwell, I'eho,
end d eecribed in said Ordinance; and
IN'TERRAS, It appears that fOUr petitions presenting objections to vacating those
portions of streets have at this meeting been filed and objections thereto have been pre -
sented in person by petitioners upon said petitions.
BE IT RESOLVED That the consideration of said Application and the objections
thereto filed this date in the fortA of ^etitions and presented verbally at this melting 3
by petitioners in said petitions be continued to the regular meeting of the Mayor and
Council of the City of Caldwell, Idaho, to be held on the 4th day of February, 1946,
Upon Roll Call it appeared that the motion was unanimously carried.
There being no further business to cones efore the Council It was moved by

City Fail, wit(! the Va =or C. L. Crookham, Jr., presiding.
On Roll Ce11 the following Councilmen answered present: J. R. Sloop, Leo J. iTaso ,
_ Pete Olesen, L. E. currell, 0. L. Thornock and R. H. YcDTeill.

was continued from the Specinl "eeting of Januar-i 14th, for consideration of the appli-
cation of the College of Ina'.o for the vacation of portions of Twenty -third Avenue and
portions of Hazel Street and the considerat'on of those who had previously made objections

'77 Tt is imperati. *°•e that an underpass under tie right of way of the TTn1on
Pacific Pailroad in tle Cat; of Caldwell, I'ta'0, be constructed, for the following reasons
in particular:
(a) The residence districts in Crldwell, Idaho, have grown on each side of
the union Pacific right of way, that *fight- of -vray ,approximately bisectins the
city, and such an underpass wo±ild be Jeneridial in drawing the two portions
Of the City of C ldarell closer toLWlor and ma' 1n7 each more accessible to
the residents of t'9 other.
(b) Lotter and more certain fire protection could to provided owners of pro-
perty situated on the T'ortherly side of t'e railroad rig�:t of way;
(c) Pedestrian fatalities an] collisions between t:utomo.11es and trains at

particularly desirable locntion for siii 1i an underpass for these reasons;
(a) 7*ball Avenue (?iChth Avenue) is now both e unit In U.S. TTigtruay No,
30 and one of the principal end most used streets in the center of the business
district of Cn2d•:e11, Idaho. Those factors coupled with the proximity of the
business district in Caldwell, I�a!T.o, to the rnilrond right of way present
serious traffic problems; for example, traffic is often backed up and stalled
for three or four blacks in the business district when Kimball Avenue is block"
ed mom f—rily by trains on the intersectinE rnilrond tracknr
(Y) Traffic lights have.Leen ordered and will be installed on three business
district intersections with Finbnll Avenue for the nurpose of oontrnlling and
rAfiulating tTe ` flow of traffic on that avenue, w' -.1ch traffic control
will necessarily impair the "through" 1-d hway (U.S. ITo. 30) traffic thereon.
(c) Tenth Avenue in Caldwell, Idnhe Conn -ets with the proposed e:•:tension of
Franklin ?vane on the northerly side of Caldwell, and, without obstruction,
extends sout' to Fnrcher Road, 2' miles south of the City of Caldwell;
(d) The continuation of tenth Avenue in Caldwell south to Sercher Road has
been d esignsted a "far ^ -to- market" road;
(e) Fimball Avenue (eighth Avenue) r,nd 'Tlnth Avenue in the City of Caldwell
are not feasible locations for an underpass under the railroad right of :ny
since both avenues extend through the - usiness district of that City, and
such an underpass wrrild seriously devaluate the Pdjoining business properties;
(f) Mlevnnth Avenue and Twelfth Avenue in the City of Caldxell,esch extend
P 966 ®dating public schools, and therefore each would not be desirable loentioni
for heavy or through traffic h1 &vrsys or streets;
(g) Tenth Avenue in C.13well, Idaho, does not pass sny public schools and
does not pass through the business district of Cnldviell, Idaho, and accordingly
there would :so a minimum depletion of vnlues for adjoining real estate by the
construction of an underpass on Tenth Avenue;
NOW THEREFORE, FL IT T:FSOI" ^D;
1. That the Council of the City of CP]drell, Ida' - o, hereby approves the locatior
and construction of an underpass under the right of way of the Anion Pacific
Railroad at its intersection with Tenth Avenue in Caldwell, Ida'' ^o;
2. From the standpoint of essentialness and necessity, the construction of
such an undernnsA be considered s econd only to the completion of the extensinn
of Franklin Lane through the corporate limits of the City of Cald and
the construction of a new bridge ^cross the Boise River as a part of that
Franklin Lane extension program;
S. That the Director of vighways of the State of II ?aho be requested and urged
to include the project for tIe construction of such an underpass at Tenth
Avenue in Cn.Iftell, Ldo "o, as a project in the subway planning under the present
Federal Aid Program.

RESOLUTION
By Councilman Thornock.
It was moved by Councilman Thornock, seconded by Councilman Burrell that the
following Resolution.be adopted.
WHEREAS, A similar application covering the same subject matter was presented
to the Council and resolution with respect thereto was adopted November 6th, 1944;
NOW, TREREFORE BE IT RESOLVED, that said resolution previously adopted not be
altered and remain Vhe effective decision of this Council in respect to this matter.
In response to roll call upon said motion. Councilmen voting "Aye" were:
Olesen, Sloop, Mason, Burrell, Thbrnock, McNeill. Nay: None. Absent and not voting;
None.
Thereupon the Mayor declared the motion carried and the Resolution adopted.
0. L. Thornock, Councilman on the Board of Adjustment of the City of Caldwell
reported action by the Board of Adjustment approving application of U. S. Bureau of
Reclamation for special permit to erect office ';uilding on Lots 20 -21 -22 Block 61,
Original Townsits of Caldwell, Idaho.
Moved by Clasen, seconded by McNeill that the City of Caldwell enter into a
lease with W.F. Johnston for gravel pit and that the Mayor and City Clerk be authorized
to execute same on behalf and in the,name of the City-of Caldwell, Motion carried.
Councilman Olesen, Chairman of the Water Department presented a list of uncollec
able water accounts and recommended they be charged off the Water Ledger.
Moved by Mason, seconded by Burrell that the following accounts be charged off
the Water Ledger. Motion carried.
