. Owing to the absence of the Oily Clerk the Mayor appointed Mr. W. 0.
Dyer Acting Clerk and. aim onnoe& that the Counoii. was in session for the considers..

W. H. Guerin applyed for Superintendent of Memorial Yarn.
This being the date set for opening bids oallsd for in Looel Improve-
ment District No. 14, the Clerk presented and read to the Oosnoil the Affidavit .
of Publication of the Notice of Receiving Bide in Local Improvement bietriat No.

Thereupon Ooanoilman Johns introduced the following resolution and
moved its adoption.

A RESOLUTION PROVIDING FOR THE PURCHASE OF THE MATERIAL AND HIRING THE
LABOR NBOESSARY FOR HAVING THE WORK DONE BY THE CITY OF CALDWJW IN THE AONBTWO-
TION or THE IMPROVMBANT IN LOCAL IMPROTUMT DISTRRICT 10. 14, WITHOUT THE LETTING
OF ANY 0ONTRAOT THEREFOR AND WITHOUT FURTHER CALLING YOH BIDS.
WHERRIS. all bide for the oonstruotion of the improvement in Local
Improvement District Be. 14, for the Oily of Caldwell, Idaho, have been rejected
and it appearing for the beat interest of the city and' of said improvement district

IMEMS, it is Provided' ia.Bection 4163, Idaho Compiled 8tatutee,
and auction 37, Qhapter 267, Lawn of 1927, of the State of Idaho, that the City
may purchase the material and hire the labor necessary for having the work done
without the' letting Of any contract therefor, and without the further calling
for bids; now, therefore
BE IT RESOLVED, by the Mayor and Council of the ' City of Caldwell, Idaho;
Section 1. That the City of Caldwell purchase the material and hire
the labor necessary for having the work done in.Locel Improvement No.
14� in aocordanoo with the plans and specifications therefor on file in the
office of the City Engineer without the letting of any contract therefor and
without further oallii�ng for bids.
Boo. E. That each material, except sand and gravel for the construction
of manholes, be purchased from Caldwell Concrete Pipe Company and that Gabbey
& McNeil be and they hereby are hired to do the work for the construction of such
improvement, the whole not -to exceed the, sum of 06226.00
Sep, 3. -- VAIL sa }& Gabbey &MoNeil be required to furnish s bond to the

City of Caldwell in the penal sum of $8000.00 to guarantee the completion of each
work in accordance to the provisions of this resolution.
The motion for the adoption of said resolution was duly seoonded by
Gordon. The question being "Shall the resolution pase7" The Mayor diraoted the
Ole!k to call the roil which resulted as follows: Those voting in the affirmative:
Bollmagr, Pickens, Gordon, Johns, 4e1ghty and. aandmeyer. Those voting in .the
uogative:, None. Absent and nyt votings none. Whereupon the, Mayor declared the
motion carried and Resolution No, 61 adopted and directed the Clerk to record
the same upon the Journal of the proceedings of the 0oanoil.as a part of the
minutes of his meeting. Thereupon the Mayor in open session of the Council
