COUNCIL ORAMBERS, FEBRUARY 1, 1932
9.00 P. M.
The Regular Monthly Meeting of the City Council met in the Council Room, with the
Mayor, Fred L. Lilly, presiding.
On Roll Call, the following Councilmen answered present: M. S. Sandmeyer, C. E. Pal
s,
E. L. Vassar, C. M. Johnston end Joe Dickens.
The following Citizens were present: Walter Griffiths, J. H, Forbes, Ed Petrie,
Martin Jensen, Carroll Kipp, Fred'Harrington, John Kipp, Ansel Rayne, C. t. Rayne, Chas.
Satterfield, Frank Gaines, D. F. Brown, Geo. Crookham, Mrs. E. F. Tompkins, Mrs. A. G.
Fisk, Mrs. Shirley Ledbetter, Cy. Emery, Ed Meek, Hugh Caldwell, Harry Mo Cluskey and
Carpenter Anderson.
The Minutia of January 4th. 20th. and 25th. were read and approved as read.
The Clerk read Bill No. 5 for the third time. The Mayor then asked if any one
present had any thing to say either for or against the passage of the above Bill.
A number of people spoke against the passage of the Bill and about an equal number
spoke in favor of the passage of the same. After an extended discussion, the Mayor directs
the Clerk to call the Roll on the question, It Shall Bill No. 6 Pass." These voting in f
favor of the passage of the Bill were; Sandmeyer, Bales, Johnston, Di($kens and Vassar.
Those opposed , None. Absent and n6t voting, geister. Thereupon, the Mayor declared that
Bill No. 6 had passed by the necessary three - fourths . majority, and the Mayor, in open s
session of the Council, duly signed and approved said Hill, and the Clerk duly signed
and attestdd the name, which became Ordinance No. 497. The Mayor directed the Olerk to
make the proper entry of the same and to cause Ordinance No. 497 to be published in the
Caldwell Newe- Trffibune, the official newspaper of the City of Oaldwell, Idaho.

AN ORDINANCE PRESCRIBING RULES AND REGULATIONS FOR THE CONDUCT OF PUBLIC
AUCTIONS AND PUBLIC SALES GROUNDS.

BE IT ORDAINED by the Mayor and Council of the City of Caldwell, Idaho:
Section 1. From and after the passage,. apnroval and publication of this
Ordinance it shall be unlawful for any person, firm or corporation to construct, maintain
or establish any public 'auction or public sale ground where goods, wares, merchandise,
livestock or poultry are sold or as offered fo�sale within the limits of the City of
Caldwell, Idaho, without the consent of the Mayor and Cmuno� said City; provided,

however, this section shall not apply to public auctions orASales grounds that have been
established and are operating at the time of passage end apptoval of this ordinance.
Section 2. All public auction or public sale grounds shall comply with the Fir
Ordinances off the City of Caldwell, Idaho, which have been or may hereafter be.enacted
and with such rules and regulations concerning sanitation as may be prescribed by the Boar
of Health of the City of Caldwell and Canyon County, and the Department of Public Welfare
ozIbe State of Idaho.
JJ Section 3. All pens in which livestock or poultry in kept shall have concrete
floors and shall be thoroughly cleaned and washed immediately (and on the day of each sale.
Section 4. No livestock or poultry shall be kept upon the peemises after seven
thirty OIClock P. M.
Section 5. All manure and refuse shall be hauled away within twenty -four hours

after each sale.

Section 6. Public auctions or public sales shall be so conducted as to not become

a nuisance to surrounding property- owners or interfere with traffic upon the streets or
sidewalks.
Section 7..All buildings, fences, pens and structures of all kinds shall be so
constructed and maintained as to not become a fire hazard to surrounding property or to
jeopardize the lives of the public.
Section S. Any person, firm or corporation violating any of the provisions of this

ordinance Shall ye guilty of a misdemeanor and upon conviction thereof shall be punished

by a fine/not to. exceed One Hundred Dollars ( 100.00).
section 9, This ordinance shall take effect and be in force and effect from and
after its passage, approval and publication.

Walter Griffiths appeared and presented the matter of the cancellation of the
delinquent taxes.on Late 13 to 16, Block 18, Dormans Addition, up to and including the
Year 1930.
The Mayor appointed Dickens and 'a.ndmeyer as a Committee to look into the matter
and report back to the next meeting of the Council.
Hugh N. galdwell appeared and presented a Petition asking permissi

a gasoline storage tank on Lots 22 and 23, Block 3, Original Town by the Idaho Co.
Moved by,Dickens and seconded by Vassar that the Mayor appoint a Committee of
three to investigate the matter. said Committee to be empowered to act. Motion Carried.
The Mayor appointed Sandmeyer, Bales and Vassar as the above committee.
The following Bills were read and on motion made by Dickens and seconded by
Vassar that these, bills be allowed and Warrants be drawn for the various amounts, all of
which had been approved by the Chairman of the Finance Committee. Motion Carried

RESOLUTION NO. 6
By the Council
A RESOLUTION GIVING THE IDAHO POWER COMPANY PERMISSION TO INSTALL ONE CERTAIN
ELECTRIC TRANSMISSION LINE WITHIN ANV UPON SEk, NE� 15 -4n -3W AND AUTHORIZING THE MAYOR
TO EXECUTE AN EASEMENT FOR THAT PURPOSE.
WHEREAS, Idaho Power Company is installing an electrio transmission line within
8Ek NEB, 15- 4 of this City, for the purpose of serving the City of Caldwell and cer-
tain individuals at and in the vicinity of Canyon Hill Cemetery in the City of Caldwell;a
WHEREAS, in connection with the installation of said electric transmission line,
it has been necessary that said Company NH place certain parts of its system in places
other than on the roadway within said'lands;
NOW, THEREFORE, BE IT RESOLVED that the Idaho power Company be, and hereby is,.
given permission to occupy said land with said electric transmission line, and the Mayor
Of this City be, and he hereby is, authorized, in his official Capacity, to execute tb

said Company the necessary easement for Aaid purpose.

A Call meeting of the City Council met in the Council Room of the City Hall, with
M. S. Sandmeyer, president of the Council, presiding in place of the Mayor, Fred L. Lilly
who was ill.
On Roll.0all, the following Councilmen answered present; M. S. Sandmeyer, A. G.
Keister, C. E. Bales, Joe Dickens and C. M. Johnston. Absent E. L. Vassar,
This was the: day on which the Boy Scouts of Caldwell had taken over the various
offices of the Ci:tyrs government from 4 :00 to 5:00 P. DR. And at this meeting the Scout
Council were present as follows: Bob Froman as Mayor, Bobbie Murray as City Clerk and
Charles Mc Bride, James Ruark, Paul Parrish, Ronald Street and Bert English as Oounellmen
besides some twelve other Boy Scouts. The acting Mayor gave the Scouts a nice talk, ex-
plaining the duties of the various officers, The Boys showed great interest in the City's
affairs, casting their own votes on the different questions that came up before the
regular Council.
11. S. Sandmeyer brot up "he matter of the accident to the Sprinkler, and on motion
made by Dickens and ascended by Johnston, it was moved bliat the Mayor be empowered to
employ R. B. Seatterday to assist the City Attorney in bringing legal action to collect
the insurance. Motion Carried.
The Clerk read an Estimate from the Idaho Power 00, giving the estimated price for
installing nine additional lights from the Bridge across the Boise River along Kimball
Street to Olevaland Blvd, and along Cleveland Blvd. to 23rd. Street.
Moved by Bales and seconded by Dickens that. we accept the proposition as made by the
Idaho Power Co and install the nine lights at the following points:
