1 to 81, both numbers inclusive. Much bonds are being sold for the purpose of paying

Pursuant to adjournment of the special adAourned meeting of the City Council of
the City of Caldwell, Canyon County, State of Idaho held on the 4th day of January, 1935,
and pursuant to the adjournment of the regular meeting of said City Council, held on the

7th day of January, 1935, the Mayor and City Council of the City of Caldwell, eanyon
County, Idaho met at the hour of 8 otclock p. M, this 29th day of January, 1935 in the Ci

Hall at said City, being the time and place advertised for the opening and consideration
of bids by the City Council, on file with the City Clerk pursuant to ¢otiee of sale of
681,000 legally issued direct obligation 4% Refunding Bonds of the said City of Caldwell,
dated January 1, 1935 and known as Refunding Bonds, Series 1935.
The Mayor, Emery L. Vassar called the meeting to order, and the roll call shove
the following present, to -wit: Mayor: Emery L. Vassar. City Clerk: 0. E. Fritts.

Councilmen: Edgar L. Oakes, F. D. Mumford, W. S. Boynton, G. M. Fenrich and W. R. Holling

worth; Absent: G.W. Montgom-r y.

It appearing there was a quorum of the Council present, the Mayor asked the Cit
Clerk if there were any bids on file for the purchase of said bonds, thereupon the City
Clerk produced one sealed bid, and was directed by the Mayor that said bids be openedi
whereupon the ^bids were opened and read as follows, to -wit:
"Bid from Continental National Bank & Trust Company of Salt Lake
City, Utah for par and accrued interest for 4% bonds as d@ecribed
icfi notice of sale, with cashier's check on the First National Bank
of Caldwell, Idaho attached for $4100.00:"
After duly considering the said bid, the following motion was made by Councilmai
Hollingsworth and seended by Councilmen: Fenrich to -wit:
It appears, after due consideration of all the bids offered for the purchase of
$81,000.00 Refunding Bonds descried in the notice requesting bids heretofore published
by order of the City Council, that there has been one bid filad and after duly consider-
ing said bids, it appears that the bid of Continental National Bank & Trust Co., of Salt
Lake City, Utah, is a fair and reasonable offer for the purchase of said bonds and is
the best bid obtainable, and that it is to the best interest of the City of Caldwell to
accept said bid.
Now, therefore, be it resolved that the said bid submitted by Continental Natio

Bank & Trust Co., of Sald Lake City, Utah be, and the same is, hereby accepted and said

bonds are sold to said bidder.
Be it further resolved that the Mayor of theCity of Caldwell is hereby authorized
to sign the acceptanfe of said bid for and on behalf of the City, and cause said acceptance
to be attested by the City Clerk under the seal of the City.

whereupon, the Mayor declared said motion adopted and that said bid had been
accepted and the said bonds sold to Continental National Bank & Trust Co., Salt Lake City
Utah.

off a like amount of outstanding legal bonds of the City, as set forth and described in
Ordinance 516 passed by the City Council at its special meeting held on the 17th day of
December, 1934, beginning at the hour of 8 P. M. of said day.
Thereupon, Councilman Oakes moved the adoption of said resolution, which motion
was seconded by Councilman Mumford said resolution being as follows, to-wit-

9dHEREAS, the City of Caldwell has duly authorized the issuance
Of $81,000.00 refunding bonds of said City dated January 1, 1935,
in denominations of $1,000.00 each and numbered from 1 to 81, both
Inclusive, and
AREAS, all ordinances and matters necessary for the issuance
of said bonds have been passed, done and fully complied with and said
bonds have been prepared under the direction of the proper officers
of said City of Caldwell in proper form, as authorized by ordinance
No. 516 of said City and have been signed by the Mayor of said City
and attested by the signature of the City Clerk of said City and the
City Treasurer of said City, all in full compliance with the law and
said Ordinance No. 515 of said City, and
WHEREAS, said City caused Notice to be given, as required by law,
requesting bids for the sale of said bonds, which bids were made, as
required by law and opened by the City Council at a session thereof
regularly.held on the 29th day of January, 1935, at the hour of 8
o'clock, P. M. and upon opening said bids and full consideration there-
of, the bid of Continental National Bank & Trust Co., Salt Lake City,
Utah was accepted and said bonds were sold to said bidder, and
3CMREAS, said bonds have been duly registered by the City Clerk,
in numerical order, in a permanent public record book kept by him in
his said office for that purpose, and sugh registration endorsed on
said bonds and signed by the City Clerk, and .
r1M1REAS said bonds having been delivered by the City Clerk to
the City Treasurer, and his receipt taken therefor, and said City
Treasurer having registered the.same in a permanent public record
book kept by him in his office for that purpose in the manner provided
by law, and the law and the ordinances of the City having been in all
respects complied with by the officers of said City in connection witch
the execution and registration of said bonds, and the some now being l
ready to be delivered to the purchaser thereof:
NOSH, THEREFORE, BE IT RESOLVED That the City Treasurer is hereby
authorized and directed to deliver said bonds to the said purchaser
Continental National Bank & Trust Co., Salt Lake City, Utah, which
shall give their receipt therefor and pay to the City Treasurer there-
for a sum equal to par and accrued interest for said bonds. That the
money so received for said bonds shall b•e immediately deposited by
the City Treasurer in the First National Bank of Caldwell, Idaho,
in a special, separate fund, apart, the purpose of paying the
principal of the following outstanding bonds of said City:
$67,000 Refunding Bonds, dated January 1, 1925, due January 1,
1945, and bearing interest at the rate of 5-j% per annum, and numbered
1 to 67, inclusive.
014,000 (being part of a total authorized $25,500) Funding Bonds,
dated July 1, 1920, due July 1, 1940, bearing interest at the rate Of
6 % per annum, and numbered 10 to 23 both inclusive:
and none of such funds shall he otherwise used until all of such
bonds are fully paid, retired, and cancelled.
BE IT FURTHER RESOLVED That said First National Bank of Cal.dvell,
Idaho is hereby authorized to take from said fund and pay any of said
bonds a5presented, and deliver such bonds so paid to the City Treasurer
for cancellation and the City Treasurer is hereby authorized and direct-
ed to deliver a letter of instructions to the said bank authorizing
It to make said payments of the principal of said bonds from said fund,
and charge the fund with the same until all of said bonds herein
mentioned are fully paid.
Said resolution was duly considered and the roll of the Council was ordered
called thereon by the Mayor and resulted as follows: Ayes: Edgar L. Oakes, F.D. Mum-
ford, 17. S. Boynton, G. M. Fenrich and o7. R. Hollingam rth. Nays: None.
Whereupon, the Mayor declared the said resolution duly adopted.
Mr. Vassar and Mr. McConnel gave a,.detailed report of the Northwest.Regional
Board which met in Seattle, December 12,13,14. It was brought out in the report that the
City Planning Board would be recognized Yn the future more than in the past In--A matter
in the matter of securing public funds. It was also brought out that the State of Idaho
was poorly organized and had not received their portion of goverment funds as compared
Witt Washington, Oregon and Montana.
There being no further business to come before the Council, it was, on motion
duly seconded and carried, declared adjourned. to meet Feb ruar 7th.,

The Regular Monthly Meeting of the City council met in the Council Room of the
City Hall, with the Mayor, Emery L. Vassar, presiding.
On Roll Call the following Councilmen answered present: Edgar L. Oakes, F. D.
Mumford, G. W. Montgomery, G. M. Fenrieh and W. R. Hollingsworth. Absent: W, S, Boynton.
The minutes for January 7th, 8th, 21st., 29th, were read and approved as read

with a few corrections.
IDs. Wagoner appeared before the Council and stated that he wished to sell the
, garbage contract to Mr. Bunt. The Mayor informed Mr. Wagoner that Mr. Hunt would have to
appear before the Council at the next regular meeting before the contract could be trans -
fered.
Mr. J. H. McNeal appeared and asked that a new bridge be constructed across
Indian Creek at 11th and Arthur.
Moved by Oakes, seconded by Mumford that the City; Engineer and the Road Com-
mittee investigate this matter. Motion carried.
The City Clerk read an Affidavit of Publication.
The Mayor informed the Council that Mr. of Ontario, Oregon, wished to
borrow the city crusher; The City attorney in,, "ormed the Mayor and City Council that it
was out of the jurisdiction of the city. Moved by'hientgomery, seconded by Hollingsworth
that thls request be rejected. ¬ion carried.
The Committee reported to the Council that arrangements had been made for the
removal of the McWilliams corral.
The Bills for January were read and on notion made by Mumford, seconded by
Montgomery that these bills be allowed and Warrants be ordered drawn for the various
amounts all of which had been approved by the Chairman of the Finance Committee. Motion
carried.
